Today I want to begin by sounding a note of caution. Huge crowds of Diwali shoppers have been noticed in most of the big markets in the major cities of India during the past one week, giving rise to fears of a third wave of Covid pandemic.

Despite repeated announcements by the Centre and state governments, all standard guidelines for prevention of Covid have been thrown to the winds. Most of the shoppers thronging the markets are moving around without masks. People are becoming nonchalant and are under the false impression that the danger of another wave of pandemic is no more.

It is true that the fear of another wave of pandemic is presently not there, and the rise in number of Covid cases has declined. It is also true that the world has praised India’s success in crossing the target of more than a billion doses of Covid vaccines. Yet, it is also true that the virus has not vanished, it is causing deaths in several parts of the globe. The danger is still there.

During the last 24 hours, 12,514 fresh Covid cases were registered across India and the daily positivity rate is now 1.42 per cent. But the visuals of thousands of Diwali shoppers thronging the big markets of major cities like Delhi, Mumbai, Ahmedabad, Jaipur, Lucknow, Patna and Bhopal are scary. People are committing the same mistake that they did after first wave of pandemic waned. The result: the nation faced a deadly second wave of pandemic in April and May, when lakhs of people gasped for survival, due to lack of oxygen. The crematoriums were full and daily thousands of bodies of Covid victims were being cremated.

In my prime time show ‘Aaj Ki Baat’ on Monday night, we showed visuals from Delhi’s major markets like Sadar Bazar, Chandni Chowk, Bhagirath Palace, Sarojini Nagar, Lajpat Nagar, Gandhi Nagar, and Laxmi Nagar. With crowds thronging shops, there was no place even to stand, forget social distancing.

Our reporters spoke to shoppers and traders. One shopkeeper said, people have stopped fearing the pandemic after getting vaccinated. Most of the people, who were not wearing masks, told our reporters nonchalantly that the fear is now over and there was no need to wear masks. The fear that had engulfed Delhites in April and May is no more. Remember, there were no beds or oxygen in Delhi hospitals during May. People were fighting for their lives, waiting for oxygen, lying inside cars and ambulances. There was 24 to 48 hours of waiting outside crematoriums.

Similar crowds were seen in the major markets of Mumbai and Ahmedabad, the cities that bore the brunt of the second wave of pandemic in April and May. At the Teen Darwaza market in Ahmedabad, huge crowds of shoppers were jostling outside shops.

Our reporters spoke to doctors who said that if a third wave hits the cities, the load on medical infrastructure will be too high. The doctors said, people must not live under a false impression that getting both the vaccine doses is a panacea for them. Covid appropriate behaviour is a must to prevent the pandemic. There were huge crowds of Diwali shoppers at the Khaitan market in Patna and Bhootnath market in Lucknow. In both these places, there were hundreds of shoppers moving around without masks.

We should learn from what is happening in other countries. Russia is presently facing a big wave of Covid pandemic. Daily more than 40,000 Covid cases are being reported. In Russia, more than 70 per cent people have been vaccinated with a single dose, while 33 per cent of the population has already taken double doses. 1,131 Covid patients died during the last 24 hours in Russia. Russia did not face huge crowds that are being witnessed in India, and yet the virus spread fast. A lockdown has been imposed from October 30 till November 7. Those above the age of 60 years, who have not taken both the doses, have been asked to remain indoors.

Frenzied buying for Diwali and hectic partying at homes, is good news for economists. The Indian economy, which had witnessed a decline during the lockdown period, is now booming. It should be good news for all of us, but we should also take care to prevent a fresh wave of pandemic.

With the decline in number of cases, cinemas, shopping malls, schools and colleges have reopened, but caution is the need of the hour. I understand, people had been feeling a sense of fatigue after continuously wearing masks and remaining indoors for nearly two years. They want to move around in the open, but they must avoid crowds, and follow Covid guidelines diligently. One must not be under the false impression that taking both the vaccine doses will prevent the virus from entering the body.

Medical experts have pointed out that the decline in number of cases was mainly due to strict implementation of Covid guidelines. Most of the people have developed antibodies, but the virus hasn’t gone away. It is still lurking. Nobody wants a situation like Russia developing here in India. At least, people must wear masks when they step out of their homes. They should not keep the masks inside their pockets or leave them hanging on their chin. Nose and mouth must remain covered with mask.

Remember, this is the last phase of the pandemic. If we all follow guidelines, we shall win this battle. Since Diwali is the festival of lights and joy, everybody should celebrate, but they must do so, with caution. Buying new utensils or other goods during Dhanteras is a customary ritual. They are free to follow this, but they must exercise caution when they find a crowd in front of them. Do not bring the Coronavirus to your home, otherwise your near and dear ones can get infected. There is no medicine to prevent Coronavirus, and the vaccine provides you with protection. Do not live under the false impression that those who have been vaccinated will never get infected with the virus.

पिछले 11 महीने से बंद दिल्ली के बॉर्डर्स को पुलिस ने शुक्रवार को खोल दिया। नेशनल हाईवे पर आवागमन सामान्य रूप से बहाल करने के लिए टिकरी और गाजीपुर बॉर्डर से सारे बैरिकेड्स हटा दिए गए। दिल्ली पुलिस ने बैरिकेड्स, कंटीले तार और कंक्रीट के बोल्डर हटाकर रास्ते को क्लियर कर दिया। आंदोलनकारी किसान ट्रैक्टरो पर सवार होकर दिल्ली में घुस न पाएं, इसके लिए पिछले साल ये बैरिकेड्स लगाए गए थे। इन बैरिकेड्स की वजह से इस रास्ते से होकर आनेजाने वाले या फिर आसपास रहनेवाले लोगों को काफी परेशानियों का सामना करना पड़ रहा था। जो दूरी 10 मिनट में तय की जा सकती थी उसे तय करने में तीन घंटे तक लग रहे थे।

सुप्रीम कोर्ट ने हाईवे पर यातायात को सुचारू तरीके से बहाल करने के लिए किसान संगठनों को निर्देश दिया था कि वे अपने टेंट और सामान हटा लें। लेकिन शुक्रवार को किसानों की तरफ से टेंट हटाने का कोई संकेत नहीं मिला। वे हाईवे के एक बड़े हिस्से पर अपना कब्जा बनाए हुए थे जिससे आवागमन अभी भी रुका हुआ है।

किसान नेता राकेश टिकैत ने कहा, धरनास्थल पर उनका प्रदर्शन जारी रहेगा। उन्होंने दावा किया, दिल्ली पुलिस सुप्रीम कोर्ट के आदेश पर बैरिकेड्स हटा रही है, क्योंकि हमने कोर्ट से कहा है कि ‘हाईवे को पुलिस ने ब्लॉक कर रखा है, किसानों ने नहीं।’ टिकैत ने धमकी भी दी। उन्होंने कहा-‘किसान अब राजधानी दिल्ली में दाखिल होने के लिए आजाद हैं, वे ट्रैक्टर से दिल्ली में दाखिल होंगे और संसद के बाहर धान बेचेंगे।’

पिछले साल नवंबर में दिल्ली पुलिस ने राजधानी के तीन प्रमुख एंट्री प्वाइंट्स पर बैरिकेड्स लगाए थे। लेकिन 26 जनवरी को गणतंत्र दिवस के मौके पर लाल किला, आईटीओ और अन्य जगहों पर ट्रैक्टर रैली के दौरान हुई हिंसा की घटनाओं के बाद पुलिस ने कांटेदार तार, कील, बड़े कंटेनर और कंक्रीट के पत्थर लगा दिए थे ताकि किसान संगठन के लोग फिर से दिल्ली में घुसकर उत्पात न मचा सकें। इसके बाद से गतिरोध जारी था। गाजीपुर में तो बैरिकेड्स की 12 लेयर बनाई गई थी। इन सभी को पुलिस ने शुक्रवार को हटा दिया। बैरिकेड्स हटाने के लिए क्रेन, जेसीबी मशीन और कर्मचारियों को लगाया गया।

दिल्ली पुलिस ने स्पष्ट कर दिया है कि अब उनकी तरफ से नेशनल हाईवे नंबर 9 पर कोई रुकावट नहीं है। पुलिस का कहना है कि गाजीपुर और टिकरी बॉर्डर पर रास्ता क्लीयर कर दिया गया है। लेकिन हकीकत ये है कि NH-9 पर अभी भी ट्रैफिक शुरू नहीं हो पाया है। क्योंकि हाईवे की दो लेन पर किसानों ने अपने टेंट लगा रखे हैं। ट्रैफिक शुरू होने में सबसे बड़ी अड़चन आंदोलनकारी किसानों का मंच है। सड़क के बीचों-बीच आंदोलन का मुख्य मंच बना हुआ है जिसके कारण फिलहाल कोई भी गाड़ी एक तरफ से दूसरी तरफ नहीं जा सकती। किसानों ने मंच के पास कंक्रीट की पक्की दीवार बना रखी है। आंदोलन स्थल बड़ी संख्या में गाड़ियां और ट्रैक्टर हैं।

दिल्ली-हरियाणा के टिकरी बॉर्डर पर भी कमोबेश गाजीपुर बॉर्डर जैसे ही हालात हैं। यहां भी किसानों ने अपने टेंट और ट्रैक्टरों को नहीं हटाया है जबकि दिल्ली पुलिस ने सभी बैरिकेड्स, कंटीले तार और बोल्डर्स को हटा दिया है।

शुक्रवार की रात अपने प्राइम टाइम शो ‘आज की बात’ में मैंने दिल्ली पुलिस कमिश्नर राकेश अस्थाना से पूछा कि अचानक सारे बैरिकेड्स हटाने के पीछे वजह क्या है। उन्होंने कहा कि दिल्ली पुलिस पिछले कई हफ्तों से लगातार दोनों पड़ोसी राज्यों और किसान नेताओं से बैरिकेड्स हटाने को लेकर बात कर रही थी ताकि आवागमन को सुचारू रूप से चालू किया जा सके। उन्होंने कहा, ‘हम एक सकारात्मक संदेश देना चाहते थे कि पुलिस आवागमन को सुचारू रूप से चलाने के लिए तैयार है।’

किसान नेता राकेश टिकैत की इस धमकी पर कि किसान दिल्ली में घुसेंगे और संसद के बाहर धान बेचेंगे, राकेश अस्थाना ने कहा- ‘अगर कानून-व्यवस्था को लेकर कोई समस्या होती है तो फिर हम उसे परिस्थितियों के मुताबिक समुचित तरीके से हैंडल करेंगे।’ किसान नेताओं द्वारा अपने टेंट और मंच को हटाने से इनकार करने के सवाल पर दिल्ली पुलिस प्रमुख अस्थाना ने कहा, टेंट और मंच उत्तरप्रदेश की तरफ बनाए गए हैं। यूपी पुलिस और प्रशासन को इस पर फैसला लेना होगा और हम उनके साथ समन्वय रखेंगे। ‘मुझे उम्मीद है कि लोगों के आवागमन को आसान बनाने के लिए कोई रास्ता निकलेगा।’

राकेश टिकैत के टकराव वाले मूड से जुड़े सवाल पर अस्थाना ने कहा, ‘हमें अभी भी पूरी उम्मीद है कि किसी तरह का कोई टकराव नहीं होगा। कानून-व्यवस्था बनाए रखना हमारी सर्वोच्च प्राथमिकता है। जब जैसे हालात होंगे हम उसे संभाल लेंगे।’

सिंघु बॉर्डर से बैरिकेड्स हटाए जाने के सवाल पर राकेश अस्थाना ने कहा, टिकरी और गाजीपुर बॉर्डर को हमने एक टेस्ट के तौर पर लिया है। अगर ट्रैफिक सामान्य तौर पर बिना किसी बाधा के शुरू हो जाता है तो हम सिंघु बार्डर से भी बैरीकेड्स हटा देंगे। बुनियादी तौर पर हम सबसे यही कहना चाहते हैं कि हमारी तरफ से एक सकारात्मक सोच के तहत यह कदम उठाया गया है ताकि यातायात फिर से चालू हो और जनजीवन सामान्य हो सके।’

एक ओर जहां दिल्ली पुलिस सकारात्मक रुख दिखा रही है वहीं दूसरी ओर भारतीय किसान यूनियन के नेता राकेश टिकैत ने कहा-‘दिल्ली पुलिस बैरिकेडिंग हटा रही है तो किसानों के ट्रैक्टर भी तैयार हो रहे हैं । हम दिल्ली जाएंगे और संसद में धान बेचेंगे। सरकार ने कहा है कि अब किसान अपना अनाज देश में कहीं भी बेच सकता है । 11 महीने पहले हम दिल्ली जाने के लिए आए थे लेकिन पुलिस ने हमें यहां रोका। अब रास्ता खुलेगा तो सबसे पहले हम दिल्ली जाएंगे। सवाल रास्ते का नहीं है । सवाल एमएसपी का है, तीन कृषि क़ानून वापस लेने का है । हमने 26 नवंबर तक का सरकार को समय दिया है । हमारी मांगें मानी जाती है तो ठीक है, नहीं तो टेंट के पर्दे बदले जाएंगे। वाम धड़े के किसान सभा के नेता हन्नान मोल्ला भी टिकैत की बातों सहमत हैं, लेकिन उन्होंने कहा कि किसान दिल्ली में घुसने की कोशिश नहीं करेंगे।

