शनिवार (3 अक्टूबर) की शाम मुंबई में तेज़ बारिश हो रही थी और कई इलाकों में पानी भर गया था। घाटकोपर के पास शिवाजी नगर स्थित आशापुरा सोसाइटी में रहनेवाली 32 साल की एक गृहिणी शीतल भानुशाली, पास की आटा चक्की से आटा लाने के लिए अपने घर से बाहर निकली । शीतल का 8 साल का बेटा यश भी उनके साथ जाना चाहता था, लेकिन बारिश के चलते वह उसे साथ नहीं ले गईं और चॉकलेट देकर घर पर ही रुकने के लिए मना लिया। इसके बाद शीतल कभी नहीं लौटीं। उनका बैग एक खुले मैनहोल के पास पड़ा मिला। नाले के पानी के तेज बहाव के मैनहोल का फाइबर कवर उखड़ गया था।

कई घंटे की खोजबनीन के बाद शीतल के पति जीतेश ने घाटकोपर थाने में शीतल के लापता होने की शिकायत दर्ज कराई। जीतेश एक कपड़े की दुकान में काम करते हैं। इसके बाद पुलिस और फायर ब्रिगेड ने शीतल की तलाश शुरू की। घाटकोपर थाने के एक सब-इंस्पेक्टर ने कहा, ‘हमने 200 मीटर के दायरे में सभी नालों की तलाशी ली, लेकिन महिला का कुछ पता नहीं चला।’ इसके बाद तारदेव, कुर्ला, साकी नाका, बांद्रा और माहिम तक शीतल की तलाश की गई जहां से सीवेज लाइन जुड़ी हुई है। करीब 34 घंटे के बाद सोमवार को तड़के 3 बजे तारदेव पुलिस ने बताया कि शीतल का शव हाजी अली की दरगाह के पास समंदर में तैरता हुआ मिला है।

इस मामले में जब बृहन्मुंबई नगर निगम (BMC) की तरफ उंगलियां उठीं तो वह तुरंत बचाव की मुद्रा में आ गया। पहले तो बीएमसी ने डिप्टी कमिश्नर स्तर के अधिकारी को 15 दिनों के भीतर जिम्मेदारी तय करने के लिए कहा, लेकिन इसी बीच BMC के अधिकारियों ने यह भी कहना शुरू कर दिया कि मामला संदिग्ध लग रहा है। BMC के एक वरिष्ठ अधिकारी ने कहा, ‘महिला की लाश माहिम में मिलनी चाहिए थी क्योंकि घाटकोपर ड्रेनेज लाइन असल्फा (शीतल के इलाके) से होकर गुजरती है और मीठी नदी में जाकर खत्म होती है। हमें यह घटना थोड़ी संदिग्ध लग रही है और हम विस्तार से जांच कर रहे हैं।’

भानुशाली के परिवार का कहना है कि BMC ने हाल ही में कंक्रीट के मैनहोल कवर को हटाकर हल्के फाइबर से बना कवर लगाया था, जो बारिश के दौरान पानी के तेज बहाव को नहीं झेल सकता। BYL नायर अस्पताल की पोस्टमॉर्टम रिपोर्ट में बताया गया कि महिला की मौत डूबने से हुई। मुंबई जैसे बड़े महानगर में यह डूबने की एक छोटी सी घटना हो सकती है, लेकिन मेरी आंखों के सामने शीतल की झाई साल की बेटी की तस्वीरें घूम रही है, जो बार बार पूछ रही है कि मम्मी कहां है। इस समय यह बच्ची अपनी दादी की देखरेख में हे । मैं पूछना चाहता हूं कि इन दो बेगुनाह बच्चों की मां की मौत के लिए कौन जिम्मेदार है। क्या शीतल मुंबई नगर निगम की संवेदनहीन व्यवस्था की शिकार नहीं हुईं ? बीएमसी आखिर भारत का सबसे अमीर नगर निगम है, जिसके पास पैसे की कोई कमी नहीं है।

शीतल की बेटी ध्वनि के इस तड़पते सवाल का जवाब आखिर कौन देगा, ‘मेरी मम्मी कहां है?’ शीतल का 8 साल का बेटा यश खामोश है। वह जानता है कि उसकी मां अब इस दुनिया में नहीं रहीं, और वह अपने पापा को किसी भी तरह से परेशान नहीं करना चाहता, इसलिए वह इन दिनों चुप रहता है।

मैंने अपने रिपोर्टर्स को शीतल के घर, उसके इलाके और हाजी अली के पास समंदर के किनारे भेजा। शीतल के घर के पास वह गली मुश्किल से 3 फीट चौड़ी है, और मैनहोल पर एक फाइवर कवर लगा हुआ था। पड़ोसियों के मुताबिक, शनिवार की शाम बारिश के दौरान पानी के दबाव के कारण ये कवर अपनी जगह से हट गया था। हैरानी की बात यह है कि शीतल अपने घर के पास मैनहोल के अंदर गिरीं और उनकी लाश 20 से 25 किलोमीटर दूर समंदर में बहती मिली ।

BMC के अधिकारियों का कहना है कि यह सीवर लाइन समंदर में जाकर नहीं मिलती। साफ है कि BMC अपनी जिम्मेदारी से पल्ला झाड़ने की कोशिश कर रही है। शीतल के इस इलाके में रहने वालों ने BMC से पीड़ित परिवार को मुआवजा देने की मांग की है, लेकिन मुंबई की मेयर किशोरी पेडनेकर का कुछ और ही मानना है।

पेडनेकर का तर्क यह है कि कोई लाश ड्रैनेज सिस्टम से बहकर समंदर तक कैसे पहुंच सकती है जबकि वह लाइन समंदर में मिलती ही नहीं। पेडनेकर का दावा है कि ड्रेनेज सिस्टम के अंदर बह रहे कूड़े को रोकने के लिए लोहे के जाल लगाए गए हैं। मेयर पूछ रही हैं कि ऐसे में महिला की लाश बहकर समंदर तक कैसे पहुंच सकती है। जहां तक मैनहोल के ढक्कन खुले होने का सवाल है, पेडनेकर का कहना है कि हर बार BMC को दोष देना ठीक नहीं हैं, क्योंकि कई बार लोग अपने घरों के पास जाम सीवर को खोलने के लिए खुद ही ढक्कन हटा देते हैं और फिर मेनहोल को खुला छोड़ देते हैं।

मैं मुंबई की मेयर को याद दिलाना चाहता हूं कि 29 अगस्त 2017 को मुंबई के जाने-माने गैस्ट्रोएंटेरोलॉजिस्ट डॉक्टर दीपक अमरापुरकर की मौत भी ऐसे ही हुई। तेज़ बारिश के कारण जलभराव होने से डॉक्टर अमरापुरकर एल्फिंस्टन रोड इलाके में फंसी अपनी कार से बाहर निकले, और छाता लेकर पैदल आगे बढ़े। इसी दौरान वह एक खुले मैनहोल में गिर गए। बाद में मैनहोल के पास उनकी छतरी पड़ी मिली। डॉक्टर अमरापुरकर की लाश 2 दिन बाद वर्ली में मिली ।

29 जुलाई, 2019 को 2 साल का बालक दिव्यांश गोरेगांव ईस्ट में एक खुले मैनहोल में गिर गया था। पुलिस, फायर ब्रिगेड और NDRF की टीमों ने गोरेगांव और वेस्टर्न रेलवे के ट्रैक के नीचे से लेकर मलाड की खाड़ी के सीवर तक काफी तलाशी ली लेकिन तमाम कोशिशों के बावजूद दिव्यांश का शव नहीं मिला। इस घटना के एक हफ्ते बाद बीएमसी ने यह कहकर अपना पल्ला झाड़ लिया कि उस मैनहोल कवर को कुछ कूड़ा बीनने वालों ने चुरा लिया था।

मैंने मंगलवार को अपने एक रिपोर्टर को सांताक्रूज भेजा । उन्हें सेंट लॉरेंस स्कूल के सामने सड़क के ठीक बीचोंबीच एक खुला मैनहोल दिखा। मैनहोल पर कवर लगाने के लिए बीएमसी स्टाफ ने कोई कोशिश नहीं की। लोगों को खतरे से आगाह करने के लिए वे मौके पर सिर्फ लकड़ी का एक टुकड़ा रखकर चले गए।

साफ है कि BMC के अधिकारी पिछली गलतियों से सीखने को तैयार नहीं हैं। ऐसा नहीं है कि BMC के पास पैसे की कमी है। इसका सालाना बजट लगभग 30,000 करोड़ रुपये का है। हर साल BMC नालों की सफाई का सैकड़ों करोड़ रुपये का टेंडर जारी करती है। हर साल BMC खुले सीवर को ढकने का दावा करती है। हर साल सड़कों के गड्ढे भरने के लिए करोड़ों रुपये का टेंडर जारी किया जाता है। हर साल बीएमसी दावा करती है कि उसने सभी खुले मैनहोल्स पर कवर लगाने की व्यवस्था की है, लेकिन ये काम कब शुरू होते हैं और कब खत्म हो जाते हैं, कोई नहीं जानता। यह भी कोई नहीं जानता कि पैसा किसकी जेब में जाता है।

सबसे बड़ा सवाल तो यह है कि आखिर मैनहोल को प्लास्टिक के हल्के ढक्कन से बंद करने का सुझाव BMC को किसने दिया। अगर वाकई में मुबंई में सारे मेनहोल पर अब कंक्रीट की बजाए प्लास्टिक ढक्कन रखे जा रहे हैं, तो ये आम मुम्बईकर के लिए चिंता और डर की बात है। तेज़ बारिश के समय प्लास्टिक के ये ढक्कन पानी के प्रेशर से हट जाते हैं । ऐसे में इस तरह के हादसे होते रहेंगे और लोग खुले गटर में गिरते रहेंगे।

शिवसेना के हाथ में इस समय BMC की बागडोर है और महाराष्ट्र सरकार की भी। क्या मुख्यमंत्री उद्धव ठाकरे सुन रहे हैं? क्या वह 12 साल के यश और 2.5 साल की ध्वनि को न्याय दिला पाएंगे? क्या अब BMC अब अपनी नींद से जागकर सभी मैनहोल्स पर कंक्रीट के कवर लगाएगी, और यह सुनिश्चित करेगी कि इसमें गिरकर किसी की जान न जाए। मुझे इन सवालों के जवाब का इंतजार है।

On Saturday (October 3) evening, it was raining heavily in Mumbai and there was waterlogging in many localities. A 32-year-old housewife, Sheetal Bhanushali, stepped out of her home in Ashapura society in Shivaji Nagar near Ghatkopar to collect ‘atta’(flour) from a nearby flour mill. Her eight-year-old son Yash wanted to accompany her, but because of rain, she persuaded him to stay at home by offering him a chocolate. The lady never returned. Her bag was found near an open manhole. The fibre cover of the manhole had been blown off under tremendous pressure of gushing drain water.

After a search lasting several hours, Sheetal’s husband, Jeetesh, who works in a garment store, filed a missing person complaint with the local police. Police and fire brigade launched a hunt for Sheetal. “We searched all the drains in a radius of 200 metres, but there was no sign of the lady”, said a sub-inspector of Ghatkopar police station. The search was later extended to Tardeo, Kurla, Saki Naka, Bandra and Mahim to which the sewage line is connected. Nearly 34 hours later, at around 3 am on Monday, Tardeo police reported that Sheetal’s body was found floating in the sea off Haji Ali shrine.

With fingers being pointed at the civic body, Brihanmumbai Municipal Corporation (BMC) immediately went into a defensive mode. It first asked a deputy commissioner level officer to fix responsibility within 15 days, but in the meantime, BMC officials started saying that the matter appears to be suspicious. “The body should have been found in Mahim as the Ghatkopar drainage line passes through Asalfa (Sheetal’s locality) and ends in Mithi river. We are a little suspicious about the incident and are making a detailed inquiry”, said a senior BMC official.

Bhanushali’s family says, the BMC had recently replaced the concrete manhole cover with a cover made of light fibre, which cannot withstand tremendous drainage water pressure during rains. A post mortem report from BYL Nair Hospital says the death was caused by drowning.

This may be only one incident of drowning in a big metropolis like Mumbai, but looking at the sad faces of Sheetal’s two kids, presently in the care of their grandmother, my question is: whom should we hold responsible for Sheetal’s death? Was she not a victim of the callous civic system that we have in Mumbai, which boasts of funding the richest municipal body in India?

Who will reply to the plaintive query of Sheetal’s two-and-a-half year old daughter Dhwani, ‘where is my mom?’ Sheetal’s eight-year-old son Yash is silent. He knows his mom is no more, and he doesn’t want to pester his Papa any more and has therefore opted to stay silent.

I sent my reporters to Sheetal’s home, her locality and to the seafront near Haji Ali. The lane was hardly three feet wide, and a fibre cover had been put on the manhole. On Saturday evening, during rains, the cover came off due to drain water pressure, according to neighbours. It is strange that Sheetal fell inside the manhole and her body was fished out from sea, at a distance of nearly 20 to 25 km from her locality.

BMC officials say, this drain is not connected to the sea. Clearly, BMC is trying to disown its responsibility for sheer callousness. Residents of the locality have demanded that the BMC must pay compensation to the victim’s family, but Mumbai Mayor Kishori Pednekar thinks otherwise.

Pednekar questions how a body can float through a drainage system that has no outlet to the sea, and yet the body is recovered from sea. She claims that there are a lot of garbage inside the drainage system, and iron nets have been fixed inside. How could the body surface in the sea, asks the Mayor. Pednekar instead blames residents who prise open the manhole covers whenever there is a blockage in their local drainage system.

I want to remind the Mumbai Mayor that on 29th August, 2017, Mumba’s top gastroenterologist Dr Deepak Amrapurkar came out of his car stalled in the waterlogged Elphinstone Road locality, and was walking in heavy rain with an umbrella, when he fell into an open manhole. His umbrella was found at the spot. Two days later, the doctor’s body was found in Worli.

On July 29, 2019, two-year-old Divyansh fell into an open manhole in Goregaon East. His body could not be found after massive search by police, fire brigade and NDRF personnel in Goregaon, beneath the Western Railway track and near the bay at Malad. A week after the incident, BMC said that the manhole cover had been stolen by some ragpickers.

I sent one of my reporters to Santa Cruz on Tuesday. He found an open manhole right in the middle of the road opposite St. Lawrence School. BMC staff had made no effort to put a cover on the manhole. They had put a plyboard at the spot to warn people of danger.

Clearly, BMC officials are unwilling to learn from past mistakes. It is not that BMC is short of funds. Its annual budget is nearly Rs 30,000 crore. Every year, BMC calls for tenders worth hundreds of crores of rupees for cleaning drainage systems, every year BMC calls for tenders worth crores to fill up potholes on the city roads, every year BMC claims that it has made arrangements to put covers on all open manholes, but nobody knows when work is done on these projects and is completed, and who pockets the money spent from the civic body’s coffers.

I want to know who gave BMC the bright idea of replacing concrete covers with plastic or fibre ones on manholes. It is a matter of concern and can spread fear among Mumbaikars. In times of heavy rains, these fibre covers are bound to be forced open by gushing drain water. People are bound to fall in open gutters.

Shiv Sena runs both the BMC and the Mahrashtra government. Is chief minister Uddhav Thackeray listening? Can he ensure justice for eight-year-old Yash and two-and-a-half-year-old Dhwani? Will BMC wake up now, put concrete covers on all manholes and ensure that people do not fall into it? I am waiting for answers.

सुप्रीम कोर्ट ने मंगलवार को यूपी सरकार को निर्देश दिया कि वह हाथरस गैंगरेप केस में पीड़िता के परिवार एवं अन्य गवाहों के लिए विटनेस प्रोटेक्शन प्लान के साथ एक हलफनामा पेश करे। राज्य सरकार को यह भी बताने के लिए कहा गया है कि क्या परिवार के पास अपने प्रतिनिधित्व के लिए कोई वकील है। इस मामले की सुनवाई एक हफ्ते बाद फिर होगी।

भारत के चीफ जस्टिस एस. ए. बोबडे ने कहा, ‘हम जानना चाहते हैं कि क्या पीड़ित परिवार के पास कोई वकील है। इलाहाबाद हाई कोर्ट की कार्यवाही (12 अक्टूबर को होने वाली) को लेकर और हम इसे और ज्यादा प्रासंगिक कैसे बना सकते हैं, इस बारे में हम आपसे (सॉलिसिटर जनरल तुषार मेहता) भी सुझाव चाहते हैं। हमें यह भी रिकॉर्ड पर चाहिए कि विटनेस प्रोटेक्शन प्लान पहले से ही लागू है।’ उत्तर प्रदेश सरकार की तरफ से पेश होने वाले सॉलिसिटर जनरल की मांग थी कि सुप्रीम कोर्ट को खुद हाथरस केस की CBI जांच की निगरानी करनी चाहिए। तुषार मेहता ने कहा, ‘एक युवा लड़की की मौत को सनसनीखेज न बनाया जाए, और इस मामले की सही और निष्पक्ष जांच की जाए।’

भारत के मुख्य न्यायाधीश ने हाथरस की घटना को ‘भयानक और चौंकाने वाला’ करार दिया। CJI बोबडे, जस्टिस ए. एस. बोपन्ना और जस्टिस वी. रामसुब्रमण्यम की बेंच इस मामले की सुनवाई कर रही है। सुप्रीम कोर्ट द्वारा जनहित याचिका पर सुनवाई शुरू करने से कुछ घंटे पहले उत्तर प्रदेश सरकार ने पीड़िता का उसके गांव में आनन-फानन में अंतिम संस्कार किए जाने के बचाव में 16 पन्नों का एक हलफनामा दायर किया।

राज्य सरकार ने अपने हलफनामे में आरोप लगाया कि कुछ राजनेताओं और मीडियाकर्मियों ने कथित रूप से पीड़ित के परिवार के सदस्यों को उकसाया था और हिंसक विरोध-प्रदर्शन हुए थे, जिसकेचलते ‘परिजनों की उपस्थिति में’ रात में ही अंतिम संस्कार किया गया। राज्य सरकार ने कहा, ‘असाधारण परिस्थितियों और कानून व्यवस्थआ की स्थिति को ध्यान में रखते हुए जिला प्रशासन को पीड़िता का अंतिम संस्कार रात में करने के लिए असाधारण कदम उठाने के लिए मजबूर होना पड़ा। अंतिम संस्कार पीड़िता के परिजनों की मौजूदगी में हुआ, जो संभावित हिंसा की स्थिति से बचने के लिए इसपर सहमत हुए।’

राज्य सरकार ने अपने हलफनामे में यह आरोप लगाया कि कुछ राजनैतिक दलों और मीडिया के एक वर्ग द्वारा सोशल मीडिया और विरोध-प्रदर्शनों का इस्तेमाल करके सरकार की छवि को धूमिल करने के लिए ‘दुष्प्रचार’ किया गया। यह भी आरोप लगाया गया कि ‘हाथरस की घटना का इस्तेमाल करके सांप्रदायिक और जातीय दंगों को उकसाने की एक योजनाबद्ध कोशिश की गई, और इसलिए यह उचित होगा कि न्यायालय की निगरानी में समयबद्ध तरीके से इसकी सीबीआई जांच कराई जाए।’ सरकार ने अपने हलफनामे में कहा, ‘सुप्रीम कोर्ट की निगरानी से यह सुनिश्चित हो जाएगा कि जांच के दौरान किसी प्रकार की झूठी कहानियां इसमें हस्तक्षेप नहीं करें।’

राज्य सरकार ने यह भी बताया कि ‘पीड़िता ने पुलिस को दिए अपने पहले बयान में बलात्कार का जिक्र नहीं किया था और उसने रेप का आरोप अपने दूसरे बयान में लगाया जिसके बाद सभी चारों आरोपियों को गिरफ्तार किया गया।’

पिछले कुछ दिनों से हाथरस की बेटी से जुड़े हर अपडेट पर मेरी नजर है। मैंने इस दौरान सैकड़ों वीडियो देखे हैं और पीड़िता एवं उसके माता-पिता के बयान सुने हैं। मैंने पीड़िता के शव का रात में ही अंतिम संस्कार किए जाने को लेकर पुलिस और प्रशासन के तर्क भी सुने हैं। मैं आपको ये भी बता दूं कि उत्तर प्रदेश पुलिस के बहुत सारे अफसरों ने इस घटना के बारे में मुझसे बात की है, और जिस तरह से हाथरस पुलिस ने इस मामले को डील किया, उसको जस्टिफाई करने के लिए उन्होंने कई तर्क दिए। उनके तर्क क्या हैं, ये मैं आपको एक-एक करके बताता हूं।

पहला तर्क, यह घटना दिन में 10.30 बजे के आसपास हुई और पीड़िका अपने माता-पिता के साथ पुलिस स्टेशन गई। तुरंत केस दर्ज हुआ, और पहले उसे जिला अस्पताल और फिर 2 बजे तक उसे AMU के हॉस्पिटल में ऐडमिट भी करवा दिया गया। पुलिस का ये भी कहना है कि पहले दिन उस लड़की ने बलात्कार की शिकायत नहीं की थी, इसलिए उस दिन डॉक्टरों ने रेप से जुड़ा कोई टेस्ट नहीं किया।

मैंने हॉस्पिटल के बाहर चबूतरे पर लेटी दर्द से तड़पती 19 साल की लड़की का वीडियो देखा है। लड़की वहां दर्द से तड़प रही है, और वहीं 2 पुलिस वाले खड़े हैं जो उसके परिवार वालों से बयान ले रहे हैं। इसके बाद मैंने हॉस्पिटल के स्ट्रेचर पर पड़ी, दर्द से कराह रही लड़की की बात सुनी है जिसमें उसने टूटे-फूटे लब्जों में आरोपी द्वारा अपने साथ की गई जबरदस्ती की बात कही है। उसने कहा, ‘चोट इसलिए लगी, गर्दन इसलिए टूटी क्योंकि मैंने संदीप को अपने साथ जबरदस्ती नहीं करने दी।’

यूपी पुलिस के अफसरों से मेरा सवाल यह है कि जुल्म की शिकार लड़की इससे ज्यादा और क्या कहेगी? क्या किसी महिला के साथ जबरदस्ती का मतलब रेप नहीं है? कानून तो यही कहता है। मैं मानता हूं कि शुरू में ही रेप का केस दर्ज न करना, ये पुलिस की पहली बड़ी लापरवाही थी।

यूपी पुलिस के अफसरों का कहना है कि पीड़िता ने घटना के 8 दिन बाद दुष्कर्म का आरोप लगाया, और जैसे ही उन्होंने आरोप लगाया पुलिस ने FIR में रेप का आरोप भी जोड़ दिया। घटना के 11 दिन बाद मेडिकल टेस्ट किया गया। हर पुलिसकर्मी जानता है कि यदि घटना के 96 घंटे बाद मेडिकल टेस्ट किया जाए तो ऐसे मामलों में जांच से कुछ नहीं होता, बलात्कार का कोई सबूत नहीं मिल सकता। पुलिस किसे बेवकूफ बनाने की कोशिश कर रही है? यह लापरवाही नंबर 2 थी। इसी के चलते पुलिस की नीयत पर शक हुआ।

तीसरी बात पुलिस अफसरों ने कही कि लड़की की मां ने 3 बार बयान बदले। उनके मुताबिक, पीड़िता की मां ने पहले कहा कि गला घोंटा गया, इसके बाद उसने कहा कि रस्सी से गला दबाया गया, और फिर कहा कि दुपट्टे से गला घोंटा गया। मेरा कहना यह है कि इस बात से क्या फर्क पड़ता है कि गला कैसे दबाया गया? इससे क्या फर्क पड़ता है कि गला हाथों से दबाया गया, रस्सी से दबाया गया या दुपट्टे से? कड़वा सच तो यह है कि आरोपी द्वारा गला दबाने से हुई स्पाइनल इंजरी के चलते एक बेटी ने तड़प-तड़प कर अपनी जान दे दी। यह पुलिस की लापरवाही नंबर 3 थी।

चौथी बात यह है कि जब पुलिस को यह पता चला कि स्पाइनल इंजरी के चलते लड़की की हालत खराब है और वह दर्द से तड़प रही है, तो उसे दिल्ली शिफ्ट करने में देरी क्यों की गई? इसके जवाब में पुलिस का कहना है कि लड़की का परिवार शुरू में उसे इलाज के लिए दिल्ली शिफ्ट करने के लिए तैयार नहीं था। यदि मैं पुलिस की यह बात मान भी लेता हूं, तो मेरा सवाल यह है कि: जब पुलिस परिवार की कही बातों को इतना मान दे रही थी, तो उसने एंबुलेंस के सामने बैठी लड़की की मां की मिन्नतों को नजरअंदाज करते हुए पीड़िता के शव को रात में ही सफदरजंग अस्पताल से बाहर क्यों निकाल लिया? पुलिस ने परिवार को शव का अंतिम संस्कार सुबह करने की इजाजत क्यों नहीं दी?