संयुक्त किसान मोर्चा ने शुक्रवार रात एक बयान जारी कर कहा कि न टेंट हटेंगे और न ही किसान घर जाएंगे। मोर्चा ने कहा कि आंदोलन वापस नहीं लिया जाएगा। संयुक्त किसान मोर्चा ने पड़ोसी राज्यों के सभी किसानों से अपील की है कि वे बॉर्डर के एंट्री प्वाइंट पर जल्द पहुंचे।

किसान आंदोलन को शुरू हुए 11 महीने बीत गए। ये बहुत बड़ा वक्त होता है। लेकिन केंद्र सरकार, राकेश टिकैत और उनके सहयोगी किसान नेताओं के दबाव में नहीं आई। इसकी वजह सरकार की जिद नहीं पब्लिक का रुख है। बड़े पैमाने पर लोग कृषि कानूनों पर सरकार के रुख का समर्थन कर रहे हैं। लोकतन्त्र में सरकारें पब्लिक का मूड देखकर फैसले लेती है और जनता के समर्थन से झुकती है। इस आंदोलन की सबसे बड़ी कमी ये है कि राकेश टिकैत और दूसरे किसान नेताओं के साथ देश के लोगों का समर्थन नहीं है।

किसानों के साथ सबकी पूरी सहानुभूति है लेकिन उनके नेताओं पर भरोसा नहीं है। पिछले साल जब संयुक्त किसान मोर्चे की कॉल पर पंजाब और हरियाणा से हजारों की संख्या में किसान दिल्ली के बॉर्डर पर पहुंचे थे तो उस वक्त लोगों को लगा कि ये बड़ा आंदोलन है। लोग इस आंदोलन के साथ जुड़े। जब किसान और उनके परिवार को लोगों ने सर्दी में सड़क पर बैठे देखा तो लोग कंबल और रजाइयां लेकर पहुंच गए। धरनास्थल पर कोई फल, कोई दूध, कोई सब्जी तो कोई आटा लेकर पहुंच गया। लोगों ने जब बारिश में भीगते किसानों को देखा तो सरकार के खिलाफ नाराजगी का इजहार भी किया।

लेकिन जब किसान आंदोलन में देश-विरोधी लोग घुस गए, जब सियासी मजमा लगने लगा, देश विरोधी पोस्टर और नारे लगने लगे तो लोगों का दिल टूट गया। लोगों को लगा कि किसान ऐसे नहीं होते हैं। फिर जब 26 जनवरी को देशद्रोही तत्व जबरन लालकिले में घुस गए और राष्ट्रीय ध्वज का अपमान किया, हिंसा हुई तो किसान आंदोलन के प्रति लोगों का भरोसा पूरी तरह टूट गया। लोगों को लगने लगा कि ये किसान नहीं, बल्कि किसान के वेश में राष्ट्रविरोधी तत्व हैं।

इसके बाद भी पुलिस या प्रशासन ने या फिर सरकार ने किसानों को ताकत के बल पर बॉर्डर से उठाने की कोशिश नहीं की। पिछले छह महीने में मैने कई बार रिपोर्टर्स को बॉर्डर पर भेजा। पता लगा कि अब सिर्फ टेंट लगे हैं, लेकिन टेंट में किसान नेता नहीं हैं। संयुक्त किसान मोर्चे के कुछ कार्यकर्ता ही वहीं रहते हैं।

सबसे मजे की बात ये है कि राकेश टिकैत जैसे किसान नेता, जो सरकार को चुनौती दे रहे हैं, वे भी अब दिल्ली के बॉर्डर पर नहीं रहते। राकेश टिकैत, यूपी और हरियाणा में बीजेपी के खिलाफ कैंपेन कर रहे हैं। गुरनाम सिंह चढ़ूनी को पहले ही किसान मोर्चे ने सस्पेंड कर दिया था। अब वो भी नेतागिरी कर रहे हैं। एक अन्य नेता योगेन्द्र यादव लखीमपुरी खीरी गए थे। उसके बाद से वो भी संयुक्त किसान मोर्चे से सस्पेंड चल रहे हैं। हन्नान मोल्ला अपने घर में हैं। शिवकुमार कक्का जी, दर्शनपाल सिंह, जोगिन्दर सिंह उगराहा, बलवीर सिंह राजेवाल और युद्धवीर सिंह भी लंबे अर्से से नहीं दिखे हैं। इसके बाद भी राकेश टिकैत संसद में धान बेचने की धमकी दे रहे हैं।

असल में लोगों को लगने लगा है कि किसानों का यह आंदोलन किसानों की भलाई के लिए नहीं बल्कि बीजेपी को सत्ता से हटाने के लिए हो रहा है। इसीलिए लोगों ने किसान आंदोलन का साथ छोड़ा और यही इस आंदोलन के कमजोर होने की वजह है।

After a gap of 11 months, Delhi Police on Friday removed barricades, barbed wires and concrete boulders put on the capital’s borders at Tikri and Ghazipur border points, in order to ensure smooth flow of traffic on national highways. These barricades were put last year to prevent agitating farmers from entering the capital on tractors. Due to these obstructions, commuters and people living in close vicinity had a tough time in moving from one place to another. A distance that could have been covered in 10 minutes took nearly three hours to complete.

The Supreme Court had directed farmers’ organisations to remove their tents and other paraphernalia to ensure smooth flow of traffic on highways. But on Friday, there was no sign of farmers removing their tents. They continue to occupy large portions of the highway obstructing traffic.

Farmer leader Rakesh Tikait said, their protest at the site would continue. He claimed, Delhi Police was removing the barricades on Supreme Court’s orders, because “we had told the court that it was the police which had blocked the highways, not us.” Tikait went to the extent of issuing a threat. He said, farmers would now be free to enter the capital on tractors and they would sell paddy outside Parliament.

Delhi Police had installed barricades at the three major entry points of the capital in November last year. After farmers resorted to violence on January 26 Republic Day at the Red Fort, ITO and other places by using their tractors, police put barbed wires, nails, huge containerswe3 and concrete boulders to prevent farmers from entering Delhi. The impasse continues. There were 12 layers of barricades at Ghazipur, all of which were removed by police on Friday. Cranes, JCB machines and workers were brought to remove the barricades.

While Delhi Police claimed that the barricades at Ghazipur and Tikri border points have been removed, the fact remains that traffic is yet to reopen on NH9. Tents belonging to farmers are still there on two lines of the highway. The dais erected for farmer leaders is still there, bang in the middle of the highway. Farmers have erected a concrete wall near their dais. There is a large number of vehicles and tractors at the site.

A similar situation exists at the Delhi-Haryana border point at Tikri. Farmers have not removed their tents and tractors, while Delhi Police has removed all barricades, boulders and barbed wires.

In my prime time show ‘Aaj Ki Baat’ on Friday night, I asked Delhi Police Commissioner Rakesh Asthana what was the reason for suddenly removing all the barricades. He replied that Delhi Police had been speaking to farmer leaders and the police of two neighbouring states for the last several weeks for removing the barricades to ensure smooth flow of traffic. “We wanted to give a positive message to tell that police is ready to facilitate smooth flow of traffic”, he added.

On Rakesh Tikait’s threat about entering Delhi and sell paddy outside Parliament, Rakesh Asthana said, “if a law and order situation develops, we will handle it accordingly and appropriately.” On farmer leaders refusing to remove their tents and dais, the police chief said, “the tents and dais have been erected on the side of Uttar Pradesh. UP police and administration will have to decide, and we will coordinate with them. I still hope there will be a way out to facilitate people for moving freely.”

On Rakesh Tikait’s confrontationist mood, Delhi Police chief Asthana said, “I still hope there would be no confrontation. For us, maintenance of law and order is the topmost priority. We will handle the situation as and when it develops.”

On the question of removal of barricades from Singhu border, Rakesh Asthana said, “we have taken up Tikri and Ghazipur border points as test case. If traffic resumes smoothly, we will also remove barricades from Singhu border too. Basically, we want to tell everybody that there is positivity from our side so that traffic resumes and life becomes normal for the common man.”

While on one hand, Delhi Police is showing positivity, BKU leader Rakesh Tikait, on the other hand, has said: “Now that the borders are open, farmers will now enter Delhi, and since the Centre has brought a law allowing farmers to sell their produce anywhere, farmers will go to Parliament and sell paddy. For last 11 months, police stopped us from entering the capital. The question is not about reopening roads. The basic question is about MSP and the three farm laws. We have given time to the government till November 26. If the Centre does not agree to our demand (to repeal farm laws), then we will change our tents.” Pro-Left Kisan Sabha leader Hannan Mollah agreed with Tikait and said that farmers would not try to enter the capital.

The Samyukta Kisan Morcha, on Friday night, issued a statement saying that the tents will not be removed, nor the farmers will go home. The Morcha said the agitation will not be called off. The Morcha appealed to all farmers of neighbouring states to reach the border entry points immediately.

Eleven months have elapsed since the farmers began their protests. The Centre did not bow to pressures from farmer leaders. The reason is simple: the Centre did not bow because people at large are supporting the government’s stand on farm laws. In a democracy, governments take decisions by judging the popular mood. It bows when there is tremendous pressure from the public. The major drawback in this farmers’ agitation is that, Rakesh Tikait and other farmer leaders do not enjoy the support of the public at large.

While people have full sympathy with the farmers, they do not trust their leaders. Thousands of farmers came from Punjab and Haryana when the agitation began last year. When farmers and their family members sat on dharna in biting winter, people had sympathy for their cause. People provided blankets, fruits, milk, vegetables, groceries to the farmers sitting on dharna. People were unhappy when they saw farmers braving unseasonal winter rain.

At that point of time, anti-national elements infiltrated among the protesters, and a political touch was given to the protests. Anti-national posters were shown and anti-Indian slogans were raised. When anti-national elements forcibly entered the Red Fort and insulted the national flag, people’s sympathy for the farmers waned. People started realizing that these were not farmers, but anti-national elements posing as farmers.

People also noticed that the police and the administration did not use force to evict the farmers from the protest sites. During the last six months, we sent our reporters to the protest sites several times, and found most of the tents empty. There was no sign of farmer leaders. Only a few activists of Samyukta Kisan Morcha were seen.

Farmer leader Rakesh Tikait is busy campaigning against the BJP in states like UP and Haryana. Farmer leader Gurnam Singh Charuni, who was suspended by the Morcha, is busy posing as a political leader. Another leader Yogendra Yadav, who had gone to Lakhimpur Kheri was suspended by the Morcha. Hannan Mollah is staying in his residence, while other leaders like Shivkumar Kakkaji, Darshan Pal Singh, Joginder Singh Ugrahan, Balbir Singh Rajewal and Yudhvir Singh have vanished from public view. And yet, Rakesh Tikait is threatening that farmers will enter Delhi and sell paddy outside Parliament.

People have started realizing that this agitation is not aimed at betterment of farmers, but for the sole purpose of removal of BJP from power. That is why people have stopped supporting this agitation. This, in a nutshell, is the reason why the farmers’ agitation has now become weak.

बॉलीवुड के सुपरस्टार शाहरुख खान ने आखिरकार गुरुवार को उस समय राहत की सांस ली जब बॉम्बे हाईकोर्ट ने क्रूज शिप ड्रग्स मामले में उनके 23 साल के बेटे आर्यन को जमानत दे दी। हाईकोर्ट में तीन दिनों तक चली मैराथन सुनवाई के बाद आर्यन के साथ उसके दो दोस्तों मुनमुन धमेचा और अरबाज मर्चेंट को भी जमानत मिली है। नारकोटिक्स कंट्रोल ब्यूरो द्वारा क्रूज शिप पर रेव पार्टी के दौरान मारे गए छापे के बाद पिछले 25 दिनों से ज्यादा वक्त से ये तीनों हिरासत में थे।

उधर फैसला आने के बाद मुंबई में शाहरुख के बंगले ‘मन्नत’ के बाहर बहुत दिनों के बाद रौनक दिखी। फैन्स ने बंगले के बाहर पटाखे फोड़े और नाच गाकर खुशी का इजहार किया। ‘मन्नत’ के बाहर वेलकम होम, प्रिंस के पोस्टर लगाए गए। वहीं सतीश मानशिंदे की अगुवाई वाली लीगल टीम ने शाहरुख खान और उनकी पत्नी गौरी खान से मुलाकात की और अदालती कार्यवाही के बारे में जानकारी दी। तीनों की जमानत की शर्तों के रूप में हाईकोर्ट की तरफ से विस्तृत दिशा-निर्देश जारी करने की उम्मीद की जा रही है। अदालत का विस्तृत आदेश मिलने के बाद ही जेल अधिकारी तीनों को रिहा करेंगे।

गुरुवार रात मेरे प्राइम टाइम शो ‘आज की बात’ में आर्यन खान की ओर से कोर्ट में पेश हुए पूर्व अटॉर्नी जनरल मुकुल रोहतगी ने बताया कि कैसे जस्टिस नितिन सांबरे की सिंगल जज बेंच ने जमानत देने का फैसला किया।