मैंने ऐम्बुलेंस के सामने लड़की की मां का सिर पीटते हुए, और उसके हाथों एवं शरीर पर ‘हल्दी’ लगाने के लिए शव को अपने घर ले जाने के लिए पुलिस से गुहार लगाने का वीडियो देखा है। यूपी पुलिस जो कह रही है यदि हम उसे मान भी लें, तो क्या दाह संस्कार के वक्त दंगाई गांव में इकट्ठा हो पाते? वह भी रात के अंधेरे में? यह लापरवाही नंबर 4 थी।

यूपी पुलिस के अफसरों के कुछ और तर्क भी हैं। उनका दावा है कि पीड़िता के परिवार और आरोपी के परिवार के बीच पुरानी रंजिश थी। यह घटना उनके पारिवारिक झगड़ों का नतीजा थी। पुलिस का यह भी दावा है कि सभी 4 आरोपियों को तभी गिरफ्तार कर लिया गया था, जब पीड़िता ने उनका नाम बताया था। इन सारी बातों का अब कोई मतलब नहीं है क्योंकि सच्चाई यह है कि 19 साल की एक लड़की को टॉर्चर किया गया, उसका यौन उत्पीड़न हुआ, और 2 हफ्ते तक मौत से जूझने के बाद उसने तड़प-तड़प कर दम तोड़ दिया। यह भी एक तथ्य है कि परिवार के सदस्यों की सहमति के बिना, रात में चुपचाप उसके शव का अंतिम संस्कार कर दिया गया।

मैं एक बार फिर कह रहा हूं कि मुख्यमंत्री योगी आदित्यनाथ ने CBI जांच का आदेश देकर सही काम किया है, और उत्तर प्रदेश पुलिस को अब मामले पर पर्दा डालने की कोशिश बंद करनी चाहिए। राज्य सरकार ने पहले ही 5 पुलिस अफसरों को सस्पेंड कर दिया है, लेकिन हाथरस के डीएम, जिनके आदेश पर पुलिस ने जबरन पीड़िता का अंतिम संस्कार कर दिया, अभी भी अपने पद पर बने हुए हैं। डीएम के खिलाफ कार्रवाई क्यों नहीं की गई? इंडिया टीवी के रिपोर्टर ने हाथरस के इंस्पेक्टर संजीव शर्मा से बात की, जिन्होंने कैमरे पर स्वीकार किया कि दाह संस्कार की रात जो कुछ भी किया गया उसके लिए ‘ऊपर से आदेश’ दिया गया था। यदि आदेशों का पालन करने वालों के खिलाफ कार्रवाई की गई, तो सवाल उठता है कि जिसने ये आदेश दिए, उसके खिलाफ कार्रवाई क्यों नहीं की गई।

एएमयू मेडिकल कॉलेज अस्पताल के ट्रॉमा सेंटर के प्रमुख डॉक्टर अज़ीम मलिक ने कहा है कि घटना के 11 दिन बाद लिए गए सैंपल पर FSL की रिपोर्ट कभी भी यौन उत्पीड़न के बारे में निर्णायक फैसला नहीं दे सकती है। उनके मुताबिक, सरकारी दिशानिर्देशों के अनुसार, इस तरह का मेडिकल टेस्ट घटना के 96 घंटों (4 दिनों) के भीतर किया जाता है ताकि निर्णायक साक्ष्य मिल सकें। यूपी पुलिस का यह दावा कि रेप का कोई सबूत नहीं था, कोई अहमियत नहीं रखता।

कुल मिलाकर स्थानीय पुलिस की ओर से की गई घोर लापरवाही, जिला प्रशासन के अधिकारियों के अहंकार और मनमाने रवैये, पीड़ित परिवार के प्रति संवेदनशीलता की कमी, इन सभी ने मिलकर 19 साल की इस लड़की के जीवन के साथ खिलवाड़ किया। इलाहाबाद हाई कोर्ट की लखनऊ बेंच ने इस मामले का संज्ञान लिया और अपने आदेश में मेरे न्यूज शो ‘आज की बात’ का हवाला दिया, और अब यह मामला सुप्रीम कोर्ट के सामने है।

मुझे पूरा यकीन है कि हाथरस की बेटी को इंसाफ मिलेगा, लेकिन जब तक मामला अदालत में है, तब तक यह हमारे समाज की जिम्मेदारी है कि हम पीड़िता के माता-पिता और उसके परिवार के सदस्यों के साथ सहानुभूति रखें, उन्हें सांत्वना दें और उन्हें अदालत में चुनौतियों का सामना करने की ताकत दें।

The Supreme Court on Tuesday directed the UP government to come up with an affidavit stipulating a witness protection plan for the Hathras victim’s family and other witnesses in the gruesome gangrape-murder case. The state government has been asked to tell whether the family has chosen a lawyer to represent them. The hearing will resume after a week.

Chief Justice of India S A Bobde said: “We want to know if victim’s family has chosen an advocate. We also want suggestion from you (Solicitor General Tushar Mehta) as to the scope of Allahabad High Court proceedings (due on October 12) and how we can make them more relevant. We want it on record that a witness protection plan is already in force.”

The Solicitor General, appearing on behalf of the UP government, wanted that the apex court should monitor the CBI probe into the Hathras incident. “Let us not sensationalize the death of a young girl, and let the investigation be fair and impartial”, Tushar Mehta said.

The Chief Justice of India described the Hathras incident as “horrible and shocking”. The bench consisting of CJI Bobde, Justice A S Bopanna and Justice V Ramasubramanium is hearing the matter. Hours before the apex court began hearing on the PIL, the UP government filed a 16-page affidavit defending its action in carrying out a hurried cremation of the victim in her village.

The state government in its affidavit alleged that some politicians and media personnel allegedly instigated the victim’s family members and there were violent protests because of which the cremation was done at night “in the presence of family members”.

The state government said, “the extraordinary circumstances and sequence of unlawful incidents forced the district administration to take the extraordinary step of cremating the victim at night in presence of the family members, who agreed to avoid further violence.”

The state government alleged in its affidavit that there was “insidious propaganda” by some political parties and section of the media to malign the government, using social media and protests as their tool. It also alleged that there was “a planned attempt to incite communal and caste riots using the Hathras incident, and therefore, it would be appropriate if the Supreme Court supervise the CBI probe in a time-bound manner.” The affidavit said, “monitoring by the Supreme Court will ensure false narratives do not interfere with the course of the probe.”

The state government also pointed out that “the victim did not mention rape in her first statement to the police and that she alleged rape in her second statement after which all the four accused were arrested.”

For the last several days, I have gone through scores of tapes and watched statements of the victim, her parents and police officers about the gang-rape incident and also about the sordid manner in which the body was cremated at night. Several senior UP police officials spoke to me about this incident, and they offered logic to justify the manner in which the Hathras police dealt with the matter.

Let me list their arguments, one by one.

First, the incident took place at around 10.30 am and the parents came with the victim to the police station. A case was registered and the victim was first sent to the district hospital and by 2 pm she was admitted to AMU medical college hospital. On the first day, according to police, the victim did not mention rape in her statement, because of which the doctors did not carry out tests relating to sexual assault.

I have seen the video of the victim lying on the verandah in front of the hospital. The 19-year-old girl was groaning in pain, and two policemen were taking statement from her parents. I also watched another video of the victim lying on a stretcher in the hospital. She was groaning and with much difficulty, she said about “zabardasti” (Hindi colloquial term for rape) done to her by the accused. The victim was saying, “chot isliye lagi, gardan isliye tooti, kyunki maine Sandeep ko apne saath zabardasti nahin karne di” (I suffered injuries, my neck was broken because I was resisting Sandeep from raping me).

My question to UP police officials is: what will a rape victim say, more than this? Is ‘zabardasti’ with a woman not rape? Well, the anti-rape law is clear on this point. It is my firm belief that the Hathras police made the first mistake by not registering a rape case in the beginning. This was Negligence Number One.

The UP police officials said, the victim mentioned rape eight days after the incident, and immediately the police added rape charge to the FIR. The medical test was done eleven days after the incident. Every policeman knows that no conclusive evidence of rape will come if the medical test is done 96 hours after the incident. Whom were the police trying to fool? This was Negligence Number Two. It was because of this that the intent of police came under suspicion.

Point number three. Senior police officials have said that the girl’s mother changed her statement thrice. According to them, she first said, her daughter was strangulated. She then said, a rape was used to strangle her. She again changed her statement and said that a ‘dupatta’ was used to strangulate her. My take on this is: how does it matter how the victim was strangulated? How does it matter whether she was strangled with bare hands, or a rope, or a dupatta? The bitter truth is that the girl lost her life because of spinal injury caused when the accused tried to strangulate her. This was Negligence Number Three.

Fourth point: Why didn’t UP police shift her to Delhi when they found that she was groaning with pain because of spinal injury? Police officials say the girl’s family was initially unwilling to shift her to Delhi for treatment. Even if I assumed that the police is telling the truth, my question is: If the police was so much concerned about respecting the views of the victim’s family, then why did it whisk away the body in the dead of night from Safdarjang Hospital, ignoring desperate pleas of her mother, who sat in front of the ambulance? Why didn’t police agree to allow the family to cremate the body at dawn?

I have seen the video of the girl’s mother banging her head in front of the ambulance and pleading to police to allow her to take the body to her home for putting ‘haldi’ (turmeric) on her hands and body (a ceremonial rite done at the time of funeral). If we believe what the UP police says, would rioters have congregated in the village at the time of cremation? That too, in the dead of night? This was Negligence Number Four.

UP police officials have some more arguments too. They claim that there was personal enmity between the victim’s family and the family of the accused. The incident was a fallout of those family quarrels. Police also claim that all the four accused were arrested, when the victim named them. All these do not make any sense now because the fact remains that a 19-year-old girl was sexually assaulted, tortured, and she died in pain after battling death for two weeks. It is also a fact that her body was cremated in the dead of night, without the consent of the family members.

Let me repeat that Chief Minister Yogi Adityanath has done the right thing in ordering a CBI probe, and the state police must now stop trying to cover up. The state government has already suspended five police officers, but the Hathras DM, on whose orders the police forcibly cremated his body, still remains in his post. Why was no action taken against the DM? India TV reporter spoke to Inspector Sanjeev Sharma of Hathras, who admitted on camera that whatever was done of the night of cremation was because of “orders from above”. If action was taken against those who followed orders, then the question arises: why was no action taken against the person who gave these orders.

The head of the Trauma Centre of AMU Medical College Hospital Dr Azeem Malik has said that an FSL report on sample taken eleven days after the incident can never give a conclusive finding about sexual assault. According to him, as per government guidelines, such a medical test is done within 96 hours (four days) of the incident in order to get a conclusive evidence. The claim of the UP police that there was no evidence of rape, does not hold water

To sum up: Gross negligence on part of local police, arrogance and abrasiveness of district administration officials, lack of sensitivity towards the victim’s family, all combined together played havoc with the life of a 19-year-old teenager. The Lucknow bench of Allahabad High Court took suo motu cognizance of the matter and referred to my news show ‘Aaj Ki Baat’ in its order, and now the matter is before the Supreme Court.

I have full confidence that the daughter of Hathras will get justice, but till the time the courts give her justice, it is the responsibility of our society to empathize with the victim’s parents and family members, offer them solace and give them strength to face the challenge in law courts.