रोहतगी ने कहा-आर्यन खान की गिरफ्तारी ‘नाजायज’ थी क्योंकि पहली बात ये कि उसके पास से कोई ड्रग बरामद नहीं हुआ और न ही ड्रग्स का सेवन करने के बाद वह क्रूज पर सवार हुआ था। दूसरी बात ये कि अरेस्ट मेमो में इस बात का कोई जिक्र नहीं था कि क्रूज पर मौजूद वे लोग जो ड्रग्स के साथ पकड़े गए, उनके साथ आर्यन किसी तरह की साजिश में शामिल था।

एनसीबी के इस तर्क पर कि आर्यन एक अंतरराष्ट्रीय साजिश का हिस्सा था, मुकुल रोहतगी ने मुझे बताया-‘यह तर्क कमजोर था, मुकुल रोहतगी ने कहा कि अगर वॉलेंट्री स्टेटमेंट (स्वैच्छिक बयान) बोल के कोई बयान लिया जाता है तो वह ऐसे केस में हमेशा इनवॉलेंट्री ( अनैच्छिक) होता है, लेकिन बोला वॉलेंट्री जाता है। सुप्रीम कोर्ट का फैसला है कि एनसीबी के अफसर के सामने अगर कोई भी स्टेटमेंट लिखी जाए तो चाहे वॉलेंट्री भी हो तो वह कानून में पढ़ी नहीं जा सकती और अस्वीकार्य है। आर्यन से लिए गए बयान में उन्होंने लिखवाया कि हां मैं रेग्यूलर तौर पर ड्रग्स लेता हूं। मुकुल रोहतगी ने कहा कि एनसीबी ने कोई ऐसा सबूत नहीं दिया कि आर्यन आदतन नशे का आदी था।’

रोहतगी ने कहा कि आर्यन और उसके दोस्तों के बीच व्हाट्सएप चैट की कोई कॉपी लीगल टीम को नहीं दी गई थी और इनमें से कुछ चैट जानबूझकर ‘लीक’ की गई थीं। उन्होंने कहा, यह एनसीबी की ओर से प्राइवेसी का उल्लंघन है। इसके अलावा कोई भी चैट क्रूज रेव पार्टी से या उस दिन ड्रग्स के इस्तेमाल से जुड़ा हुआ नहीं है।

रोहतगी ने कहा, ‘आम तौर पर 20-22 साल की उम्र के युवा कॉलेजों में हंसी-मजाक के लिए इस तरह के व्हाट्सएप चैट का इस्तेमाल करते हैं। दिल्ली यूनिवर्सिटी में हमारे दिनों में, छात्र व्हिस्की और सिगरेट पीते थे और आजकल लोग ड्रग्स लेने की कोशिश करते हैं, लेकिन क्या इसका मतलब यह है कि वे सभी ड्रग पेडलर हैं? क्या हम विश्वास कर सकते हैं कि एक अमीर आदमी का बेटा (शाहरुख की तरह) 10 से 20 हजार रुपये कमाने के लिए ड्रग पेडलिंग का सहारा लेगा? रोहतगी ने कहा कि एनसीबी का आरोप निराधार था और वे उन चैट का इस्तेमाल कर डरा रहे थे। व्हाट्सएप चैट पर बातचीत केवल आपसी मजाक के लिए थी।

एनसीबी के इस आरोप पर कि आर्यन एक अंतरराष्ट्रीय ड्रग माफिया का हिस्सा था, रोहतगी ने कहा, ‘हम मान भी लें कि वह ड्रग माफिया का हिस्सा था, तो उसका एकमात्र उद्देश्य इससे बड़ी कमाई करना होगा। लेकिन इस तरह के बिजनेस से पैसे कमाने का कोई मुद्दा नहीं उठता। क्या एक अमीर परिवार से आनेवाले शख्स को इस तरह से पैसे कमाने की जरूरत थी? हां, ड्ग्स लेने की बात हो सकती है। कोई इस पर बहस कर सकता है। लेकिन इस केस में ड्रग्स सेवन करने और किसी तरह के लेनदेन का कोई सबूत नहीं है।

रोहतगी ने कहा-‘यह साबित करने के लिए कोई सबूत नहीं था कि आर्यन को इस बात की जानकारी थी कि अरबाज ने अपने जूते में 6 ग्राम ड्रग रखी थी। इस तरह के एक्ट में 6 ग्राम को बहुत कम मात्रा मना जाता है और इन मामलों में हमेशा जमानत दी जाती है, क्योंकि इसमें अधिकतम सजा केवल जुर्माना है। जिस अपराध में केवल जुर्माने का प्रावधान है और उसके लिए आप किसी शख्स को जेल में कैसे डाल सकते हैं?

उन्होंने कहा, ‘जहां तक एनसीबी डायरेक्टर और एनसीपी नेता के बीच चल रहे राजनीतिक विवाद की बात है तो यह उनका निजी मामला है और इसका इस मामले से कोई लेना-देना नहीं है। हमने अपने लिखित निवेदन में भी यही बात कही है। हम इस मामले में न तो किसी एनसीबी अधिकारी को दोष दे रहे हैं और न ही चुनौती दे रहे हैं। हमने किसी भी पक्ष को उकसाया नहीं है और अब वह मामला हाईकोर्ट में चला गया है और वानखेड़े ने अपनी याचिका दाखिल की है। यह पूरी तरह से अलग मामला है और इससे हमारा कोई लेना-देना नहीं है। हमारा मामला फुल प्रूफ था।’

पूर्व अटॉर्नी जनरल ने कहा, ‘यह महज संयोग है कि नवाब मलिक के दामाद को एनसीबी के डायरेक्टर समीर वानखेड़े ने ड्रग मामले में गिरफ्तार किया था और छह महीने बाद जमानत मिल गई थी। यह एक संयोग था…. जहां तक आर्यन केस में मीडिया पब्लिसिटी का सवाल है, तो इससे कुछ समस्याएं पैदा हुई हैं, अन्यथा आम तौर पर ऐसे सामान्य मामलों में तुरंत जमानत दे दी जाती है। भारत में इस तरह के सामान्य मामलों की कभी चर्चा नहीं होती, लेकिन यह एक हाई प्रोफाइल मामला था।’

मुकुल रोहतगी ने कहा, ‘जब शाहरुख को यह बताया गया कि उनके बेटे को जमानत मिल गई है, तो उनकी आंखों में आंसू आ गए। वो अपने बेटे को लेकर बेहद चिंतित थे। इस केस को लेकर पिछले तीन से चार दिनों में उन्होंने कई घंटे मेरे साथ बिताए। वो खुद नोट्स लाते थे, खुद टाइप करते थे और अपने बेटे के बैकग्राउंड और अन्य चीजों के बारे में बताते थे। जाहिर है जब 22 साल का बेटा जेल चला जाए तो मां-बाप परेशान हो जाते हैं। हाईकोर्ट से जमानत मिलने के बाद जब मैं उनसे मिला तो उनकी आंखों में खुशी के आंसू थे। वह काफी राहत महसूस कर रहे थे।’

हाईकोर्ट के इस आदेश जो दूसरे व्यक्ति खुश दिखे वो हैं एनसीपी नेता और महाराष्ट्र सरकार में मंत्री नवाब मलिक। उन्होंने कहा कि उनके पास और भी ज्यादा सबूत हैं, अगर उसे कोर्ट में रख दिया जाए तो उसके आधार पर यह पूरा केस खत्म हो जाएगा। उधर, समीर वानखेड़े ने अपनी गिरफ्तारी के डर से हाईकोर्ट में याचिका दाखिल की थी और इस पर सुनवाई के दौरान राज्य सरकार ने हाईकोर्ट से कहा है कि वह कोई भी एक्शन लेते समय वानखेड़े को तीन दिन पहले नोटिस देगी। नवाब मलिक ने व्यंग्यात्मक लहजे में कहा- ‘पिक्चर अभी बाकी है मेरे दोस्त, जो आदमी बेगुनाहों को सलाखों के पीछे भेजने की होड़ में शामिल था, खुद जेल जाने से डर रहा है।’

आर्यन खान केस में मैंने कुछ दिन पहले ‘आज की बात’ में कहा था कि ऐसा लग रहा है जैसे यह पूरा मामला अनुमान और कल्पना पर आधारित है। आर्यन के पास ड्रग नहीं मिली लेकिन NCB ने आर्यन को ड्रग एडिक्ट बता दिया। आर्यन खान उस पार्टी में गेस्ट के तौर पर गया था और वो सिर्फ अरबाज को जानता था लेकिन NCB ने आर्यन को ड्रग्स पार्टी का सबसे बड़ा मोहरा मान लिया। उसे रेव पार्टी के किंगपिन के तौर पर पेश किया गया।

तीन साल पुरानी व्हाटसैप चैट में आए दो शब्दों के आधार पर NCB ने आर्यन को इंटरनेशनल ड्रग रैकेट का हिस्सा मान लिया। अरबाज के पास से केवल 6 ग्राम ड्रग्स मिली और इस छह ग्राम चरस से क्रूज पर पार्टी होने वाली थी। इस छह ग्राम चरस के आधार पर ड्रग्स की सप्लाई का भी एंगल भी आ गया। इतना ही नहीं इस छह ग्राम चरस के चक्कर में इंटरनेशनल ड्रग्स का धंधा करने की भी धाराएं जुड़ गईं। ये सारी चीजें किसी नॉवेल की कहानी जैसी लग रही थी। लेकिन हैरानी की बात ये है कि NCB इसके आधार पर ही केस लड़ रही थी। इन्हीं धाराओं के आधार पर NCB आर्यन और उसके दोस्तों को 26 दिन तक जेल में रखने में कामयाब हो गई और आगे भी रखना चाहती थी।

चूंकि NCB का केस इतना कमजोर और मनगढ़ंत लग रहा था इसीलिए देश के लाखों लोगों की सहानुभूति आर्यन खान के साथ जुड़ गई। इसके बाद इस केस में जिस तरह की बयानबाजी हुई, जिस तरह के इल्जाम लगे और जिस तरह की सियासत हुई उससे यह मामला और ज्यादा संदेहास्पद लगने लगा। इसीलिए जब आर्यन और उसके दोनों दोस्तों को जमानत देने का हाईकोर्ट का फैसला आया तो सबसे पहला रिएक्शन नवाब मलिक का आया। नवाब मलिक का कहना है कि आर्यन खान और उसके दोस्तों को जेल में डालने वाला आज खुद जेल जाने से डर रहा है। नवाब मलिक ने कहा कि समीर वानखेड़े चाहते थे कि उनकी जांच CBI या NIA जैसी एजेंसी करें लेकिन कोर्ट ने इसे नहीं माना। नवाब मलिक ने कहा कि समीर वानखेड़े ने जो फर्जीवाड़ा किया है वो सामने आने लगा है इसलिए अब उन्हें जेल जाने का डर सता रहा है। उधर, पहले ही मुंबई पुलिस ने एक एसआईटी का गठन कर एनसीबी के जोनल डायरेक्टर वानखेड़े के खिलाफ लगे आरोपों की जांच शुरू कर दी है। वहीं वानखेड़े का कहना है कि उन्हें परेशान करने के लिए एसआईटी का गठन किया गया है।

यह दुखद है कि एक तरफ भारतीय राजस्व सेवा के वरिष्ठ अधिकारी समीर वानखेड़े कह रहे हैं कि उन्हें मुंबई पुलिस पर भरोसा नहीं है, वहीं दूसरी तरफ नवाब मलिक जैसे महाराष्ट्र के वरिष्ठ राजनेता कह रहे हैं कि उन्हें केंद्रीय एजेंसियों पर भरोसा नहीं है। एनसीबी और मुंबई पुलिस दोनों एजेंसियों की अच्छी साख है। ये दोनों सीधे पब्लिक से डील करती हैं इसलिए इनकी निष्पक्षता बनी रहे और इस निष्पक्षता पर लोगों का भरोसा बना रहे, यह बहुत जरूरी है। लेकिन पिछले चार हफ्तों में जो हुआ उससे इन एजेंसियों की छवि खराब हुई है। ऐसा लग रहा है जैसे दोनों एजेंसियां राजनीति का हथियार बन गई हैं। यह मैसेज अच्छा नहीं हैं। इस दाग को जितानी जल्दी धोया जाए, उतना बेहतर होगा।

जहां तक आर्यन के केस का सवाल है तो मुझे लगता है कि शाहरुख खान कल रात चैन से सो पाए होंगे। दो नबंवर को शाहरूख का जन्मदिन है, चार नबंवर को दिवाली है और 13 नवंबर को आर्यन का बर्थ डे है। अब शाहरुख खान पूरे परिवार के साथ दिवाली भी मना पाएंगे और अपना और बेटे का बर्थ डे भी। शाहरुख और उनके परिवार को मेरी शुभकामनाएं।

Superstar Shahrukh Khan, at last, heaved a sigh of relief on Thursday after the Bombay High Court granted bail to his 23-year-old son Aryan and his two friends, Munmun Dhamecha and Arbaaz Merchant, after a three-day-long marathon hearing in the cruise drug seizure case. The three were in custody for more than 25 days since the Narcotics Control Bureau raided a rave party on a cruise on October 2 night.