यूपी सरकार ने शनिवार सुबह हाथरस की बेटी के गांव के अंदर मीडियाकर्मियों के प्रवेश पर लगे प्रतिबंध को हटा दिया। यहां के एसडीएम प्रेम प्रकाश मीणा ने कहा कि गांव में धारा 144 लागू है जिसे देखते हुए पांच से ज्यादा मीडियाकर्मियों को एक जगह जमा होने की इजाजत नहीं दी जाएगी। उन्होंने कहा कि कानून और व्यवस्था को देखते हुए राजनीतिक दलों और अन्य सामाजिक संगठन के लोगों के प्रवेश पर प्रतिबंध जारी रहेगा। गैंगरेप की शिकार बेटी के जबरन दाह संस्कार के बाद उसके गांव में मीडिया के दाखिल होने पर पिछले दो दिनों से प्रतिबंध लगा हुआ था।

इससे पहले यूपी सरकार ने शुक्रवार को हाथरस के एसपी विक्रांत वीर, सीओ राम शबद, एसएचओ दिनेश कुमार वर्मा, सब-इंस्पेक्टर जगवीर सिंह और हेड मोहरिर्र (क्लर्क) महेश पाल को सस्पेंड कर दिया। शामली के एसपी विनीत जायसवाल को हाथरस का नया एसपी नियुक्त किया गया है।

वहीं मुख्यमंत्री योगी आदित्यनाथ ने एक ट्वीट में हत्यारों के खिलाफ कड़ी कार्रवाई करने का वादा किया है। योगी ने लिखा है, “उत्तर प्रदेश में माताओं-बहनों के सम्मान-स्वाभिमान को क्षति पहुंचाने का विचार मात्र रखने वालों का समूल नाश सुनिश्चित है। इन्हें ऐसा दंड मिलेगा, जो भविष्य में उदाहरण प्रस्तुत करेगा। आपकी सरकार प्रत्येक माता-बहन की सुरक्षा व विकास हेतु संकल्पबद्ध है। यह हमारा संकल्प है, वचन है। “

मुझे विश्वास है योगी जी अपना वचन जरूर पूरा करेंगे। वे अपराधियों के खिलाफ कड़ी कार्रवाई करेंगे। लेकिन सबसे जरुरी है हाथरस की बेटी के परिवार को विश्वास दिलाना..उन्हें यकीन दिलाना कि उसके साथ अन्याय नहीं होगा। उनके परिवार को इस बात का यकीन दिलाना कि बेटी के हत्यारों को जल्दी सजा मिलेगी। ये भी जरूरी है विश्वास पैदा करने के लिए कि इस बेटी के परिवार पर लगा पहरा हटाया जाए। उन्हें मीडिया के सामने अपनी बात कहने का मौका दिया जाए। और जब तक ये विश्वास पैदा नहीं होगा, तब तक नाराजगी बनी रहेगी।

मैं आपको ये भी बता दूं कि हाईकोर्ट ने जब इस मामले का संज्ञान लिया तो साफ-साफ लफ्जों में कहा कि अगर सरकार ने इस मामले की ठीक से जांच नहीं की तो फिर हाईकोर्ट इस पूरे मामले की जांच एक स्वतंत्र एजेंसी को दे सकता है और जरूरत पड़ी तो अदालत पूरी जांच की निगरानी भी करेगी।

जब मैंने हाईकोर्ट के लखनऊ बेंच के आदेश को पढ़ा तो जज साहेबान के प्रति इज्जत और बढ़ गई, न्यायपालिका के प्रति सम्मान और गहरा हो गया। इस आदेश को पढ़ने के बाद आपको भी लगेगा कि हमारे जज (न्यायाधीश) सिर्फ सरकारी जवाबों और कागजों के आधार पर फैसले नहीं करते। उनकी नजर समाज में हो रही हर घटना पर होती है। उसके सब पक्षों को वो देखते हैं और सुनते हैं और ये जरूरी नहीं कि वे न्याय तभी देते हैं जब फरियादी अदालत की चौखट पर आए। जज साहेबान उन लोगों को भी न्याय देने की कोशिश करते हैं जो अदालत तक नहीं पहुंच सकते और इस केस में तो इलाहाबाद हाईकोर्ट के जजेज ने उस बेटी को न्याय देने की पहल खुद की है जो अब इस दुनिया में ही नहीं है। जो अपना दर्द और अपने साथ हुई नाइंसाफी को बयां नहीं कर सकती। अदालत के आदेश को पढ़कर ऐसा लगा कि जजेज ने पूरी डिटेल देखी, उसके बारे में खुद तहकीकात की और फिर किसी जनहित याचिका का इंतजार नहीं किया।

इलाहाबाद हाईकोर्ट के जज जस्टिस रंजन रॉय और जस्टिस जसप्रीत सिंह ने 11 पेज के अपने आदेश में लिखा है कि इंडिया टीवी पर ‘आज की बात’ में हाथरस में मंगलवार रात के घटनाक्रम को विस्तार से दिखाया गया। उन वीडियोज को दिखाया गया जिसमें आरोप लगाया गया है कि पुलिस ने जबदरस्ती पीड़ित लड़की के शव को देर रात बिना परिवार की मर्जी के जला दिया। हाईकोर्ट ने अपने आदेश में मेरा जिक्र किया और लिखा है कि रजत शर्मा के प्रोग्राम में वो सारे वीडियो दिखाए गए जिसमें ऐसा लग रहा था कि पुलिस ने परिवारवालों को अंतिम संस्कार में शामिल नहीं होने दिया। धार्मिक रीति-रिवाजों का पालन किए बगैर अपनी मर्जी से शवदाह कर दिया। इसके बाद कोर्ट ने कहा कि स्टेट अथॉरिटीज पर जिस तरह के आरोप लगे हैं उससे ये मामला ना सिर्फ पीड़ित लड़की बल्कि उसके परिवारवालों के भी मानवाधिकारों का उल्लंघन है। कोर्ट ने कहा की पीड़ित लड़की दरिंदगी का शिकार हुई लेकिन उसकी मौत के बाद जो कुछ हुआ..जैसे आरोप लगे हैं, अगर उनमें सच्चाई है तो फिर ये परिवारवालों के जख्मों पर नमक छिड़कने जैसा है।

हाईकोर्ट ने कहा कि पीड़ित लड़की की मौत के बाद उसके शव का पूरे सम्मान के साथ अन्तिम संस्कार किया जाना चाहिए था। वह लड़की सम्मानपूर्वक अंत्येष्टि की हकदार थी लेकिन रिपोर्ट कहती है कि उसे ये हक नहीं मिला। कोर्ट ने कहा कि जो दिखाया गया उसके मुताबिक पीड़िता के शव को उसके गांव ले जाया गया। लेकिन हैरानी की बात ये है कि शव को परिवार को नहीं सौंपा गया और उसकी सम्मानपूर्वक अंत्येष्टि भी नहीं की गई। कोर्ट ने कहा हमें पता चला कि बेटी के शव को माता-पिता और भाई-बहन को नहीं सौंपा गया बल्कि दूसरे लोगों के जरिए उसका अंतिम संस्कार करवा दिया गया। और तो और अंतिम संस्कार देर रात 2 बजे से 2.30 बजे के बीच हुआ जबकि पीड़ित परिवार का कहना था कि उनके रिवाजों के मुताबिक सूर्यास्त के बाद शवों को नहीं जलाया जाता।

अपने आदेश में जज साहिबान ने लिखा, ‘आज की बात’ में दिखाया गया कि किस तरह परिवार बार-बार शव लेने की गुहार लगाता रहा। परिवार कहता रहा कि धार्मिक परंपरा के मुताबिक सूर्यास्त के बाद अंत्येष्टी नहीं की जाती लेकिन जिला प्रशासन ने परिवार की परंपरा का ध्यान ना रखते हुए बेटी का अंतिम संस्कार करवा दिया। कोर्ट ने रिपोर्ट्स का हवाला देकर कहा कि बेटी का शव अभी गांव भी नहीं पहुंचा था कि उसी दौरान जिला प्रशासन की तरफ से लकड़ियों का इंतजाम किया गया। चिता को तैयार कर दिया गया और जिस वक्त एंबुलेंस गांव में दाखिल हुई, उस समय मेन रोड और पीड़िता के परिवार के बीच थ्री लेयर का बैरिकेड लगा दिया गया। पीड़ित लड़की के भाई ने कहा था कि जैसे ही एंबुलेंस सीधा श्मशान घाट की तरफ गई, उसी वक्त मेरी मां पुलिसवालों के पैरों में गिर पड़ी। एक और महिला एंबुलेंस के बोनट के सामने आ गई। उसने हाथ जोड़ लिये और वो कहने लगी कि कम से कम बेटी की मिट्टी पर हल्दी तो लगाने दीजिए। एक बार घर के अंदर बेटी के शव को ले जाने दीजिए, लेकिन किसी ने उनकी बात नहीं सुनी। एक बार तो पुलिसवाले ये सब देखकर गुस्से में आ गए और पीड़ित परिवार के रिश्तेदारों को लात मारी और धक्का दिया जो कि बीच-बचाव करने पहुंचे थे। इसी के बाद पूरे परिवार ने खुद को घर के अंदर बंद कर लिया और दो घंटे तक उन्हें ये ही पता नहीं चला कि बेटी का अंतिम संस्कार हुआ या नहीं। अदालत ने अपने आदेश में ये भी कहा है कि राज्य सरकार इस बात को सुनिश्चित करे कि हाथरस का प्रशासन या फिर पुलिस के अफसर या फिर यूपी सरकार के अधिकारियों की ओर से हाथरस की बेटी के परिवार वालों पर किसी तरह का कोई दबाब ना डाला जाए, उन्हें डराया ना जाए।

बड़ी बात ये है कि हाईकोर्ट ने अपने आदेश में ये भी कहा है कि इस केस की सुनवाई 12 अक्टूबर को होगी और उस दिन हाथरस की बेटी के माता-पिता, उसके भाई-बहन को भी अदालत में पेश किया जाए। अदालत ने इन सभी लोगों को अच्छे तरीके से हाथरस से लखनऊ लाने, लखनऊ में उनके ठहरने और खाने-पीने का इंतजाम भी सरकार से करने को कहा है। हाईकोर्ट ने अपने आदेश में यूपी के एडिशनल चीफ सेक्रेटरी या प्रधान सचिव (गृह), डीजीपी, एडीजीपी, हाथरस के डीएम और एसपी को भी समन किया है और पूरे मामले की जांच को लेकर जवाब मांगा है।

मैं आपको इलाहाबाद हाईकोर्ट के आदेश को इतने विस्तार से इसलिए बता रहा हूं क्योंकि सारे तथ्य और पूरे आदेश को जानने के बाद आपको लगेगा कि हमारे जज कितने सजग और संवेदनशील हैं और उनकी नजर कितनी पैनी है। कितनी संवेदनशीलता के साथ और कितनी गहराई के साथ हाथरस की बेटी के केस को देखा और जब कोई अदालत की चौखट पर नहीं पहुंचा तो जज साहेबान ने मामले का स्वत: संज्ञान लेकर आदेश जारी कर दिया। हाईकोर्ट ने एक्शन तब लिया जब वहां कोई इंसाफ मांगने नहीं गया था। हाईकोर्ट ने सिर्फ हाथरस की तस्वीरों को देखा, रिपोर्ट्स को देखा। ‘आज की बात’ में दिखाए गए वीडियो को देखा, डीएम की बातों को सुना और इसके बाद हाईकोर्ट के जज साहिबान खुद को रोक नहीं पाए। उन्हें लगा कि सच सामने आना जरूरी है। न्याय सिर्फ होना नहीं चाहिए, न्याय होते हुए दिखाई देना चाहिए। इसीलिए हाईकोर्ट के जजेज ने रात में ही बिना किसी याचिका के, बिना किसी फरियाद के, बिना किसी याचिका के मामले का स्वत: संज्ञान लिया और इतने विस्तार से आदेश पास किया। ये बहुत बड़ी बात है, कोई छोटी बात नहीं। ये न्यायपालिका और जजेज के प्रति देश के लोगों के दिलों में विश्वास बढ़ाने वाली बात है।

शुरुआत में मेरी कोशिश सिर्फ इतनी थी कि हाथरस की एक बेटी की मौत हो गई है और उसकी मौत के गुनहगारों को सजा मिलनी चाहिए। बेटी की मौत कैसे हुई, क्या उसके इलाज में देरी हुई, क्या पुलिस ने लापरवाही बरती…क्या अफसरों ने मामले को दबाने की कोशिश की? अगर ऐसा हुआ तो जिम्मेदार अफसरों पर भी एक्शन होना चाहिए, इतनी कोशिश थी। लेकिन जब सफदरजंग हॉस्पिटल में हाथरस की इस बेटी के मौत के बाद जिस तरह से पुलिस परिवार को बिना बताए लाश को ले गई फिर रात के अंधेरे में जिस तरह से लड़की की लाश को जलाया गया और जिस तरह से परिवार वालों को धमकाया गया…उससे शक पैदा हुआ। इसके बाद डीएम, एसपी, एडीएम और फिर एडीजी ने जिस तरह के बयान दिए उससे सवाल पैदा हुए..आशंका हुई। जिले के अधिकारी लगातार झूठ पर झूठ बोले जा रहे थे। इसी झूठ की वजह से मुख्यमंत्री ने एसआईटी का गठन किया और एसपी समेत अन्य पुलिसकर्मियों को सस्पेंड करने का कदम उठाया। एसआईटी ने पुलिस अधिकारियों को सस्पेंड करने की सिफारिश के अलावा, थाने के सभी पुलिस वालों का पॉलीग्राफ टेस्ट कराने की सिफारिश की है। पुलिस वालों के साथ-साथ लड़की के परिवारवालों का और हत्या के जो आरोपी हैं, उन सबका पॉलीग्राफ टेस्ट होगा।