Shahrukh’s fans, carrying posters ‘Welcome Home, Prince’ burst firecrackers outside his residence ‘Mannat’ in Mumbai on Thursday night as part of celebrations. The legal team led by Satish Maneshinde met Shahrukh and his wife Gauri Khan and briefed them about the court proceedings. The high court is expected to issue detailed guidelines as conditions for bail to all the three. Only after the detailed court order is received, jail authorities will release the three from prison.

In my prime time show ‘Aaj Ki Baat’ on Thursday night, former attorney general Mukul Rohatgi, who appeared for Aryan Khan, spoke about how the single judge bench of Justice Nitin Sambre, decided to grant bail.

Rohatgi said, the arrest of Aryan Khan was “illegal” because, one, he had neither any drug in his possession nor had he reached the cruise after consuming drugs, and two, the arrest memo made no reference to any alleged conspiracy between Aryan and others who were present on the cruise and were caught carrying drugs.

On the NCB’s argument that Aryan was part of an international conspiracy, Mukul Rohatgi told me that the argument was weak because so-called voluntary statements taken from accused are mostly ‘involuntary’, as per the Supreme Court ruling which says any ‘voluntary’ statement made before an NCB officer is inadmissible in law. The ‘voluntary’ statement that was taken from Aryan says that he had admitted he was a habitual consumer of drugs. No evidence was placed to show that Aryan was a habitual drug addict, he added.

Rohatgi said, no copy of WhatsApp chats between Aryan and his friends was given to the legal team, and some of these chats were deliberately ‘leaked’. This, he said, amounts to breach of privacy on part of NCB. Moreover, none of the chats was related to the cruise rave party nor to the use of drugs on that day.

Rohatgi told me, “normally youths in colleges in the age group of 20-22 years use WhatsApp chats for banter, jest and laughter. During my days in Delhi University, students used to try whisky and cigarettes, and nowadays they occasionally try drugs, but does it mean that they are all drug peddlers? Can we believe that the son of a rich man (like Shahrukh) will resort to drug peddling for making Rs 10-20,000? The NCB charge was baseless and they were creating a scare by using those chats. The conversations on WhatsApp chats were only meant for mutual banter”, Rohatgi said.

On the NCB charge that Aryan was part of an international drug mafia, Rohatgi replied, “Even if we assume that he was part of such a mafia, his sole interest would be to earn big money from business. Did he need big money, coming from a rich family? They can argue about drug consumption, but here not a single concrete drug transaction was shown as evidence.”

“There was no material evidence to prove that Aryan knew that Arbaaz had kept 6 gm of drug in his shoe. Six grams is considered a very small quantity under the Act, and bail is always granted in such cases, because the maximum punishment is only a fine. How can you put a person in jail for an offence that provides for fine only? “, Rohatgi said.

“As far as the political controversy going on between the NCB director and the NCP leader, this is their personal issue and has nothing to do with this case. We said so in our written submission that we are neither blaming, nor challenging any NCB officer in this case. We have not instigated either parties and now that case has gone to High Court with Wankhede filing his petition . That is a different case altogether and we have nothing to do with it. Our case was full proof”, Rohatgi said.

The former attorney general said, “It is a mere coincidence that Nawab Malik’s son-in-law was arrested by NCB director Sameer Wankhede in a drug case and the former got bail after six months. The coincidence was in the timing…. As far as the media publicity for Aryan case is concerned, it did cause some problems, otherwise normally bail is immediately granted in such ordinary cases. Such ordinary cases are never talked about in India, but this was a high profile case.”

Rohatgi said, “when Shahrukh was informed that bail has been granted to his son, he had tears in his eyes, because he was a worried father. For the last 3-4 days, he spent several hours with me on this case. He used to bring notes himself, type himself, about his son’s background and other details. Obviously, when a 22 year old son goes to jail, his parents get worried. After the high court’s bail announcement, when I met him, he had tears of joy in his eyes. He looked very much relieved.”

The other man who was happy with the High Court’s bail order was NCP Minister Nawab Malik. He said, he had more evidences with him, which, if produced, will bring a full stop to the entire case. Since Wankhede has filed a petition fearing his arrest, the state government told the High Court that it would give three days’ prior notice to him if any action was taken against him. Nawab Malik sarcastically remarked, “Picture abhi baaki hai mere dost. The man who was on a spree to send innocents behind bars, is scared of jail himself.”

In the Aryan Khan case, I had said several days ago in ‘Aaj Ki Baat’ that the entire case stood on the basis of mere assumptions and imaginations. No drug was found from Aryan, but NCB alleged he was a drug addict. Aryan only knew his friend Arbaaz and had gone to the party as a guest, but he was projected as a kingpin of the rave party.

On the basis of only two words in WhatsApp chats made three years ago, he was declared part of an international drug syndicate. Only 6 grams drugs were found from Arbaaz’s possession, and, on the basis of these 6 grams, the entire rave party was expected to be organized and drug peddling angle was introduced. On the basis of these 6 grams of drugs, sections of NDPS Act were added to the case to allege that an organized international drug peddling syndicate was active. The NCB managed to keep Aryan and his two friends behind bars for 26 days, and wanted more time for their custody.

Since the entire case prepared by NCB was weak and based on figments of imagination, the sympathy of millions of people lay with Aryan Khan. The manner in which charges were levelled against one another, with politics entering the slugfest, the entire matter looked not only suspicious, but ludicrous. When the High Court granted bail to Aryan and his two friends, the first to react was NCP Minister Nawab Malik, who sounded ominous and hinted at the NCB director’s arrest. He said, Wankhede wanted his case to be probed either by CBI or NIA, but this was rejected by the high court. “He is now fearing his imminent arret”, Malik said. Already, a special investigation team (SIT) is probing charges against Wankhede, and the NCB director has said that the SIT has been constituted in order to harass him.

It is sad to note that on one hand, a senior Indian Revenue Service officer like Sameer Wankhede is saying he cannot trust Mumbai Police, while on the other hand, a senior Maharashtra political leader like Nawab Malik is saying he does not trust central agencies. Both NCB and Mumbai Police are investigating agencies, having good reputation, and since they deal with public, it is necessary that there must be no erosion of people’s trust in both these agencies. But judging by whatever happened in the last four weeks, the reputation of both these agencies stands tarnished. It appears as if both the agencies have become political tools. This is not a good message that is being conveyed to the public at large. The sooner these stains are removed, the better.

For Shahrukh Khan, he will surely have a good sleep at night. His birthday falls on November 2, Diwali will be celebrated two days later, and on November 13, 23-year-old Aryan will be celebrating his birthday. My best wishes to Shahrukh and his family. Let them celebrate the festivities in peace.

बॉम्बे हाईकोर्ट में आर्यन खान की जमानत याचिका पर चल रही मैराथन सुनवाई का आज तीसरा दिन है। एक बात तो बिल्कुल साफ है; सवाल यह नहीं कि उन्हें जमानत मिली या नहीं, या उन्हें जमानत मिलनी चाहिए या नहीं। यह एक कानूनी मसला है और अदालत में सबूतों और दलीलों के आधार पर फैसला होगा। लेकिन यह सवाल जरूर है कि क्या इस केस में आर्यन को सिर्फ इसलिए जेल की हवा खानी पड़ रही है क्योंकि वो सुपरस्टार शाहरूख खान के बेटे हैं?

इस पूरे मामले में यह सवाल भी उठ रहा है कि क्या आर्यन के बहाने तमाम तरह के पुराने हिसाब-किताब बराबर किए जा रहे हैं। क्या इस केस में महाराष्ट्र के नेता और केन्द्र सरकार के अफसर पार्टी बन गए हैं। इस केस में एनसीपी और बीजेपी आमने-सामने है और दोनों के बीच आर्यन खान और उसके दोस्त पिस रहे हैं। ऐसे में ये सवाल बेहद प्रासंगिक हैं और इनके जवाब मिलने चाहिए।

नारकोटिक्स कंट्रोल ब्यूरो (एनसीबी) के जोनल डायरेक्टर समीर वानखेड़े ड्रग्स मामले की जांच कर रहे थे, लेकिन अब एनसीबी दिल्ली के वरिष्ठ अधिकारियों की एक टीम वानखेड़े के खिलाफ लगाए गए आरोपों की जांच कर रही है। आर्यन खान के वकील अदालत में आर्यन की बेगुनाही के सबूत दे रहे हैं। वे कह रहे हैं की छापे के दौरान आर्यन के पास से कोई ड्रग्स बरामद नहीं हुआ। एनसीबी की तरफ से सबूत के तौर पर तीन साल पुराने व्हाट्सएप चैट पेश किए जा रहे हैं। वहीं दूसरी ओर समीर वानखेड़े अपने सीनियर्स के सामने अपने ऊपर लगे आरोपों को झूठा साबित करने की कोशिश कर रहे हैं क्योंकि समीर के खिलाफ प्रोफेशनल और पर्सनल दोनों तरह के इल्जाम हैं। आर्यन के वकील पूर्व अटॉर्नी जनरल मुकुल रोहतगी ने अदालत से एनसीबी के अरेस्ट मेमो को देखने की गुजारिश की और यह साबित करने की कोशिश की कि जिस वक्त आर्यन खान को गिरफ्तार किया गया था उस वक्त उनके खिलाफ अंतरराष्ट्रीय ड्रग माफिया की साजिश का आरोप नहीं लगाया गया था। उन्होंने अदालत को बताया कि इस आरोप को बाद में जोड़ा गया। मुकुल रोहतगी ने कहा कि आर्यन खान को गलत तरीके से गिरफ्तार किया गया।

आर्यन और उसके दो दोस्तों अरबाज मर्चेंट और मुनमुन धमेचा को तीन अक्टूबर को गिरफ्तार किया गया था। ये लोग पहले ही 25 दिन हिरासत में बिता चुके हैं। दरअसल यह सुप्रीम कोर्ट के उस प्रसिद्ध फैसले के खिलाफ है जिसमें कहा गया-‘जमानत नियम होना चाहिए और गिरफ्तारी अपवाद होनी चाहिए’। वकील अमित देसाई ने हाईकोर्ट में सही कहा कि अब सब उल्टा हो गया है। जेल नियम और जमानत अपवाद हो गई है। NCB ने खुद माना कि आर्यन के पास से ड्रग्स बरामद नहीं हुई। तो सवाल यह है कि आर्यन का गुनाह क्या है? एनसीबी का इल्जाम कि आर्यन खान इंटरनेशनल ड्रग्स रैकेट का हिस्सा हैं, लेकिन इस तर्क की पुष्टि के लिए उसके पास कोई सबूत नहीं है।

तीन साल पुरानी व्हाट्सएप चैट दिखाई जा रही है और अब इन्हें वैरीफाई करना है। एनसीबी का तर्क है कि चूंकि आर्यन एक प्रभावशाली परिवार से ताल्लुक रखता है इसलिए उसे जेल में रखना जरूरी है ताकि वो सबूतों के छेड़छाड़ न कर दे, गवाहों को प्रभावित न कर दे। लेकिन इस केस में गवाह कौन हैं? एक गवाह जो फरार हो गया था उसे आज सुबह गिरफ्तार किया गया और दूसरे गवाह ने आरोप लगाया कि मामले की जांच कर रहे एनसीबी के कुछ अधिकारियों ने रिश्वत मांगी थी।

आर्यन केस में गवाह नंबर वन, प्रभाकर सैल ने खुद अपना वीडियो जारी करके और एफिडेविट देकर कहा कि शाहरूख खान से 25 करोड़ में डील होनी थी लेकिन अधिकारियों को पैसा नहीं मिला इसलिए आर्यन को लपेटा गया और उसे जेल भेज दिया गया। प्रभाकर सैल इस मामले में दूसरे गवाह किरण गोसावी का बॉडीगार्ड है। आर्यन की गिरफ्तारी के सारे वीडियो में किरण गोसावी दिख रहा है। प्रभाकर का दावा है कि आर्यन को लेकर सारी डीलिंग किरण गोसावी कर रहा था। मामला उजागर होते ही किरण गोसावी फरार हो गया लेकिन आज सुबह उसे पुणे पुलिस ने गिरफ्तार कर लिया है। प्रभाकर का दावा है कि आर्यन को छोड़ने के एवज में शाहरूख खान से 25 करोड़ मांगे जाने थे। यह डील 18 करोड़ में होनी थी और उसमें से 8 करोड़ समीर वानखेड़े को पहुंचाने थे। लेकिन शाहरूख की मैनेजर ने फोन उठाना बंद कर दिया इसलिए बात बिगड़ गई।

प्रभाकर के आरोपों की जांच एनसीबी कर रही है लेकिन प्रभाकर के बाद महाराष्ट्र सरकार के मंत्री और एनसीपी नेता नवाब मलिक ने तो समीर वानखेड़े के खिलाफ इतने इल्जाम लगा दिए कि तुरंत जांच होना संभव भी नहीं है। नवाब मलिक रोजाना समीर वानखेड़े पर आरोप लगा रहे हैं। फिलहाल नवाब मलिक ये साबित करने में लगे हैं कि समीर वानखेड़े मुस्लिम हैं। उन्होंने आरक्षण का फायदा उठाने के लिए फर्जी जाति प्रमाणपत्र बनवाया और उसी के आधार पर सिविल सर्विसेज की परीक्षा पास की।