पहले ही पुलिस की तरफ से गढ़े गए अधिकांश झूठ का पर्दाफाश हो चुका है और पुलिस झूठ भी ऐसा बोलती है कि तुरंत पकड़ा जाता है। कुछ दिनों में हाथरस की बेटी के साथ गैंगरेप और हत्या के आरोपियों को बचाने वालों का चेहरा भी सामने आ जाएगा। लेकिन यह स्पष्ट है कि हाईकोर्ट के आदेश के बावजूद हाथरस की बेटी के परिजनों पर दबाव साफ तौर पर देखा जा रहा है।

अच्छी बात ये है कि सीएम योगी आदित्यनाथ इस बात को समझ गए हैं और उन्हें इस बात का अंदाजा हो गया है कि पुलिस का रोल भी सिस्टम की छवि को खराब करने वाला है।इसीलिए उन्होंने हाथरस के एसपी समेत कई पुलिसकर्मियों को शुक्रवार रात सस्पेंड कर दिया। ये बड़ा और सख्त फैसला है। योगी आदित्यनाथ के इस कदम से सिस्टम, सरकार और प्रशासन में लोगों का भरोसा बढ़ेगा। पुलिस की छवि को जो धक्का लगा है, उसे कुछ हद तक सही किया जा सकेगा।

The UP government on Saturday morning lifted the ban on entry of media personnel inside the gang-rape victim’s village near Hathras. In view of Section 144 prohibitory orders in the village, not more than five mediapersons will be allowed to gather at a single place, the local SDM Prem Prakash Meena said. Entry of delegations of political parties and other social organisations will remain banned in view of the law and order situation, he added.

With this, the two-day-long ban on media entry imposed after the forced cremation of the gangrape victim has come to an end. On Friday, the UP government had suspended the Hathras Superintendent of Police Vikrant Veer, Circle Officer Ram Shabd, SHO Dinesh Kumar Verma, sub-inspector Jagveer Singh and head moharrir (clerk) Mahesh Pal in connection with the gruesome rape and murder of a 19-year-old woman in Chandpa area. Shamli SP Vineet Jaiswal has taken over as Hathras SP.

Chief Minister Yogi Adityanath in a tweet promised to take stringent action against the perpetrators. Yogi said, “those who even dare to think about harming the self-respect of our mothers and sisters will be exterminated. They will face punishment that shall be an example for the future. This is my vow, my promise.”

I have full confidence in Yogi’s resolve to take stringent action against the perpetrators. But the need of the hour is to win the trust of the victim’s parents and family members. Yogi must assure the family that they will not be deprived of justice. In order to do this, he must allow the victim’s family members and relatives to speak freely and openly to the media. This will help in unravelling the truth about the chain of incidents that took place since the day of gangrape and torture till the day of forced cremation. This is the only sure way to win the trust of the victim’s family.

I want to point out here that the Lucknow bench of Allahabad High Court in its order has clearly indicated that if the probe is not done fairly, it may ask an independent agency to investigate, and if required, it will monitor the probe.

My respect for the Lucknow bench judges has gone up several notches after reading their order in full. After reading the order, one can easily visualize that our judges do not only go by what the executive says, but they keep their eyes and ears open to all other sources of information. They keep a watchful eye on happenings that take place in our society and do not wait for the criminals to be brought to the doorstep of the court. The court did not wait for any PIL to be filed, but took suo motu cognizance of the manner in which the state authorities violated the basic principles of human dignity and values by carrying out a forced cremation of the victim.

In their 11-page order, Justice Rajan Roy and Justice Jaspreet Singh mentioned the videos shown in my show ‘Aaj Ki Baat’ on India TV and pulled up the state authorities for carrying out the forced cremation. The judges wrote: “As it is, the deceased victim was treated with extreme brutality by the perpetrators of the crime and what is alleged to have happened thereafter, if true, amounts to perpetuating the misery of the family and rubbing salt in their wounds.”

The judges, in their order, said: “In this very context, we may also refer to an electronic media program shown on India TV channel by the name “Aaj Ki Baat” where the anchor Shri Rajat Sharma dwelled on the issue of alleged forcible cremation of the deceased victim at length and in the said program, videos which were recorded on the spot at the time the deceased victim’s body arrived in the village and her cremation indicating the forcible cremation without the family members being allowed to participate, that too, in the midst of night contrary to the religious practices followed by the family, have been shown. The family members were shown as stating that cremation is not carried out after sunset and before daybreak and that the body of the deceased should be taken to their home, but this was not done……The state authorities are directed that no coercion, influence or pressure is exerted on the family members of the deceased in any manner, by anyone.”

The family members of the deceased have been directed to be present before the court (on October 12) “so that the court can further ascertain the facts.” The court has directed the state government to bring the victim’s parents and her close family members from Hathras to Lucknow, make arrangements for their stay and food, and present them before the court.

The court has also summoned the Additional Chief Secretary or Principal Secretary (Home), DGP, Additional DGP, Hathras District Magistrate and Hathras SP to put forth their version of the case with supporting material and to apprise the court of the status of the investigation.”

The high court order clearly indicates that the learned judges did not wait for any PIL or government’s response, but on seeing visuals of the family members begging before officials, and listening to the DM speaking to the family, made up their mind to take suo motu cognizance and issued the order. This is a humane act on part of the judiciary and it rekindles the sense of respect towards judges in the minds of common people.

Initially, my efforts since the time when news broke about the death of the Hathras girl have been to point out how she was tortured, how she suffered for two weeks due to the negligence of the administration and how she breathed her last in Delhi’s Safdarjang hospital. But after seeing the manner in which police ignored the pleas of family members, whisked away her body from hospital in the dead of night, took it to her village, and then carried out a hurried cremation disregarding pleas of the victim’s parents, I knew that the district administration was lying through its teeth. The district officials were spinning out lies after lies. It was because of these lies that the SIT formed by the Chief Minister took the first step in getting the SP and other cops suspended.

The SIT, apart from recommending suspension of the police officers, has recommended polygraph and narco tests on policemen, all the accused and family members of the victim.

Already, most of the lies dished out by the police have been exposed. It is a matter of time before the truth behind the grotesque gangrape and murder of the girl will tumble out and those shielding the perpetrators will be unmasked. Despite the clear order of the High Court, the pressure on the girl’s family is evident for all to see.

The only silver lining in the cloud is that Yogi Adityanath has realized how the arrogant and abrasive attitude of some police officers has brought a bad name to the state government. It was because of this that the Hathras SP and other policemen were suspended on Friday night. Let us hope that Yogi will ultimately win back the trust of the girl’s family members and relatives and his government will nail the perpetrators.

यह लोकतंत्र के नाम पर एक भद्दा मजाक है कि हाथरस प्रशासन ने पूरे जिले को सील कर दिया है और 4 युवकों द्वारा 19 वर्षीय दलित लड़की के टॉर्चर और जघन्य गैंगरेप के बाद हुए उसके जबरन अंतिम संस्कार के मद्देनजर बाहरी लोगों के गांव में घुसने और लोगों के जमावड़े पर रोक लगा दी है। हाथरस में मीडिया पर बैन लगा दिया है, और जिले की सीमाओं को सील कर दिया गया है। पुलिस ने पीड़िता के गांव को एक किले में तब्दील कर दिया है। इस बारे में पुलिस महानिरीक्षक पीयूष मोरड़िया ने कहा, ‘कानून और व्यवस्था बनाए रखने के लिए यह फैसला लिया गया है।’

इलाहाबाद हाई कोर्ट की लखनऊ बेंच ने गुरुवार को सम्मन जारी कर राज्य सरकार के शीर्ष अधिकारियों को अदालत में उपस्थित होने को कहा है। जस्टिस राजन रॉय और जस्टिस जसप्रीत सिंह की बेंच ने उत्तर प्रदेश के अपर मुख्य सचिव, पुलिस महानिदेश, अपर पुलिस महानिदेशक और हाथरस जिले के डीएम एवं एसपी को सम्मन जारी कर सभी से 12 अक्टूबर को अदालत में पेश होने और मामले में स्पष्टीकरण देने को कहा है। इसके साथ ही पीड़िता के परिवार के सदस्यों को भी अदालत में पेश होने का निर्देश दिया गया है।

हाई कोर्ट ने कहा कि इन घटनाओं ने ‘हमारी अंतरात्मा को झकझोर दिया है। हम यह जानना चाहते हैं कि क्या पीड़िता और उसके परिवार के सदस्यों के मौलिक अधिकारों का घोर उल्लंघन हुआ था? क्या राज्य प्रशासन ने दमनकारी, मनमाने और गैकरकानूनी तरीके से उनके अधिकारों का उल्लंघन किया, और यदि ऐसा है, तो यह एक ऐसा मामला होगा जिसमें न केवल जवाबदेही तय की जाएगी, बल्कि भविष्य में मार्गदर्शन के लिए कड़ी कार्रवाई की जररूत होगी।’ हाई कोर्ट ने अपने आदेश में मेरे न्यूज शो ‘आज की बात’ का हवाला दिया, जिसमें मैंने वीडियो और ऑडियो के जरिए दिखाया था कि कैसे पुलिस और जिला प्रशासन ने परिवार के सदस्यों के साथ दुर्व्यवहार किया और पीड़िता का दाह संस्कार किया।

हाई कोर्ट ने कहा, ‘इस संदर्भ में हम इलेक्ट्रॉनिक मीडिया के एक प्रोग्राम का भी जिक्र कर सकते हैं, जो ‘आज की बात’ नाम के कार्यक्रम में इंडिया टीवी पर दिखाई गई है। इस प्रोग्राम में एंकर रजत शर्मा ने मृतक पीड़िता के जबरन अंतिम संस्कार के मुद्दे की तरफ ध्यान दिलाया है। इस प्रोग्राम में जो वीडियो पीड़िता का शव गांव में आने और उसके दाह संस्कार के समय रिकॉर्ड किए गए हैं वे इस बात की तरफ इशारा करते हैं कि पीड़िता के परिजनों के शामिल हुए बिना ही जबरन उसका दाह संस्कार किया गया, और वह भी आधी रात के वक्त, परिवार द्वारा पालन की जाने वाली धार्मिक मान्यताओं के विपरीत। परिवार के सदस्यों को यह कहते हुए भी दिखाया गया है कि सूर्यास्त के बाद और सूर्योदय के पहले दाह संस्कार नहीं किया जाता है और पीड़िता के शव को उनके घर ले जाया जाए, लेकिन ऐसा नहीं किया गया।’

हाई कोर्ट ने कहा, ‘हमारे सामने जो मामला है, जिसके बारे में हमने संज्ञान लिया है, वह सार्वजनिक महत्व और सार्वजनिक हित का है क्योंकि इसमें राज्य के अधिकारियों द्वारा मनमानी का आरोप शामिल है, जिसके चलते न सिर्फ पीड़िता बल्कि उसके परिजनों के भी आधारभूत मानवीय और मौलिक अधिकारों का उल्लंघन होता है।’ अदालत ने आगे कहा, ‘जैसा कि सामने है, इस अपराध को अंजाम देने वाले अपराधियों ने मृत पीड़िता के बेहद क्रूरता का व्यवहार किया था और उसके बाद क्या जो होने का आरोप लगा है, यदि वह सच है, तो यह परिवार की तकलीफों को बढ़ाने और उसके घावों पर नमक रगड़ने जैसा है। हम यह जानना चाहते हैं कि क्या राज्य प्रशासन ने मृतक के परिवार के उत्पीड़न और उन्हें उनके संवैधानिक अधिकारों से वंचित करने के लिए उनकी आर्थिक और सामाजिक स्थिति का फायदा उठाया।’