अपने इल्जाम को साबित करने के लिए पहले नवाब मलिक ने समीर वानखेड़े का बर्थ सर्टिफिकेट सार्वजनिक किया था और फिर बाद में नवाब मलिक ने समीर वानखेड़े की पहली शादी का निकाहनामा पेश कर दिया। इसमें समीर वानखेड़े का नाम समीर दाऊद वानखेड़े लिखा है। इसके साथ ही वह ‘काजी’ भी सामने आया जिसने समीर का उनकी पहली पत्नी के साथ निकाह कराने का दावा किया। एनसीपी नेता नबाव मलिक ने दावा किया कि समीर वानखेड़े के खिलाफ उनके पास इतने सबूत हैं कि अगले छह महीने में उनकी नौकरी से छुट्टी हो जाएगी।

इंडिया टीवी के रिपोर्टर ने समीर के पिता ज्ञानदेव वानखेड़े से मुलाकात की। उन्होंने यह माना कि निकाहनामा सही है। निकाहनामे पर साइन भी उन्हीं के हैं लेकिन लेकिन वे यह नहीं बता सके कि उस पर समीर दाऊद वानखेड़े क्यों लिखा गया था। इंडिया टीवी के रिपोर्टर ने उस काजी को भी ढूंढ निकाला जिसके दस्तखत निकाहनामे पर हैं। उसने कहा कि निकाहनामा असली है। लड़का-लड़की दोनों मुसलमान थे। समीर के पिता का नाम दाऊद है। उनका पूरा परिवार मुसलमान था इसीलिए उन्होंने निकाह पढ़वाया था। अगर लड़के का परिवार हिन्दू होता तो शरिया में निकाह की इजाजत ही नहीं है। वे ऐसी शादी नहीं कराते।

ये अच्छी बात है कि समीर वानखेड़े के खिलाफ जो इल्जाम लगे हैं, एनसीबी ने बिना देर किए उनकी जांच शुरू कर दी है। महाराष्ट्र सरकार के मंत्री नवाब मलिक ने जो आऱोप लगाए वो गंभीर हैं। मलिक का आरोप है कि समीर वानखेड़े शादी करने के लिए मुसलमान बन गए औऱ सरकारी नौकरी पाने के लिए दलित होने का फजी सर्टिफिकेट बनवाया।

इतना ही नहीं नवाब मलिक ने जो चिट्ठी जारी की उसमें तो कहा गया कि समीर वानखेड़े जिनको पकड़ते हैं उनके घरों में नारकोटिक्स प्लांट करके रिकवरी दिखाते हैं फिर केस बंद करने के लिए करोड़ों रुपए मांगते हैं। इस केस में जिन लोगों को वानखेड़े ने गवाह बनाया उनके कनेक्शन बीजेपी से निकले इसीलिए ये मामला अब पूरी तरह सियासी हो गया।

अब यह मामला महाराष्ट्र की राज्य सरकार औऱ केंद्र सरकार के नेताओं के बीच टकराव का मामला बन गया है।आर्यन और उसके दोस्त क्रॉस फायर में फंस गए हैं। ऐसा लग रहा है जैसे नवाब मलिक ड्रग्स केस में अपने दामाद को गिरफ्तार करने वाले समीर वानखेड़े के पीछे पड़ गए हैं। नवाब मलिक आश्वस्त हैं कि वानखेड़े ने उनके दामाद को झूठे केस में फंसाया इसलिए अब वे किसी तरह से समीर वानखेड़े को जेल भेजना चाहते हैं। वहीं दूसरी ओर बीजेपी के नेता समीर वानखेड़े को बचाने में जुट गए हैं। ऐसा लग रहा है जैसे बीजेपी समीर वानखेड़े के साथ सिर्फ इसलिए खड़ी है क्योंकि महाराष्ट्र सरकार के एक बड़े मंत्री समीर वानखेड़े के खिलाफ हैं।

महाराष्ट्र में पिछले साल भर में ये तीसरा मौका है कि जो केस जांच एजेंसियों का विषय होना चाहिए था वो राजनैतिक दलों के बीच लड़ा जा रहा है। एक अफसर राज्य सरकार की प्रोटेक्शन लेता है तो दूसरा केंद्र सरकार की।

मुझे लगता है कि कानूनी मामलों में, क्रिमिनल केसेज में जब सियासत घुसती है तो फिर उसका खामियाजा सबको भुगतना पड़ता है। जांच एजेंसियों की छवि खराब होती है। न्यायपालिका पर कीचड़ उछलता है और न्याय मिलने में देर होती है।

शाहरूख के बेटे आर्यन के साथ यही हो रहा है इसीलिए उसके वकील अदालत में बार-बार कह रहे हैं कि उन्हें सियासी बयानों से कोई मतलब नहीं है। एनसीबी के जोनल डायरेक्टर समीर वानखेड़े पर लगे इल्जामात से उनका कोई लेना-देना नहीं है। वो तो क्रॉस फायर में फंस गए हैं। आर्य़न के वकील कहते हैं कि उनका केस अगर मैरिट के आधार पर सुना जाता तो अब तक आर्य़न को बेल मिल चुकी होती।

As the marathon hearing on Aryan Khan’s bail petition in Bombay High Court entered its third day today, one thing has become clear: it is no more a question of whether he gets bail or not, or, whether he should get bail or not. It is a legal question and the court will decide on the basis of evidences and arguments. The cold fact is that Aryan is spending time in jail only because he is superstar Shahrukh Khan’s son.

Questions are being raised whether in Aryan’s name, old scores are being settled. Maharashtra’s political leaders and officers of union government are now at opposite ends of the spectrum . BJP and NCP, too, are at loggerheads, and, in the meanwhile, Aryan and his friends are bearing the brunt of crossfire. These questions are relevant and need answers.

Narcotics Control Bureau zonal director Sameer Wankhede was probing the drugs case, but now, a team of top NCB officials from Delhi are now probing charges levelled against Wankhede. Aryan’s lawyers are telling the court that no drugs were seized from him during the raid, and three year old WhatsApp chats are being produced as evidence. At the other end, Sameer Wankhede is trying to prove his innocence before his seniors, because several charges relating to his professional and personal conduct have been raised. Aryan’s lawyer former Attorney General Mukul Rohtagi urged the high court to go through the NCB arrest memo. He was trying to prove that at the time of his arrest, no charge of international drug mafia conspiracy was levelled against him. These charges were added later, he told the court.

Aryan and his two friends, Arbaaz Merchant and Munmun Dhamecha were arrested on October 3. They have already spent 25 days in custody. This flies in the face of Supreme Court’s famous ruling that ‘bail should be the rule and arrest should be an exception’. Lawyer Amit Desai told the high court in so many words and said, it now appears as if arrest has become the rule, and bail has become an exception. NCB has admitted that no drug was found from Aryan’s possession. Then the question arises, what was Aryan’s crime? There are no evidences to substantiate NCB’s arguments that Aryan was part of an international drug syndicate.

Three year old WhatsApp chats are being shown, and these chats need to be verified. NCB’s argument is that Aryan belongs to a powerful family and he may tamper with evidence and put pressure on witnesses. Who are the witnesses? One had absconded and was arrested this morning and the other has alleged that some NCB officials probing the case asked for bribe.

Prabhakar Sail, eyewitness number 1 in Aryan’s case, has alleged on video and affidavit, that a Rs 25 crore deal with Shahrukh Khan was being planned, but since officials did not get the money, Aryan was jailed. Kiran Gosavi, who Prabhakar Sail alleges was the middleman, was seen sitting in all the videos, but went underground. He was arrested by Pune police this morning. Prabhakar’s allegation is that Rs 25 crore was struck, but later the deal was settled for Rs 18 crore, out of which Rs 8 crore was to be given to NCB director Sameer Wankhede. Prabhakar says, Shahrukh’s personal manager stopped taking phone calls and the deal was called off.

While NCB is probing Prabhakar’s allegations, Maharashtra minister and senior NCP leader Nawab Malik continues to fire fresh salvos daily against Wankhede, alleging that he and his parents were Muslims, and he changed his name to get a false caste certificate, in order to avail reservation for passing UPSC exam.

Nawab Malik has produced his original birth certificate showing his name as Sameer Dawood Wankhede, his ‘nikahnama’ (marriage certificate) and also produced the ‘kaazi’ who carried out the Muslim marriage rites with his first wife. Nawab Malik claims that he has so many evidences that Sameer Wankhede is bound to lose his job within the next six months.

India TV reporter met Sameer’s father Gyandev Wankhede, who admitted that the nikahnama was original, but he could not explain why the name Sameer Dawood Wankhede was written on it. India TV reporter met the kaazi, who admitted that both the groom and bride were Muslims, Sameer’s father’s name is Dawood and the family was Muslim. He said, had the groom’s family been Hindu, he would not have allowed the Islamic marriage.

The NCB, by launching a probe into Nawab Malik’s allegations against Sameer Wankhede, has done the right thing. The allegations are serious. Malik is suggesting that Sameer became a Muslim for marriage, but became a Dalit for getting a caste certificate to apply for government job.

Nawab Malik has gone to the extent of producing a letter from an unknown complainant who has alleged that Sameer Wankhede had been extorting money from people by planting drugs in the houses that are raided. The persons whom Sameer Wankhede has made witnesses, have connections with the BJP.

Now that the matter has turned political, it is being projected as a state versus Centre issue. Aryan and his friends have been caught in the political crossfire. Nawab Malik is out to avenge the arrest of his son-in-law in a drug case by Sameer Wankhede. On the other hand, state BJP leaders are trying to protect Wankhede, only because he has become the target of an NCP leader.

This is the third instance in the last one year when a matter that requires to be probed by investigation agencies are being probed by political parties. While one officer takes protection from the state government, another officer is trying to take support from the Centre.

My personal view is that, once politics enters the domain of civil and criminal cases, everybody has to bear the consequences. The image of investigation agencies takes a beating, while fingers are pointed even against the judiciary. The end result: it takes a long time for dispensing justice.

This is what happened to Shahrukh’s son Aryan. That is why his lawyer is saying ad nauseum in courts that he has nothing to do with political comments, nor has he anything to do with charges that are being levelled at NCB director Wankhede. Aryan has been caught between the crossfire. Aryan’s lawyers say that he would have got bail by now, had the case been heard purely on merit and not got entangled in political skirmishes.

मुंबई की NDPS कोर्ट ने बुधवार को एक चौंकाने वाला फैसला दिया। NDPS कोर्ट के जज वी.वी.पाटिल ने 13 दिन से मुंबई की ऑर्थर रोड जेल में बंद शाहरूख खान के बेटे आर्यन खान की जमानत याचिका नामंजूर कर दी। जज ने 5 दिन पहले सुनवाई के बाद आर्यन की जमानत याचिका पर अपना आदेश सुरक्षित रख लिया था और बुधवार को इस पर अपना आदेश सुनाया। कोर्ट ने आर्यन खान और उनके 2 दोस्तों, मुनमुन धमेचा और अरबाज मर्चेंट की जमानत याचिका खारिज करते हुए अपना फैसला सुना दिया।

अपने विस्तृत आदेश में जज ने उन कारणों का खुलासा किया जिसके चलते उन्होंने इन सभी लोगों की जमानत याचिकाएं खारिज की। हालांकि सच्चाई ये है कि आर्यन खान के पास न तो ड्रग्स बरामद हुई, न ही पैसा बरामद हुआ। आर्यन खान ने ड्रग्स खरीदी, इसका कोई सबूत नहीं है। आर्यन ने ड्रग्स की सप्लाई की, इसका कोई जिक्र न तो NCB की रिपोर्ट में है और न ही वकीलों की दलीलों में इसका कोई उल्लेख है। अब सवाल उठता है कि इसके बाद भी आर्यन खान को जमानत क्यों नहीं मिली? उनके वकील अमित देसाई और सतीश मानशिंदे को पूरी उम्मीद थी कि आर्यन खान को जमानत मिल जाएगी। उन्हें अपनी दलीलों पर पूरा भरोसा था। लेकिन अदालत ने इनकी दलीलों को खारिज करते हुए आर्यन की जमानत याचिका नामंजूर कर दी।

आर्यन खान पिछले 17 दिनों से कानून के शिकंजे में हैं। वह पहले NCB की हिरासत में रहे और फिर 8 अक्टूबर से न्यायिक हिरासत में मुंबई की आर्थर रोड जेल में हैं। जब मैंने सेशन कोर्ट के विस्तृत आदेश को पढ़ा तो हैरान रह गया। ऐसा लगा जैसे किसी इंटरनेशनल ड्रग्स माफिया के खिलाफ लगे आरोप पढ़ रहा हूं। NCB की जिन दलीलों और आरोपों के आधार पर अदालत ने आर्यन की जमानत याचिका खारिज की है, उन्हें देखकर ऐसा लगता है जैसे NCB ने किसी आदतन ड्रग एडिक्ट, ड्रग विक्रेता और इंटरनेशल ड्रग रैकेट चलाने वाले अपराधी का कच्चा चिट्ठा उजागर किया हो।

सबसे ज्यादा चौंकाने वाली बात यह है कि NCB ने अपनी दलीलों में कहीं भी यह नहीं कहा है कि आर्यन खान के पास से ड्रग्स बरामद की गई थी। NCB ने ये भी माना है कि आर्यन ड्रग्स लेकर आए थे या ड्रग्स खरीदने जा रहे थे, इसके भी कोई सबूत नहीं हैं। अब सवाल ये है कि फिर आर्यन के खिलाफ इंटरनेशनल ड्रग रैकेट का हिस्सा होने का इल्जाम किस आधार पर लगा?