गुरुवार की रात ‘आज की बात’ में मैंने एक वीडियो दिखाया था जिसमें हाथरस के डीएम प्रवीन कुमार लक्षकार ने परिवार को यह कहते हुए अप्रत्यक्ष रूप से धमकाया था, ‘आप अपनी विश्वसनीयता खत्म मत कीजिए। मीडिया वाले आधे चले गए हैं, कल सुबह आधे निकल जाएंगे। हम आपके साथ खड़े हैं, अब आपकी इच्छा है कि आपको बयान बदलना है या नहीं। हम भी बदल सकते हैं।’ सेलफोन पर लिया गया यह वीडियो तुरंत वायरल हो गया। एक अन्य वीडियो में पीड़िता की भाभी घूंघट के अंदर से कहती सुनी गईं, ‘वे हम पर दबाव डाल रहे हैं। वे कह रहे हैं कि अगर हमारी लड़की कोरोना वायरस से मर गई होती तो क्या उसे मुआवजा मिल पाता? वे कह रहे हैं कि मामला रफ़ा-दफ़ा होगा। हमें धमकियां मिल रही हैं, हमारे पापा को भी धमकाया जा रहा है।’

यह साफ है कि हाथरस के डीएम और एसपी की दिलचस्पी परिवार को न्याय दिलाने की बजाय मामले को दबाने में ज्यादा है। डीएम को परोक्ष धमकी देते हुए देखने के बाद क्या कोई गरीब परिवार ऐसे अधिकारियों से सत्य, न्याय और निष्पक्षता की उम्मीद कर सकता है? सिर्फ इतना ही नहीं, डीएम ने जिले में मीडिया की एंट्री पर बैन लगाने के आदेश जारी किए हैं। साफ है कि यूपी पुलिस मीडिया को धमकाकर सच्चाई को दबाने की कोशिश कर रही है।

एडीजी (लॉ एंड ऑर्डर) प्रशांत कुमार ने गुरुवार को कहा, ‘फॉरेंसिक साइंस लैब की रिपोर्ट के मुताबिक, पीड़िता के विसरा सैंपल में स्पर्म नहीं मिला। इस रिपोर्ट के मुताबिक, बलात्कार का कोई सबूत नहीं है। अधिकारियों द्वारा बयान दिए जाने के बावजूत मीडिया में कुछ गलत जानकारियां प्रसारित की गईं। सामाजिक सौहार्द को बिगाड़ने और जातीय हिंसा भड़काने के लिए कुछ लोग तथ्यों को गलत तरीके से पेश कर रहे हैं। (पुलिस) विभाग को बदनाम करने की भी कोशिश की जा रही है और हम ऐसा करने वाले लोगों के खिलाफ कार्रवाई शुरू करेंगे।’

एक्सपर्ट्स के मुताबिक, कथित बलात्कार के 8 दिन बाद हुए मेडिकल एग्जामिनेशन की प्रक्रिया में खामियां थीं। यह स्पष्ट रूप से राष्ट्रीय और अंतर्राष्ट्रीय दिशानिर्देशों का उल्लंघन करता है जिनके मुताबिक बलात्कार के मामलों में पीड़िता के प्राइवेट पार्ट्स की जांच जल्द से जल्द की जानी चाहिए।

मीडिया के खिलाफ कार्रवाई करने की धमकी के बारे में मैं कहना चाहता हूं कि डंके की चोट पर सच बोलने से न हम कभी डरे हैं, और न डरेंगे। जब बात बेटियों को न्याय दिलाने की हो, अन्याय के खिलाफ आवाज उठाने की हो, तो सबसे पहली आवाज मेरी होगी। पिछले तीन दिन से बार-बार उस बेटी की आवाज कान में गूंजती है कि खेत में काम कर रही थी, संदीप ने गला दबा दिया, मेरे साथ जबरदस्ती करने की कोशिश की।

उस लड़की के पिता की बात लगातार कान में गूंजती है जो DM के सामने हाथ जोड़कर कह रहे हैं, ‘साहब, सुबह तक रुक जाइए। बेटी की लाश को घर की चौखट तक ले चलिए। रात में अन्तिम संस्कार नहीं किया जाता। सुबह कर देंगे।’ उस मां की आवाज कान में गूंजती है जो कह रही है, ‘आखिरी बार विदा करने से पहले लड़की के हाथ में हल्दी लगानी है।’ लेकिन डीएम कहता है कि अब और इंतजार नहीं होगा, अन्तिम संस्कार तो अभी होगा, रात में ही होगा।

सोचिए, बेटी की लाश सामने पड़ी हो, मां-बाप, भाई-बहन उसका चेहरा न देख पाएं। वे घर में कैद हों और बेटी की लाश को जला दिया जाए तो उन पर क्या बीती होगी। और जब वे अपना दर्द मीडिया से शेयर करते हैं, पुलिस के दावों की हकीकत बताते हैं, तो DM फिर गांव में पहुंचता है और परिवार वालों से कहता है कि ‘मीडिया के चक्कर में मत पड़ो, ये आज हैं, कल जाएंगे, हम यही रहेंगे आपके साथ।’ DM की बात सिर्फ 13-14 सेकेन्ड की है, लेकिन प्रशासन की मंशा का सबूत है। हाथरस की बेटी के परिवार के पिछले 17 दिन कैसे गुजरें होंगे, प्रशासन का रवैया कैसा रहा होगा, परिवार ने बेटी की मौत के गम के साथ और कैसी-कैसी तकलीफ झेली होगी, इसका अंदाजा DM की 14 सेकेन्ड की बात से हो जाता है।

एडीजी साहब की बातें सुनकर मुझे ऐसा लगा जैसे इन अफसरों को जनता की सेवा करने की नहीं, जनता को सताने की ट्रेनिंग दी गई है। इन अफसरों के बयान देखकर लगा जैसे इनका सच से कोई वास्ता नहीं हैं, इन्हें झूठ बोलने में महारात हासिल है। और जब झूठ से बात नहीं बनती तो ये कुर्सी का रौब दिखाते हैं वर्दी की धौंस दिखाते हैं, आम लोगों को डंडे की ताकत दिखाकर डराते हैं। और जो इनकी बात जनता तक पहुंचाता है, जो इनकी असलियत उजागर करता है, उन्हें ये लोग कानून का डर दिखाने की कोशिश करते हैं, अदालती कार्रवाई में घसीटने की धमकी देते हैं।

मैं तो कहूंगा कि पुलिस को अपनी ताकत इस केस को दबाने में नहीं, मीडिया को डराने में नहीं, हाथरस की बेटी को इंसाफ दिलाने में लगानी चाहिए। आज इस देश की हर बेटी पूछ रही है कि उसे कब तक डर कर जीना होगा। पुलिस को सच छिपाने की बजाए आगे आकर हमारी बेटियों को हिम्मत दिलाने की कोशिश करनी चाहिए। सच सामने लाने की कोशिश करनी चाहिए। अगर पुलिस का यही रवैया रहा, अगर पुलिस इसी तरह से झूठ बोलती रही, मामले को रफा-दफा करने में लगी रही तो किस लड़की की हिम्मत होगी कि पुलिस के सामने अपनी शिकायत दर्ज कराए? कौन से मां-बाप में हिम्मत होगी कि वे पुलिस से मदद मांगें? सबको लगेगा कि कुछ ना कहना बेहतर है।

जब निर्भया का केस हुआ था तब देश भर से आवाज आई थी। कानून बदला था तो लगा था कि अब देश की किसी बहन-बेटी के साथ जुल्म नहीं होगा। अपराध होगा तो जल्दी सजा मिलेगी, सख्त सजा मिलेगी। लेकिन निर्भया के केस में भी दरिंदों को फांसी के तख्ते तक पहुंचाने में 7 साल लग गए। योगी आदित्यनाथ ने वादा किया कि हाथरस केस में SIT 7 दिन में रिपोर्ट देगी लेकिन मैं उनसे कहना चाहता हूं कि बात तो तब बनेगी जब बलात्कार करने वालों को, हत्या करने वालों को फास्ट ट्रैक कोर्ट से जल्दी सजा मिलेगी, सख्त सजा मिलेगी। अगर यूपी की सरकार ये कर पाई तो अपराधियों के मन में खौफ पैदा होगा, और ये खौफ बहुत जरूरी है। जब तक अपराध करने वालों के दिलोदिमाग में डर नहीं होगा, सजा का खौफ नहीं होगा, अदालत का डर नहीं होगा, तब तक इस पर काबू पाना मुश्किल है।

अंत में मैं हाथरस मामले में तुरंत स्वत: संज्ञान लेने और यूपी के वरिष्ठ अधिकारियों को तथ्यों के साथ अदालत में तलब करने के लिए अपनी न्यायपालिका को सल्यूट करना चाहता हूं। आम आदमी न्यापालिका और हमारे जजों की इज्जत करता है। पूरी दुनिया में हमारी न्यायपालिका की धाक है। जिस मामले को पूरा प्रशासन, पुलिस दबाने में लगी है, उसे हाईकोर्ट के जजों ने सुन लिया। हाई कोर्ट की लखनऊ बेंच के आदेश के देखते हुए, जिसका जिक्र मैंने शुरुआत में किया था, ऐसा लग रहा है जैसे जजेज ने लड़की के दर्द को, उसके परिवार की पीड़ा को महसूस किया है, और पुलिस के रवैए को समझ लिया है।

अब मुझे पूरा यकीन हो गया है कि हाथरस की इस बेटी को न्याय मिलेगा, इंसाफ होगा और जल्दी होगा। अब पुलिस गरीबों की आवाज दबा नहीं पाएगी। दुख की बात ये है कि पुलिस ने अपनी नाकामी, अपनी लापरवाही को छिपाने के लिए लड़की की लाश को रात के अंधेरे में जबरदस्ती जला दिया। अब कोई सबूत नहीं है, अब सिर्फ चिता की राख बची है और नेता अब इस लड़की की चिता की राख पर सियासत कर रहे हैं।

It is a travesty of democracy that the Hathras administration has sealed the entire district and has clamped prohibitory orders to prevent entry of outsiders and gatherings of people in the wake of the forced cremation of the 19-year-old Dalit teenager after the heinous gangrape and torture by four youths. Entry of mediapersons into the district has been banned, the borders of the district have been sealed. The girl’s village has been turned into a fortress by the police. “The decision was taken to maintain law and order”, said the Inspector General of Police Piyush Mordia.

The Lucknow bench of Allahabad High Court consisting of Justice Rajan Roy and Justice Jaspreet Singh on Thursday took suo motu cognizance of the matter and summoned the Principal Secretary(Home), Director General of Police, Additional DGP and the DM and SP of Hathras district to be present in court on October 12. The family members of the victim have also been directed to present in court.

The High Court observed that the incidents “have shocked our conscience… we are inclined to examine whether there was gross violation of fundamental rights of the victim and her family members, whether the state authorities acted oppressively, highhandedly and illegally to violate such rights, and if it is found to be so, then this would be a case where accountability will not only be fixed, but for future guidance, stern action will be required.”

The High Court, in its order, referred to my news show ‘Aaj Ki Baat’, in which I had shown video and audio relating to how police and district administration misbehaved with the family members and carried out forced cremation of the victim.

“The matter before us, of which we have taken suo motu cognizance is of immense public importance and public interest as it involves allegation of high handedness by the State Authorities resulting in violation of the basic human and fundamental rights not only of the deceased victim but also of her family members.”

The High Court further said, “As it is, the deceased victim was treated with extreme brutality by the perpetrators of the crime and what is alleged to have happened thereafter, if true, amounts to perpetuating the misery of the family and rubbing salt in their wounds….We would like to examine whether the economic and social status of the deceased’s family has been taken advantage of by the state authorities to oppress and deprive them of their Constitutional rights.”

On Thursday night, I showed in “Aaj Ki Baat” a video in which the Hathras DM Praveen Kumar Laxkar was indirectly threatening the family by saying: “Do not finish your credibility .. these media people, some left today and tomorrow more will leave. Only we will be here with you, OK? It is up to you whether you want to change your statement or not. We can also change.” This video, taken on a cellphone, immediately went viral.

In another video, the victim’s sister-in-law, in veil, was heard saying: “They are putting pressure on us. They are saying that if our daughter had died of coronavirus, would she have received compensation? They are saying that the case will be rafaa-dafaa (dispose of). We are getting threats, our father is also getting threats.”

It is clear that the DM and SP of Hathras are more interested in cover-up rather than ensuring justice to the family. After watching the DM giving indirect threats, can any poor family expect truth, justice and fairness from such officials? To top it all, the DM has issued orders banning entry of mediapersons into the district. Clearly, the UP police is trying to suppress the truth by giving veiled threats to the media.

The Additional DGP (Law and Order) Prashant Kumar on Thursday said, “as per the Forensic Science Lab report, no sperm or spermatozoa was found in the viscera sample of the victim. There is no evidence of rape, according to this report. Despite statements by officials, some wrong information was circulated in the media. There is an attempt to create caste tensions and cause social disharmony. Some people are putting out twisted facts in the media. There is also an attempt to defame the (police) department and we will initiate action against such persons who do so.”

According to experts, there were lapses in the medical examination procedure that took place eight days after the alleged rape. It clearly violates national and international guidelines that say that scrutiny of the victim’s private parts must be done at the earliest in rape cases.

About the threat to take action against the media, I want to say here categorically that we have never been afraid, nor shall we be afraid in speaking out the truth. In cases where a daughter needs justice and voice has to be raised against injustice, I shall always stand up and raise my voice from the forefront. For the last three days, the voice of the daughter has been ringing in my ears in which she has been saying that she was working in the field when Sandeep came, tried to strangulate and assault her.

The voice of her father continues to ring in my ears, when he literally begs before the DM with folded hands, saying “Saheb, please wait till morning, please allow us to take our daughter’s body inside our doorstep. Cremation is never done at night, we will do it in the morning.”

The voice of her mother still rings in my ears, in which she is saying “we want to put ‘haldi’ (turmeric) on our daughter’s hands before saying goodbye to her”, but the DM’s voice says “no more wait. Cremation shall be done now, at night.”

Imagine, the body of a daughter lying in front of the house and the parents and family members are unable to have a last look at her. The family members are locked inside their house, even as the daughter’s body is cremated in the dead of the night.

Imagine the family’s trauma, and when they speak to the media, the DM comes to their home and tells them bluntly that the media will leave soon and “it is us with whom you will have to deal with”. The duration of the DM’s voice is hardly 13-14 seconds but that summarizes the tone and intent of the administration. This 14-second video is enough for any sane person to imagine the travails that the girl’s family must have gone through for 17 days after that horrific incident.

Listening to the Additional DGP’s remarks, I feel as if these senior police officers have been trained throughout their life never to serve, but to harass the common man. Their remarks clearly display that they have nothing to do with truth, and they have refined the act of lying into a fine art. And when their lies comes unstuck, they display the power of their uniform, they subdue common people with their lathis, and to those who try to ventilate the voice of the common people, they issue veiled threats of taking legal action.

I still want the UP police to exert all its energy and give justice to the teenager, instead of resorting to oppression, cover-up and threats to media. Every daughter in India today is asking, how long should we continue to live in fear? Instead of suppressing facts and truth, the police must come forward and give courage to our daughters. Let the whole truth come out.

But if the police persists with its attitude of suppressing the truth, stifling the voice of the victims, indulging in a litany of lies, and continuing with the intention of doing ‘rafaa-dafaa’ (dispose of) in this case, which daughter will gather courage to go the police and file complaint of sexual assault? Which parents will get the courage to go the police to seek justice? Should they remain silent and continue to live in trauma?

When the Nirbhaya incident happened, the entire nation stood up as one and voiced its outrage. Laws relating to sexual assault were made stringent. A sense of security returned in the minds of women who thought that they would get quick justice whenever they are subjected to assault. In the Nirbhaya case itself, it took seven years for the rapists to be hanged because of the tortuous legal process.

Chief Minister Yogi Adityanath has promised to get the SIT report in Hathras case within 7 days, but I want to tell him again that the rapists of Hathras must get the most stringent punishment within the shortest possible time frame. If the UP government succeeds in doing that, it will create a sense of fear in the minds of all rapists. Every rapist must know that he could be hanged for his despicable act. So long as there is no fear of law in the minds of such criminals, it will be difficult to prevent incidents of rape.

Finally, I want to salute our judiciary for taking quick suo motu cognizance of the Hathras case and summoning the senior UP officials to come to court with facts. The common man on the street respects our judges. Our judiciary commands respect throughout the world. The Lucknow bench High Court order, that I mentioned in the beginning, clearly indicates that our judges have realized the trauma through which the victim and her family must have gone through, and the learned judges have understood how police and administration were trying to do a hasty cover-up by carrying out forced cremation at night.

I have full confidence in our judiciary and hope that the girl’s family will get justice, at the earliest. Police must not be allowed to throttle the voice of the poor and the weak. The only sad point is that the police managed to cremate the body, removing most of the vital traces of evidence that could have hanged the rapists. Only the ashes remain, and it is on these ashes that a full-scale political tug-of-war has been unleashed.

हाथरस पुलिस ने मंगलवार की रात अपना झूठ छिपाने के लिए जो हरकत की उसे देखकर मेरा दिल दुख, गुस्से और दर्द से भर गया है। दुख इस बात का है कि जिस 19 साल की लड़की को टॉर्चर किया गया, उसका गैंगरेप किया गया, वह अब हमारे बीच नहीं है। और गुस्सा इस बात का है कि हाथरस पुलिस ने किस तरह लड़की के परिवार के सदस्यों की अनुपस्थिति के बावजूद जल्दबाजी में दाह संस्कार किया और साथ ही मानवता के बुनियादी मूल्यों की भी चिता जला दी।

मंगलवार की रात 2.40 बजे पुलिस ने गरीब दलित परिवार के गांव में पुलिस ने जल्दबाजी में सिर्फ गैंगरेप पीड़िता के शव का दाह संस्कार नहीं किया, बल्कि उसके साथ वर्दी की इज्जत, नियम कानून और मानवीय संवेदनाओं को भी चिता में झोंक दिया। यह सब जलती चिता को चुपचाप देख रहे ग्रामीणों के सामने अपनी वर्दी के पूरे रौब, पूरी धौंस के साथ किया गया।

दलित माता-पिता और पीड़िता के भाई आखिर तक पुलिस अधिकारियों से गुहार लगाते रहे कि उन्हें लड़की का अंतिम संस्कार हिंदू मान्यताओँ के मुताबिक सुबह करने की इजाजत दी जाए ताकि रिश्तेदार उसके अंतिम दर्शन कर सकें, लेकिन पुलिस अफसरों के कान पर जूं तक नहीं रेंगी। वे साफ तौर पर अंतिम संस्कार की जल्दबाजी में थे ताकि वे 2 हफ्तों से जिस झूठ को छिपा रहे थे, उसे हमेशा के लिए दफनाया जा सके।

जिलाधिकारी और पुलिस अधीक्षक की मौजूदगी में सैकड़ों पुलिसकर्मी श्मशान घाट में इकट्ठा हुए और पीड़िता के शव को चिता पर रख दिया। कुछ गांव वाले जो लड़की का चेहरा देखने के लिए जोर लगा रहे थे, उन्हें पुलिस वालों ने धमकी देते हुए यह डायलॉग मारा कि ‘ज्यादा बोले तो टपका दूंगा’। यह धमकी कैमरे पर रिकॉर्ड हो गई थी।

प्रशासन के लिए मेरा सीधा सवाल है: उस लड़की ने कौन-सा गुनाह किया था जिसके चलते डीएम ने आदेश दिया कि रात को ही उसका अंतिम संस्कार कर दिया जाए? क्या वह अनाथ थी? क्या वह बेसहारा थी? यहां तक कि खूंखार आतंकवादियों का अंतिम संस्कार भी पूरी गरिमा के साथ किया जाता है, उनके परिवार के सदस्यों को अंतिम दर्शन के लिए बुलाया जाता है, लेकिन हाथरस पुलिस ने पीड़िता की लाश और उसके परिवार के सदस्यों का जरा भी सम्मान नहीं किया। उन्होंने पीड़ित के माता-पिता और भाई पर कोई रहम नहीं किया। लड़की के पिता को एक पुलिसवाले ने लात मारी थी, जबकि एक अन्य पुलिसकर्मी घर के अंदर उसके भाई की पिटाई की थी। कारण: वे जोर दे रहे थे कि शव का अंतिम संस्कार सुबह किया जाए।

पुलिस अधिकारी पीड़िता के शव को जबरन उसके घर से श्मशान घाट ले गए थे और बाद में दावा किया कि दाह संस्कार ‘परिवार के सदस्यों की सहमति से’ किया गया था। इस सफेद झूठ से ज्यादा शर्मनाक कुछ भी नहीं हो सकता।

बुधवार की रात को अपने प्राइम टाइम शो ‘आज की बात’ में मैंने दिखाया था कि लड़की के माता-पिता ने पुलिस अधिकारियों के सामने कैसे गुहार लगाई और अधिकारियों ने परिवार के सदस्यों को क्या जवाब दिए। स्थानीय प्रशासन का रवैया अक्खड़ और अहंकारी साबित करने के लिए और ज्यादा सबूतों की जरूरत नहीं है। मैंने दिखाया कि कैसे पीड़िता के पिता डीएम के सामने गिड़गिड़ा रहे थे कि उनके परिवार को लड़की का अंतिम दर्शन करने की इजाजत दी जाए, और डीएम ने जवाब दिया कि वह उन्हें इसकी इजाजत देंगे लेकिन अंतिम संस्कार तुरंत करना होगा। कोई वरिष्ठ अफसर इतना क्रूर और बेदर्द कैसे हो सकता है कि वह पीड़िता के पिता को ‘गांववालों के चक्कर में न पड़ने’ की बात कहे।

एक ऐसे समय में जबकि पूरा देश पीड़ित परिवार के दुख में उसके साथ खड़ा है, स्थानीय प्रशासन, जिसे इस परिवार की मदद करनी चाहिए और उसे इंसाफ दिलाना चाहिए, वही निष्ठुरता दिखा रहा है। मैं तो इसे ‘अंतिम संस्कार’ भी नहीं कहूंगा क्योंकि हिंदू धार्मिक परंपराओं के मुताबिक सूर्यास्त के बाद किसी शव को मुखाग्नि नहीं दी जाती है। जब लड़की की चिता जलाई गई तो वहां रोने के लिए परिवार का कोई भी सदस्य नहीं था। चिता के पास सिर्फ भारी संख्या में पुलिसबल तैनात था, वह भी पूरी बैरिकेडिंग के सथ, और रात के खौफनाक सन्नाटे में पीड़िता की लाश राख में बदल गई।

इंडिया टीवी के रिपोर्टर आनंद पांडे मंगलवार की रात मीडिया को रोकने के लिए की गई पुलिस की बैरिकेडिंग लगने से पहले ही लड़की के घर पर पहुंचने में कामयाब रहे थे। अपने शो में मैंने दिखाया कि कैसे लड़की की मां के साथ अन्य महिलाएं शव को सीधे श्मशान घाट ले जाने से रोकने के लिए पुलिस की एम्बुलेंस के सामने खड़ी थीं। महिलाएं मांग कर रही थीं कि शव को पहले लड़की के घर ले जाया जाए, लेकिन पुलिसकर्मी अपनी बात पर अड़े थे। इसके बाद महिला पुलिस कॉन्स्टेबल्स को बुलाया गया और उन्हें एम्बुलेंस के सामने जमीन पर बैठी महिलाओं को हटाने के लिए कहा गया। वहीं, पुरुषों को वहां से हटाने का काम पुलिसवालों के डंडों ने किया।

चूंकि अफसरों को मालूम था कि वे जो कर रहे हैं, वह ठीक नहीं हैं, गांव वाले नाराज हैं, इसलिए अफसर खुद हैलमेट पहन कर पहुंचे। उन्होंने पहुंचते ही जोर देकर कहा कि अंतिम संस्कार तुरंत होगा, लेकिन महिलाओं का कहना था कि पीड़िता के शव को कम से कम अंतिम दर्शन के लिए उसके घर ले जाया जाना चाहिए। बहुत जिद करने के बाद एम्बुलेंस को लड़की के घर ले जाया गया लेकिन एक नया विवाद पैदा हो गया। पुलिस की तरफ से कहा गया कि जितनी जल्दी हो सके अंतिम संस्कार की रीति पूरी करनी है लेकिन घरवालों का कहना था कि अंतिम संस्कार रात को नहीं बल्कि सुबह किया जाएगा। लड़की के घरवालों का कहना था कि उन्होंने डेड बॉडी को रखने के इंतजाम किए हैं। उन्होंने कहा कि बर्फ की सिल्ली लाकर घर में रखी है जिससे शव खराब ना हो, लेकिन पुलिस डेडबॉडी सौंपने के लिए तैयार नहीं हुई। जब बात नहीं बनी तो पुलिसवाले एम्बुलेंस को लेकर सीधे श्मशान पहुंच गए।