अपने जवाब में NCB ने आर्यन की अपने दोस्तों के साथ फोन पर हुई व्हाट्सऐप चैट का जिक्र किया। इस चैट में ‘हार्ड ड्रग्स’ और ‘बल्क क्वॉन्टिटी’ जैसे एक-दो शब्द ऐसे हैं जिनसे शक पैदा हो गया कि शाहरुख खान के 23 वर्षीय बेटे आर्यन एक अंतरराष्ट्रीय ड्रग रैकेट का हिस्सा हो सकते हैं। अदालत के आदेश में कहा गया है कि NCB के मुताबिक आर्यन खान के व्हाटसएप चैट में ‘हार्ड ड्रग’ और ‘बल्क क्वॉन्टिटी’ जैसे शब्द इस्तेमाल किए गए हैं। इन्हीं दोनों शब्दों की वजह से NCB ने आर्यन को इंटरनेशनल ड्रग रैकट का हिस्सा मान लिया। यही शब्द और NCB का यही दांव आर्यन खान की जमानत के आड़े आ गया और अदालत ने जमानत याचिका खारिज कर दी। हालांकि जिस दिन NCB ने आर्यन के खिलाफ दर्ज केस में NDPS एक्ट की दफा 29 जोड़ी थी उसी दिन ये अंदाजा हो गया था कि इसी आधार पर अब आर्यन की जमानत याचिक नामंजूर करने की अपील की जाएगी और हुआ भी यही।

NDPS कोर्ट ने अपने आदेश में कहा, ‘प्रथम दृष्टया कागजात दिखा रहे हैं कि खान प्रतिबंधित नशीले पदार्थों का कारोबार करने वाले व्यक्तियों के संपर्क में थे, जैसा कि अभियोजन पक्ष ने आरोप लगाया है।’ अदालत ने कहा, रिकॉर्ड से पता चलता है कि खान और मर्चेंट ने माना कि वे लंबे समय दोस्त हैं, पार्टी में साथ-साथ और एक साथ पकड़े गए। कोर्ट ने अपने 22 पृष्ठ के आदेश में कहा, ‘आर्यन खान एवं अरबाज मर्चेंट के स्वैच्छिक बयानों से पता चलता है कि उनके पास सेवन और मौज-मस्ती के लिए मादक पदार्थ थे। इसके अलावा, आर्यन खान की व्हाट्सएप चैट से प्रथम दृष्टया पता चलता है कि वह ‘नियमित आधार पर मादक पदार्थ संबंधी अवैध गतिविधियों में शामिल थे।’

अदालत ने कहा, ‘साजिश साबित करने के पहलू पर सिर्फ ट्रायल के दौरान विचार करने की जरूरत है, लेकिन प्रथम दृष्टया यह कॉन्सपिरेसी का केस लगता है।’ अदालत ने कहा कि NCB के एडिशनल सॉलिसिटर जनरल ने आर्यन खान के साथ विदेशी नागरिक और अज्ञात लोगों की व्हाट्सऐप चैट दिखाई, जो ड्रग्स में डील कर रहे थे, और इसे पढ़ने पर ‘बल्क क्वॉन्टिटी और हार्ड ड्रग्स’ के बारे में पता चला। हालांकि, आरोपी अरबाज मर्चेंट के वकील ने कहा कि आर्यन खान ने फुटबॉल मैचों के लिए ‘बल्क क्वॉन्टिटी’ शब्द का इस्तेमाल किया था, जबकि NCB ने इसे ड्रग्स के लेनदेन से जोड़ दिया।

आर्यन खान के वकीलों ने कोर्ट से कहा कि व्हाट्सऐप चैट को कोर्ट में बतौर सबूत पेश नहीं किया जा सकता है, क्योंकि उन्हें इंडियन एविडेंस ऐक्ट के तहत सबूत नहीं माना जाता है। ऐक्ट में स्पष्ट रूप से कहा गया है कि व्हाट्सएप चैट, धारा 65 बी के तहत प्रमाणीकरण के बिना, अदालत में सबूत के रूप में स्वीकार्य नहीं हैं। वकीलों ने कहा कि उन्हें विश्वसनीय सबूत नहीं माना जाता है। हालांकि, अदालत ने कहा कि भले ही कोई यह माने कि व्हाट्सऐप चैट कोर्ट में सबूत के रूप में स्वीकार्य नहीं है, कोई सर्टिफिकेट नहीं है, मामले की जांच जारी है इसलिए अभी सर्टिफिकेशन की जरूरत नहीं है।

अपने विस्तृत आदेश में जज ने कहा कि प्रत्येक आरोपी के मामले को एक दूसरे से अलग नहीं किया जा सकता है और अलग से नहीं देखा जा सकता। आदेश में कहा गया, ‘गंभीर अपराध में प्रथम दृष्टया संलिप्तता को देखते हुए, यह जमानत देने के लिए उपयुक्त मामला नहीं है।’

अपने आदेश में, जज ने अभियोजन पक्ष की इस दलील को भी माना कि हालांकि तीनों आरोपियों का कोई आपराधिक इतिहास नहीं है, लेकिन चूंकि आर्यन खान सहित सभी ‘प्रभावशाली’ हैं, इसलिए अगर उन्हें रिहा किया जाता है तो वह सबूतों के साथ छेड़छाड़ कर सकते हैं। जज ने कहा, NCB अब ‘अन्य ड्रग डीलरों की जांच कर रहा है जो एक अंतरराष्ट्रीय ड्रग नेटवर्क का हिस्सा प्रतीत होते हैं।’

कई सीनियर वकील आदेश में व्यक्त जज के विचारों से सहमत नहीं हैं। वकील माजिद मेमन का कहना है कि इस केस में ऐसा कोई आधार नहीं है जिसके ऊपर जमानत से इनकार किया जा सके। उन्होंने कहा कि आर्यन खान आदतन अपराधी नहीं हैं और न ही उनका कोई आपराधिक रिकॉर्ड है, इसलिए उन्हें जमानत पर रिहा किया जाना चाहिए था। सजा के तौर पर आरोपी को जेल में नहीं रखा जा सकता।

क्रिमिनल जस्टिस सिस्टम के मुताबिक, किसी आरोपी को एक सीमित उद्देश्य के साथ ही गिरफ्तार किया जा सकता है या हिरासत में रखा जा सकता है। आर्यन ने ऐसा कोई अपराध नहीं किया है जिसमें आजीवन कारावास या फांसी की सजा मिले। उनका कोई आपराधिक इतिहास नहीं है और न ही वह सबूतों के साथ छेड़छाड़ करने वाले हैं, इसलिए इस केस में ऐसा कुछ नहीं है जिसके आधार पर जमानत से इनकार किया जा सके।

साफ शब्दों में कहें तो आर्यन को सिर्फ इसलिए जमानत नहीं मिली क्योंकि वह एक सुपरस्टार के बेटे हैं। अदालत को लगा कि एक 23 साल का नौजवान ‘प्रभावशाली’ है, क्योंकि वह शाहरुख खान का बेटा है और वह गवाहों को प्रभावित कर सकता है। मुझे लगता है, यह कुछ हद तक उनके साथ अन्याय है। मशहूर शख्सियत का बेटा होना कोई गुनाह नहीं है। आर्यन पिछले 17 दिनों से हिरासत में हैं और NCB के पास यह पता लगाने के लिए पर्याप्त समय था कि उसका किसी अंतरराष्ट्रीय ड्रग नेटवर्क से कोई संबंध है या नहीं।

केवल व्हाट्सएप चैट के आधार पर किसी को अपराधी या अंतरराष्ट्रीय ड्रग माफिया का हिस्सा कहना एक ऐसा काम है जिसे उचित नहीं ठहराया जा सकता है। वैसे जब मैं अदालत का आदेश पढ़ रहा था तो ऐसा लगा जैसे किसी आरोप का कोई सबूत नहीं है, पूरा का पूरा केस सिर्फ कल्पना पर, शक और आशंका पर आधारित है। आर्यन के दोस्त अरबाज के पास 6 ग्राम चरस बरामद हुई है। NCB को लगता है कि ये चरस आर्यन खान के लिए थी।

NCB ने ये मान लिया कि कि आर्यन खान को अगर बेल दी गई तो वह जेल से बाहर जाकर फिर से ड्रग्स लेगा, फिर से ड्रग्स का रैकेट चलाएगा। जब पूछा गया कि ड्रग्स रैकेट की बात कहां से आई, तो NCB ने आर्यन और अरबाज की व्हाटसऐप चैट दिखा दी। ‘हार्ड ड्रग’ और ‘बल्क क्वॉन्टिटी’, इन दो शब्दों के सहारे NCB ने आर्यन को इंटरनेशनल ड्रग रैकेट का हिस्सा मान लिया।

अदालत ने अपने आदेश में कहा कि आर्यन उन इंटरनेशनल डीलर्स के नाम नहीं बता रहा है जिनके साथ उसका कॉन्टैक्ट है। आर्यन और अरबाज के वकील कह रहे हैं कि दोनों दोस्त आपस में फुटबॉल टूर्नामेंट की बात कर रहे थे। जब किसी से कॉन्टैक्ट ही नहीं है तो आर्यन और अरबाज कौन से डीलर का नाम बता दें?

कुल मिलाकर ऐसा लग रहा है जैसे 23 साल के एक नौजवान की गलती को आधार बनाकर उसे आदतन अपराधी साबित करने को कोशिश हो रही है। यह अन्याय है। मुझे पूरा यकीन है कि बॉम्बे हाई कोर्ट इन सब बातों पर गौर करेगा और आर्यन को जमानत देकर उनके साथ इंसाफ करेगा। आखिरकार आर्यन अपनी बेगुनाही साबित करेंगे।

On Wednesday, the Mumbai NDPS court gave an order which surprised everybody. The NDPS court judge V V Patil rejected the bail petition of superstar Shahrukh Khan’s son Aryan Khan, who is in Arthur Road central jail for the last 13 days. The judge had reserved his order on bail petition for the last five days, and, gave his order on Wednesday, rejecting bail applications of Aryan Khan and his two friends, Munmun Dhamecha and Arbaaz Merchant.

In his detailed order, the judge disclosed the reasons why he rejected the bail petitions. However, the fact remains: no drugs were seized from Aryan Khan, nor was any money found on his person, nor was there any evidence of Aryan purchasing or supplying drugs. No such mention has been made in the Narcotics Control Bureau’s report, nor was it mentioned by NCB lawyer in his arguments. The question arises: why was bail denied to Aryan? His lawyers, Amit Desai and Satish Maneshinde, were very much optimistic about getting bail because they knew that their arguments had solid reasons. Yet the bail petitions were rejected.

Aryan has been facing the full brunt of law for the last 17 days. First, he was in NCB custody, and since October 8 he is in judicial custody, meaning, he is in Arthur Road jail. When I went through the detailed order of the NDPS court judge, I was surprised. It appeared as if I was reading charges against an international drug mafia.

After going through the arguments of NCB, on the basis of which the bail petition was rejected, it appeared as if NCB has exposed a habitual drug addict, a drug peddler and one running an international drug racket.

The most surprising part is that nowhere in its arguments has the NCB said that drugs were seized from Aryan Khan. The NCB, in its arguments, admitted that it had no evidence of Aryan carrying drugs or that he was going to buy drugs. The question then arises: on what basis was the allegation made that Aryan could be part of an international drug racket?

In its reply, the NCB referred to WhatsApp chats that Aryan had with his friends on his cell phone. The NCB zeroed in on two phrases “hard drugs” and “bulk quantity” used in the chats to raise the suspicion that Aryan, the 23-year-old son of Shahrukh Khan, could be part of an international drug racket. These two phrases disclosed by NCB in its arguments clinched the ruling in its favour and the bail petitions were rejected. The NCB’s plan was evident when it added Section 29 of NDPS Act in the case against Aryan, meaning that it would oppose his bail pleas.

The NDPS court in its order said, “Prime facie material showing that Khan was in contact with persons dealing in prohibited narcotic substances as alleged by prosecution.” The court said, record shows Khan and Merchant admitted to being friends for long, travelled together to the party and were apprehended together. “In their voluntary statements, both disclosed they were possessing said substance for their consumption and for enjoyment. Moreover, WhatsApp chats prima facie reveal (Khan) is dealing in illicit drug activities of narcotic substances on a regular basis”, the 22-page order said.

The court said, “aspect of proving conspiracy is required to be considered only during trial, but prima facie it appears to be a case of conspiracy.” The court noted that Additional Solicitor General for NCB had shown WhatsApp chats of Khan with foreign national and unknown persons dealing in drugs, and their perusal revealed “references of bulk quantity and hard drugs”. However, accused Arbaaz Merchant’s lawyer said, that the phrase “bulk quantity” was used by Aryan Khan for football matches, whereas the NCB linked this with drug transactions.

Aryan Khan’s lawyers had told the court that WhatsApp chats cannot be produced as evidences in court, because they are not considered evidence under Indian Evidence Act. The Act clearly states that WhatsApp chats, without certification under Section 65B, are not admissible as evidence in court. They are not considered as reliable evidences, the lawyers had said. The court, however, said, that even if one agrees that the WhatsApp chats are not admissible as evidence in court, and that there is no certificate, the matter is still under investigation, hence certification is not required now.

In his detailed order, the judge said that case of each accused cannot be segregated from each other and cannot be considered in isolation. “There is prima facie involvement….in commission of grave and serious offences. This is not a fit case for granting bail”, the order said.

In his order, the judge also accepted the prosecution’s submission that though the three accused have no criminal antecedents, since all including Aryan Khan are “influential”, they are likely to tamper with evidence if released. The judge said, NCB was now investigating “other drug dealers who appear to be part of an international drug network”.

Several senior lawyers are not in agreement with the judge’s views expressed in the order. Lawyer Majid Memon says, there is simply no basis on which bail can be refused. Aryan Khan, he said, is not a habitual offender nor has he a criminal record, hence, he must be released on bail. An accused cannot be kept in jail as part of punishment.

Under the criminal justice system, an accused can be arrested or kept in custody only with a limited objective . Aryan has not committed an offence which calls for life imprisonment or capital punishment. He has no criminal antecedents and he will not be able to tamper with evidence, so there is no basis on which bail can be refused.

To put it bluntly, Aryan was refused bail only because he is the son of a superstar. The court felt that the 23-year-old youth was “influential”, since he is Shahrukh Khan’s son and he can influence witnesses. I feel, this is, to some extent, injustice to him. To be a son of a famous personality is not a crime. Aryan has been in custody for the last 17 days and the NCB had more than ample time to find out whether he had any links with any international drug network.

To label somebody as a criminal, or a part of an international drug mafia, only on the basis of WhatsApp chats, is an act that cannot be justified. While going through the court order, I realized there were simply no evidences to support the charges against the accused, and the entire case seems to have been framed on the basis of imagination, doubts and suspicions. Six grams of charas were found from Arbaaz Merchant’s possession. NCB suspects this 6 gm of charas was meant for Aryan Khan.

NCB feels that once Aryan comes out of jail, he may resume taking drugs and join the drug racket. When asked where the question of drug racket arose, NCB pointed towards WhatsApp chats between Aryan and Arbaaz. Merely on the basis of two phrases ‘bulk quantity’ and ‘hard drugs’, the NCB suspected that they were part of an international racket.

The court, in its order says, Aryan is not revealing the names of international dealers with whom he has contacts. Aryan’s and Arbaaz’s lawyers claim, the two were discussing football. Then where does the question arise about both naming international drug dealers?

Overall, it seems that the folly of a 23-year-old youth is being used to brand him as a habitual criminal. This is not the right thing to do. It is injustice. I have full confidence that the Bombay High Court will consider all these facts and give justice to Aryan by granting him bail. Aryan’s innocence will be proved ultimately.

आज मैं अरुणाचल प्रदेश के पूर्वी सेक्टर में वास्तविक नियंत्रण रेखा पर मौजूदा जमीनी हालात के बारे में बताना चाहता हूं। हमारे डिफेंस एडिटर मनीष प्रसाद ने 2 दिन तक अरुणाचल प्रदेश में फ्रंटलाइन का दौरा किया और इस दौरान ईस्टर्न आर्मी कमांड के जनरल ऑफिसर कमांडिंग-इन-चीफ, लेफ्टिनेंट जनरल मनोज पांडे से बात की।

ईस्टर्न आर्मी के कमांडर ने मौजूदा जमीनी हालात के बारे में स्पष्ट राय दी और विस्तार से बताया कि भारतीय सेना चीन की चुनौती का सामना करने के लिए कैसे कमर कस रही है। हालांकि मामला राष्ट्रीय सुरक्षा से जुड़ा है इसलिए मैं सेना की रक्षा तैयारियों से संबंधित कुछ महत्वपूर्ण जानकारियां साझा नहीं करूंगा, लेकिन यह कहना काफी होगा कि हमारी फौज किसी भी घटना से निपटने के लिए पूरी तरह तैयार हैं। चीन पश्चिमी सेक्टर के लद्दाख में जो कर रहा है, उसी तरह पूर्वी सेक्टर में भी वह अपनी फौज की तैनाती कर रहा है।

चीन की पीपुल्स लिबरेशन आर्मी (PLA) ने पूर्वी सेक्टर में LAC को पार तो नहीं किया है, लेकिन नियमित अभ्यास करने की आड़ में उसने LAC के करीब बड़ी संख्या में सैनिकों का जमावड़ा कर लिया है।

हमारे डिफेंस एडिटर का कहना है कि चीन द्वारा LAC के पास एक गांव बसाने की खबरें सही हैं। इस गांव में चीनी नागरिकों को बसाया गया है। इस गांव का इस्तेमाल आसानी से सेना के बंकर बनाने और किलेबंदी के लिए किया जा सकता है। चूंकि यह हमारे लिए चिंता का विषय है, इसलिए भारत की फौज ने भी LAC के पास बड़ी संख्या में सैनिकों को तैनात किया है। LAC के दोनों तरफ के जवान हाई अलर्ट पर हैं। चीन की सेना का यह रुख कोई नया नहीं है, लेकिन पहली बार भारत की फौज ने चीनियों को उन्हीं की भाषा में मजबूती और दृढ़ता से जवाब देने की ठान ली है।

हमारे पूर्वी सेना कमांडर ने कहा कि चीन LAC पर अपनी तरफ इंफ्रास्ट्रक्चर खड़ा करने में जुटा हुआ है, और भारत ने भी पहली बार बड़े पैमाने पर सड़कों, पुलों और कॉरिडोर्स का एक बड़ा नेटवर्क बनाना शुरू किया है। कई नए पुल बनाए गए हैं और बॉर्डर की सड़कों को चौड़ा किया जा रहा है। कई सुरंगें भी बनाई जा रही हैं ताकि खराब मौसम के दौरान भी हमारी फौजों का काफिला अपने हथियार लेकर जल्द से जल्द जीरो पॉइंट तक पहुंच सके।

ले. जनरल मनोज पांडे ने इंडिया टीवी को बताय़ा कि ‘हमारी पहली कोशिश होती है कि शांति बनी रहे, किसी तरह का टकराव न हो इसलिए बातचीत से रास्ता निकालने की कोशिश होती है। लेकिन फिर भी अगर दूसरा पक्ष दुस्साहस के इरादे से आता है, तो फिर उसे कैसे हैंडल करना है, उसके सामने क्या रुख अपनाना है, इसकी भी पूरी तैयारी है। दुश्मन को कैसे जबाव देना है, ये हमारे जवानों को अच्छी तरह मालूम है।’

भारत की चीन के साथ लगभग 3,500 किलोमीटर लंबी सीमा है, और इसके ज्यादातर इलाके में बॉर्डर का स्पष्ट निर्धारण नहीं हुआ है। चीन इसी बात का फायदा उठाता है और उसके सैनिक अक्सर LAC को पार करने की कोशिश करते हैं। दुश्मन की ऐसी हरकतों के बावजूद शांति बनाए रखने के लिए जबरदस्त संयम की आवश्यकता होती है। लेफ्टिनेंट जनरल पांडे ने कहा, ‘हमारी फौज हमेशा समझौतों का पालन करती है, लेकिन जहां आक्रामकता की जरूरत होती है, वहां एग्रेशन भी दिखाती है। चीन की सेना ने देख लिया है कि कैसे हमारे बहादुर जवानों ने पिछले साल लद्दाख की गलवान घाटी में हथियारों का इस्तेमाल किए बगैर चीनी सैनिकों से लड़ाई लड़ी थी।‘

चीन की सेना ने पूर्वी सेक्टर में ड्रोन और लंबी दूरी के UAV (मानव रहित हवाई वाहन) तैनात किए हैं। इनका मुकाबला करने के लिए भारतीय थल सेना ने पहली बार वायु सेना के साथ समन्वय रखते हुए एक इंटीग्रेटिड कमांड सेंटर की स्थापना की है। भारतीय वायुसेना ने राफेल और सुखोई जैसे फाइटर जेट तैनात किए हैं। पहली बार अटैक हेलीकॉप्टर और एडवांस लाइट हेलीकॉप्टर सरहद पर उड़ान भर रहे हैं, सीमा की निगरानी कर रहे हैं। इसके अलावा इजरायल निर्मित हाई-टेक यूएवी का इस्तेमाल दुश्मन सेना की गतिविधियों पर करीब से नजर रखने के लिए पहली बार किया जा रहा है। ये UAV 35,000 फीट की ऊंचाई से चीन के इलाके में 35 किलोमीटर अंदर तक की सारी हलचल रिकॉर्ड कर सकते हैं।

लेफ्टिनेंट जनरल मनोज पांडे ने कहा कि सेना का खुफिया नेटवर्क प्रभावी ढंग से काम कर रहा है और चीन की फौज को पता है कि उसकी एक-एक हरकत पर भारतीय सेना नजर रखे हुए है। सैटेलाइट सर्विलांस के साथ-साथ हमारे जवान भी खुद दुश्मन की गतिविधियों पर लगातार नजर रखते हैं।

पूर्वी सेक्टर में चीनी सेना की पेट्रोल पार्टी की आवाजाही पर नज़र रखने के लिए गश्त वाले इलाकों में आर्टिफिशियल इंटेलिजेंस से लैस सॉफ्टवेयर का इस्तेमाल करके निगरानी क्षमताओं को बढ़ा दिया गया है। दुश्मन के ठिकानों पर नजर रखने वाले ग्राउंड और एयर बेस्ड सेंसर्स को भी इंटीग्रेट किया जा रहा है।

रुपा में एक डिवीजन-स्तरीय निगरानी केंद्र स्थापित किया गया है, जो रीयल-टाइम इमेज और चीनी सैनिकों की गतिविधियों के बारे में लगातार जानकारी इकट्ठा करता है। UAC, हेलीकॉप्टर-बेस्ड सेंसर, ग्राउंड रडार और सैटेलाइट फीड से मिले सारी जानकारियों को इकट्ठा करके उनका विश्लेषण किया जाता है और उसके आधार पर जवाबी रणनीति तैयार की जाती है। जमीनी और हवाई सेंसरों को आपस में जोड़ा जा रहा है, और दुश्मन सैनिकों पर नजर रखने के लिए आधुनिकतम तकनीक का इस्तेमाल किया जा रहा है।

एक पोर्टेबल सर्विलांस सिस्टम भी विकसित किया जा रहा है जो LAC पार करने वाले दुश्मन सैनिकों और उनके वाहनों की संख्या के बारे में तमाम जानकारी ऑटोमैटिक तरीके से दे देगा। इस सिस्टम से मिली जानकारी को तुरंत सीनियर ग्राउंड कमांडरों को भेज दिया जाता है ताकि जवाबी कार्रवाई हो सके।

पूर्वी सेक्टर में LAC लगभग 1,346 किमी लंबी है जो सिक्किम से अरुणाचल प्रदेश तक फैली हुई है। चीन ने जब तिब्बत में बड़ी संख्या में अपने सैनिकों को तैनात किया तो हमारी सेना ने भी सरहद की हिफाज़त के लिए सैनिकों को लामबंद करके उसका करारा जवाब दिया। 17 माउंटेन स्ट्राइक कोर को विशेष तौर पर पूर्वी सेक्टर में दुश्मन की चुनौती का मुकाबला करने के लिए तैनात किया गया है। साथ ही इंटिग्रेटेड बैटल ग्रुप (IBG) पर भी काम चल रहा है जिसमें इंफैंट्री, आर्टिलरी और वायुसेना के अफसर भी शामिल होंगे। चीन के किसी भी दुस्साहस का मुकाबला करने के लिए भारतीय सेना ने हॉवित्जर तोपों, शिनूक हेलीकॉप्टरों को तैनात किया गया है। ब्रह्मपुत्र, सेला, नुचिपु और सिंखु ला टनल के निर्माण को लेकर युद्ध स्तर पर काम चल रहा है। इन सुरंगों के अगले साल तक तैयार होने की उम्मीद है।