पुलिस वाले लड़की की डेडबॉडी को तो श्मशान लेकर चले गए, लेकिन यहां एक और समस्या पैदा हुई कि परिवार के सदस्यों की अनुपस्थिति में शव का दाह संस्कार कैसे किया जाए। इसक बाद लड़की के चाचा और उसके दादा को पुलिस की जीप में जबरन श्मशान घाट लाया गया। पुलिस अधिकारियों ने परिवार के सदस्यों को श्मशान घाट आने के लिए मनाने की कोशिश की, लेकिन उन्होंने घरवनालों ने साफ कर दिया कि वे रात को चिता नहीं जलाएंगे। इसके बाद पुलिस और परिवार के सदस्यों के बीच काफी बहस हुई। इसी बीच एक पुलिसकर्मी ने लड़की के पिता को लात मार दी, और दूसरे पुलिसकर्मी ने उसके भाई की पिटाई शुरू कर दी।

अपने शो में मैंने दिखाया था कि कैसे पुलिसवाले परिवार के सदस्यों को पुलिस की जीप में जबर्दस्ती ले जाने की कोशिश कर रहे थे, लेकिन लड़की के परिजन इसके लिए तैयार नहीं थे। इसके बाद लड़की के घरवाले किसी तरह पुलिसवालों से बचकर घर के अंदर चले गए और आंगन का गेट बंद कर दिया। फिर पुलिसवाले भी वाहं से चले गए और परिवार वालों की गैरमौजूदगी में ही अंतिम संस्कार कर दिया। लड़की के घरवालों पर पुलिस का खौफ ऐसा था कि वे रात भर घर से बाहर नहीं निकले। और इस तरह एक गैंगरेप पीड़िता का रात के अंधेरे में अंतिम संस्कार कर दिया गया। हाल के दिनों में पुलिस और प्रशासन की बेदर्दी की, असंवेदनशीलता की ऐसी तस्वीर आज से पहले न ही किसी ने देखी होगी और न ही सुनी होगी।

हाथरस के डीएम का यह दावा कि पीड़िता के परिवार की सहमति लेने के बाद ही उसका अंतिम संस्कार किया गया, एक सफेद झूठ है। लड़की की मां और भाई ने इंडिया टीवी को कैमरे पर बताया कि उन्हें जबर्दस्ती श्मशान घाट ले जाया जा रहा था, लेकिन उन्होंने इसका विरोध किया और खुद को घर में बंद कर लिया। लड़की की मां ने कहा कि परिवार के लोगों की पुलिसवालों ने पिटाई भी की थी।

जल्दबाजी में दाह संस्कार के पीछे एकमात्र कारण यह था कि स्थानीय प्रशासन इस मामले को जल्द से जल्द निपटाना चाहता था। पुलिस अधिकारियों को डर था कि यदि मीडिया की मौजूदगी में सुबह दाह संस्कार हुआ तो मामला हाथ से निकल जाएगा। स्थानीय प्रशासन गैंगरेप की घटना के बाद पुलिस से हुई गलतियों और उसके द्वारा कहे गए झूठ पर पर्दा डालना चाहता था। पुलिस साफ तौर पर मीडिया के सवालों का सामना नहीं करना चाहती थी। लेकिन वे जाहिर तौर पर यह भूल गए कि टीवी न्यूज चैनलों के स्टाफ रात को सोते नहीं हैं और उन्होंने लड़की के घर के अंदर होने वाले सारे ड्रामे को रिकॉर्ड कर लिया है।

मेरा मानना है कि यदि पुलिस ने शुरू से ही सच बोला होता तो यह मामला हाथ से नहीं निकला होता। पुलिस एक के बाद एक झूठ बोलती जा रही थी और किसी तरह मामले को दबाने की कोशिश कर रही थी। यदि पुलिस ने शुरू में ही उचित कार्रवाई की होती तो संभव है कि लड़की की जान भी बच जाती।

पुलिस ने पहला झूठ बोला कि लड़की के साथ गैंगरेप नहीं यौन उत्पीड़न हुआ था। दूसरा झूठ बोला कि घटना में सिर्फ एक आरोपी शामिल था। तीसरा झूठ बोला कि उसकी रीढ़ की हड्डी में चोट नहीं लगी थी। चौथा झूठ बोला कि उसकी जीभ नहीं काटी गई। पांचवां झूठ बोला कि उसका इलाज ठीक से हो रहा था। और बुधवार को पुलिस ने आखिरी झूठ बोला कि रात में लड़की का अंतिम संस्कार उसके परिवार वालों की रजामंदी के साथ हुआ।

अब जो परिवार इतने सारे झूठों का सामना कर चुके हैं कि उसे कैसे भरोसा होगा कि स्थानीय पुलिस उन्हें इंसाफ दिलाएगी। उस परिवार को कैसे भरोसा होगा कि यही पुलिस हत्यारों को फांसी के फंदे तक पहुंचाने का केस बनाएगी। यूपी के मुख्यमंत्री योगी आदित्यनाथ को इस बात का एहसास हो गया था कि कि उनके राजनैतिक विरोधी इस मामले का फायदा उठाने की कोशिश कर सकते हैं, क्योंकि चारों आरोपी राजपूत बिरादरी के हैं जबकि पीड़ता दलित समुदाय से ताल्लुक रखती है। स्थानीय प्रशासन और पुलिस द्वारा बोले गए झूठ अंततः योगी को ही नुकसान पहुंचाएंगे।

योगी आदित्यनाथ ने लड़की के पिता से फोन पर बात की, 25 लाख रुपये की मदद देने का ऐलान किया, साथ ही एक घर और परिवार के एक सदस्य को नौकरी का भी वादा किया। लेकिन मुझे लगता है कि हालात को देखते हुए इतना काफी नहीं है। योगी आदित्यनाथ को लड़की के परिवार को, देश की जनता को भरोसा दिलाना होगा कि सरकार हत्यारों को फांसी के फंदे तक पहुंचाएगी। पुलिस अच्छी तरह केस तैयार करेगी, इसको लड़ने के लिए बड़े वकीलों को हायर किया जाएगा, और अदालत में टाइमबाउंड तरीके से जल्दी फैसला करने का निवेदन किया जाएगा। सरकार को यह भी सुनिश्चित करना होगा कि फास्ट ट्रैक कोर्ट इस मामले में निश्चित समय-सीमा के भीतर इंसाफ करे।

My heart fills with sorrow, anger and pain over what Hathras police did on Tuesday night to brazenly cover up its lies in the dead of night. Sorrow, because a 19-year-old girl who was tortured and gang-raped by four people died; pain, on watching the tears of the girl’s parents; and anger, over how Hathras police set fire to basic human values of dignity when it hurriedly cremated the body in the absence of family members.

At 2.40 am on Tuesday night in the poor Dalit family’s village, the police not only cremated the gang-rape victim’s body in a hurry, but also made a bonfire of all civil laws, all sense of human dignity and the majesty of the police uniform. All this was done through brazen assertion of the clout of its uniform, before a crowd of villagers silently watching the funeral pyre.

Till the last moment, the Dalit parents and the victim’s brother pleaded before police officers to allow the cremation to be done early at dawn, according to Hindu rites, so that relatives could come and have a last look at the girl, but the police officders did not budge. They were clearly in a hurry to cremate, so that the lies that they had dished out over the last two weeks could be covered up, for ever.

In the presence of District Magistrate and Superintendent of police, hundreds of policemen assembled at the cremation ground and put the victim’s body on the funeral pyre. A handful of villagers who insisted on seeing the girl’s face, were threatened by policemen with dialogues like ‘zyada boley toh tapka doonga’( will shoot you if you speak much). This threat was recorded on camera.

My simple question to the administration: what was the girl’s crime because of which the DM ordered that the body be cremated in the dead of night? Was she an orphan? Was she a destitute? Even the last rites of dreaded terrorists are conducted with dignity, their family members are called to have a last look, but in Hathras, police did not give even the minimal amount of respect to the victim and her family members. They did not show mercy towards the victim’s parents and brother. The girl’s father was kicked by a policeman, and her brother was beaten up by another inside his house. Reason: they were insisting that the body be cremated at dawn.

The police officers forcibly took away the victim’s body from her house to the cremation ground and later claimed that the cremation was done “with the consent of family members”. Nothing could be more shameful than this white lie.

In my prime time show ‘Aaj Ki Baat’ on Wednesday night, I showed how the girl’s parents pleaded before police officers, and what the officers replied to family members. No more evidence is required to prove that the local administration’s attitude was abrasive and arrogant. I showed how the girl’s father was begging before the DM to allow his family to have a last look at the girl, and the DM replied that he would allow them but the cremation must be done immediately. How can a senior official be so cruel and brazen, telling the victim’s father ‘not to fall in the trap of villagers’?

At a time when the entire nation stands in sympathy with the victim’s family, the local administration which is supposed to provide help and succour to the victim’s family was behaving in a heartless manner. I would not describe it as ‘final rites’, because in Hindu religious tradition, a body is not cremated after sunset. There was nobody from the family to weep near the funeral pyre when it was lit. Only scores of policemen were standing near the pyre, with full barricading in place, and the victim’s body turned into ashes in the fearful and still silence of the night.

India TV reporter Anand Pandey managed to reach the girl’s home on Tuesday night even before the police put barricades around the village to stop the media from sneaking in. In my show, I showed how the girl’s mother along with other women stood in front of the police ambulance to stop the body from being taken directly to the cremation ground. The women were demanding that the body be first taken to the girl’s home. But policemen were adamant. Women police constables were called in and they were asked to remove the women who were squatting on the ground in front of the ambulance. The menfolk were chased away by policemen with lathis.

Senior police officials, wearing helmets, reached the spot. At first, they insisted that the cremation would be done immediately, but the womenfolk said the body should at least be taken to the girl’s home for a last look. After much persistence, the ambulance was taken to the girl’s home but a fresh problem arose. The villagers had brought ice slabs to prevent the body from decomposing, and the girl’s parents insisted that the body be kept in home at least till dawn. Police then took a tough line and the ambulance was taken straight to the cremation ground. Another problem arose over how to cremate the body in the absence of family members. The girl’s uncle and her grandfather were forcibly brought to the cremation ground in a police jeep.

Police officers tried to persuade family members to come to the cremation ground, but they insisted that the cremation must be carried out at dawn. Heated exchanges took place between the police and family members, one policeman kicked the girl’s father, and another policeman started beating her brother.

In my show, I showed how policemen were trying to drag family members into police jeeps, but the girl’s family resisted. Finally, with the family barricading itself inside the house, police carried out the final rites of the gang-rape victim at the cremation ground. The family members were in such a state of fear that they did not dare to venture outside their house throughout the night. This was how a gang-rape victim was cremated in the dead of night. Such an act is unprecedented and unheard of, at least in recent times.

The Hathras DM’s claim that the cremation was done after obtaining consent of the victim’s family is a plain lie. The girl’s mother and brother told India TV on camera that they were being forced to go to the cremation ground, but they resisted and staying inside their home. The girl’s mother said that the family members were beaten up by police

The only reason behind a hurried cremation was that the local administration wanted the matter to fizzle out at the earliest. Police officers feared that if the cremation took place in the morning in the presence of media, the matter would go out of hand. The local administration wanted to cover up all the lies that were being dished out by police since the gang-rape incident. The police was clearly unwilling to face intense media scrutiny. But they evidently forgot that TV news channel staff do not sleep at night and they recorded all the drama that took place inside the girl’s house.

My view is that the matter would not have gone out of hand, had the police spoken the truth from the beginning. The police was dishing out lies one after another and was trying to obfuscate matters. If the police had acted fairly in the beginning, the girl’s life could have been saved.

The first lie that police made was that it was sexual harassment and not a gang-rape. The second lie that police made was that only one accused was involved. The third lie was: there were no spinal injuries. The fourth lie was: the rapists did not cut off her tongue. The fifth lie was: the victim was undergoing proper treatment. The final lie made by police on Wednesday was: the cremation was done with the consent of the family.

How can the family of a gang-rape victim, in the face of so many lies, trust the local police to provide justice, and ensure that the rapists-cum-murderers are hanged? UP chief minister Yogi Adityanath has realized that the opposition parties may try to take undue advantage because all the four accused belonged to Rajput community and the victim was a Dalit girl. The lies that were dished out by local administration and police will ultimately hurt Yogi.

Yogi Adityanath spoke to the girl’s father on phone, promised to give Rs 25 lakhs as assistance, a house and a government job for his son. This is not adequate. The rapists-cum-murderers must be hanged at the earliest, and Yogi must ensure that the prosecution be launched without any delay. He must ensure that the police prepares its case diligently and top lawyers are hired to fight the prosecution’s case in court. He must also ensure that the verdict must come from the fast track court within a definite time frame.