ऐसे समय में जब चीन का सरकारी मीडिया कट्टर ‘युद्धं देहि’ रुख अपनाए हुए है और भारत को सबक सिखाने की धमकी दे रहा है, हमारे सशस्त्र बल चुपचाप जंग से जुड़ी अपनी तैयारियों में लगे हुए हैं। चीनी मीडिया अपने सैनिकों का मनोबल बढ़ाने के लिए गलवान घाटी में हुई झड़प का वीडियो भी दिखा रहा है। चीनी मीडिया का मुख्य उद्देश्य दुनिया को यह दिखाना है कि पश्चिमी और पूर्वी दोनों सेक्टरों में LAC पर चीनी सेना का दबदबा है, जबकि सच्चाई कुछ और है। हमारे सैनिक कमांडरों ने चीनी दबदबे के दावों को सरासर बकवास बताकर खारिज कर दिया है।
अब सवाल उठता है कि चीन दोनों सेक्टर्स में भारत की फौज की ताकत के बारे में सच्चाई जानते हुए भी इस तरह का झूठा प्रॉपेगैंडा क्यों कर रहा है? चीन ने जब भी भारत के किसी इलाके पर कब्जा करने का दावा किया तो उसे भारी कीमत चुकानी पड़ी । चीनी कंपनियों को भारतीय टेलिकॉम और हाईटेक सेक्टर से बाहर का रास्ता दिखाया जा चुका है। भारत सरकार चीनी ऐप्स पर पिछले साल से बैन लगा चुकी है।

चीन अब मोबाइल फोन के निर्माण में नंबर 1 नहीं है। पहली बार, Apple के iPhone का निर्माण चीन के बाहर भारत में किया जा रहा है। Apple का 5G इनबिल्ट मोबाइल फोन अब तमिलनाडु में बनेगा। Apple के बाहर होने के बाद चीन में मोबाइल फोन के निर्माण में 10 प्रतिशत की गिरावट आई है। कोरियाई कंपनी सैमसंग ने चीन में अपनी आखिरी मैन्युफैक्चरिंग यूनिट भी बंद कर दी है। चीन में सैमसंग हर साल 30 करोड़ मोबाइल फोन बनाया करता था, लेकिन अब उसने अपने सभी कारखानों को वियतनाम और भारत में ट्रांसफर कर दिया है। नोएडा की सबसे बड़ी सैमसंग यूनिट सालाना 12 करोड़ मोबाइल फोन बना रही है। चीन से पिछले 3 साल में 58 बड़ी कंपनियां शिफ्ट हुई हैं। इनमें से ज्यादातर कंपनियां भारत में शिफ्ट हो गई हैं।

चीन की सबसे बड़ी रियल एस्टेट कंपनी एवरग्रांडे दिवालिया होने की कगार पर है। इस कंपनी पर 23 लाख करोड़ रुपये से ज्यादा की देनदारी है। एवरग्रांडे के डूबने के बाद चीन की GDP लगभग एक-चौथाई गिर गई है। इसी तरह के और भी कई उदाहरण हैं। पहली बार पश्चिम की बहुराष्ट्रीय कंपनियां चीन को शक की नजर से देख रही हैं। यह चीनी अर्थव्यवस्था के लिए बुरी खबर है।

जहां तक भारत का सवाल है, उसने सैनिक और आर्थिक दोनों मोर्चों पर चीन का मुकाबला किया है। अगर आगे कोई टकराव होता है तो उसके लिए भी पूरी तैयारी है। हमारी फौज की ताकत, बहादुरी और क्षमता का अहसास चीन को अच्छी तरह से है। कुछ लोगों का सोचना है कि चीन के राष्ट्रपति शी जिनपिंग अपने देश की जनता का ध्यान घरेलू आर्थिक समस्याओं से हटाने के लिए भारत-चीन सीमा पर तनाव पैदा करने की कोशिश कर रहे हैं।

उधर, पाकिस्तान के आर्थिक हालात तो और भी खराब हैं। मंगलवार को FATF (फाइनेंशियल ऐक्शन टास्क फोर्स) ने पाकिस्तान को फिर से देशों की ग्रे लिस्ट में रखने का फैसला किया। इसका मतलब है कि पाकिस्तान को अंतरराष्ट्रीय वित्तीय संस्थानों से कर्ज नहीं मिलेगा। IMF, विश्व बैंक पहले ही पाकिस्तान को कर्ज देने से इनकार कर चुके हैं। पाकिस्तान का एकमात्र दोस्त अब चीन ही बचा है, लेकिन पाकिस्तान पहले ही चीन के बढ़ते कर्ज के बोझ तले कराह रहा है।

ये दोनों पड़ोसी मुल्क अपने लोगों का ध्यान भटकाने के लिए भारत से लगी अपनी सीमाओं पर तनाव पैदा करने की कोशिश कर रहे हैं। इन दोनों देशों को पता होना चाहिए कि भारतीय सेना के पास एक ही समय दो मोर्चों पर चुनौतियों का मुकाबला करने के लिए संसाधन और क्षमता है।

Today I would like to describe the ground situation prevailing at the Line of Actual Control in the eastern sector of Arunachal Pradesh. Our defence editor Manish Prasad visited the frontlines in Arunachal for two days and spoke to the General Officer Commanding-in-Chief, Eastern Army Command, Lt. Gen. Manoj Pande.

The eastern army commander gave his frank assessment about the current ground situation and described in detail, how Indian army is gearing up to meet the challenge from China. Of course, due to security reasons, I will not share some of the critical information relating to our defence preparedness, but suffice it to say that our armed forces are fully prepared to meet any eventuality. China is deploying its army in a big way in the eastern sector too, apart from what it has been doing in Ladakh, in the western sector.

The Chinese People’s Liberation Army (PLA) has not crossed the LAC in the eastern sector, but, in the guise of doing regular exercises, it has deployed a large number of troops close to the LAC.

Reports of the Chinese setting up a model village close to the LAC are correct, says our defence editor. Chinese nationals have been resettled in this village. This village can be easily used to set up army bunkers and fortifications. Since it is a matter of concern for us, the Indian army has also deployed troops in large number near the LAC. Troops on both sides of LAC are on high alert. The posturing of Chinese PLA is not new, but, for the first time, the Indian army has decided to reply to Chinese posturings firmly and resolutely.

Our eastern army commander said that China is busy setting up infrastructure on its side of LAC, and for the first time, India has started building a big network of roads, bridges and corridors in a big way. Several bridges have been set up and border roads are being widened. Several tunnels are also being set up so that our convoy of troops, carrying weapons, can reach the zero point speedily, without use of air assets during adverse weather conditions.

Lt Gen Manoj Pande said, “our first step is to opt for negotiations with the other side, to maintain peace and tranquility and avoid confrontation, but if the other side takes resort to misadventures, we are fully prepared how to respond. Our jawans know how to reply to the enemy effectively.”

India has a roughly 3,500 kilometre long border with China, and most parts of this border are properly delineated. China tries to take advantage of this, and its troops occasionally carry out transgressions. To maintain peace and tranquility in the face of such actions by the enemy, required tremendous restraint. Lt. Gen. Pande said, our forces always follow agreements, but where aggression is needed, they do show it. The PLA has seen how our brave jawans with bare hands and without weapons, fought the Chinese troops in Galwan valley in Ladakh last year.

The Chinese army has deployed drones and long-range UAVs (unmanned aerial vehicles) in the eastern sector. To counter this, the Indian army, for the first time, has set up an integrated command centre, to coordinate with the Indian Air Force, which has deployed Rafale and Sukhoi jet fighters, along with attack helicopters and advanced light helicopters. For the first time, Israeli-made hi-tech UAVs are being used to keep a close watch on enemy troop movements, from a height of 35,000 feet with a range of 35 km.

Lt. Gen. Manoj Pande said that the army intelligence network is working effectively and the Chinese PLA know that each of their movements is being watched by Indian army. Along with satellite surveillance, our jawans keep a physical watch over enemy movements.

The Army in eastern sector has stepped up surveillance capabilities by using new artificial intelligence-enabled software to track movement of Chinese army patrols. Ground and air-based sensors that keep watch over enemy positions are being integrated.

A division-level surveillance centre has been set up at Rupa which gets real-time images and inputs of Chinese troop movements along the LAC. All inputs from UAVs, helicopter-based sensors, ground radars and satellite feeds are integrated, collated and analysed to formulate a response strategy. Ground and air sensors are being fused, and latest technology is being used to keep watch on enemy troops.

A portable surveillance system is being developed which automatically counts the number of enemy troops transgressing LAC and their mode of transport. This is immediately relayed to senior ground commanders for an effective response.

The LAC in the eastern sector is roughly 1,346 km long which spreads from Sikkim to Arunachal Pradesh. After China deployed large number of troops in Tibet, our army responded by mobilizing more troops to guard the frontier. The 17 Mountain Strike Corps has been deployed specifically to counter challengers from enemy in the eastern sector. Work is going on to set up an Integrated Battle Group consisting of men from artillery, infantry and air force. Howitzer guns, Chinook helicopters have been deployed by Indian army to counter the Chinese threat. Work is going on a war footing to building tunnels under Brahmaputra, Sela, Nuchipu and Sinkhu La. These tunnels are expected to be ready by next year.

At a time when the Chinese state-supported media has become jingoistic and is threatening to teach India a lesson, our armed forces are quietly carrying on with their war preparedness. Chinese media has been showing video of Galwan Valley confrontation to boost the morale of its troops. Their main aim is to show to the world that the Chinese PLA has an upper hand at the LAC, both in the western and eastern sectors, but our army commanders have rejected these claims as rubbish.

The question is: why are the Chinese trying to peddle lies and propaganda, when they know about the huge deployments made by India in both sectors? Whenever China made big claims about grabbing territory, it had to pay a heavy price. Chinese companies have been shown the way out from Indian telecom and hi-tech sectors. Chinese apps were banned by Indian government.

China is no more No. 1 in cellphone manufacturing. For the first time, Apple’s iPhone has been manufactured outside China, in India. Apple’s 5G inbuilt cellphone will now be manufactured in Tamil Nadu. There has been a 10 per cent drop in cellphone manufacturing in China, after Apple walked out. Korean company Samsung has closed its last manufacturing unit in China. Samsung used to manufacture 30 crore cellphone units in China, but now it has shifted all its factories to Vietnam and India. The biggest Samsung unit in Noida manufactures 12 crore cellphones annually. 58 big companies have shifted from China in the last three years. Most of these companies have shifted to India.

One of the biggest real estate companies in China, Evergrande, is now on the brink of bankruptcy, with a liability of Rs 23 lakh crore. China’s GDP fell almost one-fourth after the collapse of Evergrande company. There are many other similar examples. For the first time, multinational companies from the West are looking at China with suspicion. This is bad news for the Chinese economy.

As far as India is concerned, it has fought China both on the economic and military fronts. Our armed forces are ready to face any military challenge from China. The Chinese PLA knows the valour, capability and tenacity of the Indian army jawans and officers. A section of people think that in order to divert the Chinese people’s attention from domestic economic problems, the Chinese President Xi Jinping is trying to create tension on India-China border.

Pakistan’s economic problem is worse. On Tuesday, the FATF (Financial Action Task Force) again decided to keep Pakistan in the grey list of countries. This means that Pakistan will not get loans from international financial institutions. IMF, World Bank have already refused to give loans to Pakistan. The only friend left for Pakistan is China, but already Pakistan is groaning under mounting Chinese debts.

Both these neighbours are therefore trying to create tension on their borders with India in order to divert the attention of their people. Both these countries should know that the Indian armed forces has the resources and capability to counter a two-front challenge.

बांग्लादेश में पिछले कई दिनों से हिन्दुओं को निशाना बनाकर उनपर हमले किए जा रहे हैं। हिंदुओं के घर जलाए जा रहे हैं, उन्हें मारा जा रहा है और साजिश के तहत उनकी संपत्ति को नुकसान पहुंचाया जा रहा है। इन घटनाओं से यहां रहने वाले करीब 1.5 करोड़ हिंदू डरे हुए हैं। रविवार की रात रंगपुर में हिंदू मछुआरों की बस्ती पर करीब 200 लोगों की भीड़ ने हमला कर दिया और 29 घरों में आग लगा दी। वहीं, राजधानी ढाका से 157 किमी दूर फेनी में शनिवार को भीड़ ने हिंदू मंदिरों और दुकानों में तोड़फोड़ की।

पांच दिन पहले कोमिला में एक पूजा पंडाल में पवित्र कुरान के कथित अपमान को लेकर अफवाह फैलने के बाद दुर्गा पूजा पंडालों और हिंदू मंदिरों में तोड़फोड़ की घटनाएं हुईं। इस घटना के बाद से बांग्लादेश में हिंदुओं पर हमलों की संख्या कई गुना बढ़ गई है।

बांग्लादेश की प्रधानमंत्री शेख हसीना और उनके मंत्रियों ने उस वक्त हिन्दुओं की रक्षा करने और उन पर हमला करने वालों को सजा देने का भरोसा दिलाया था। लेकिन उसका कोई असर नहीं हुआ। न हिन्दुओं पर हमले बंद हुए और न हिंसा खत्म हुई। इतना ही नहीं इस्कॉन के मंदिर में भी तोड़फोड़ हुई और दो कृष्णभक्तों की हत्या कर दी गई।

भीड़ को हमले और हिंसा के लिए उकसाने वाले इस्लामिक जिहादी नेताओं को न तो गिरफ्तार किया गया और न ही उन्हें जेल भेजा गया। सरकार की तरफ से कड़े एक्शन लेने में हुई कमी की वजह से परोक्ष तौर पर दंगाइयों का मनोबल बढ़ गया और उन्होंने हिंदुओं को निशाना बनाकर लूटपाट, रेप और आगजनी जैसी घटनाओं को अंजाम देना शुरू कर दिया।

बांग्लादेश में हिन्दुओं पर हो रहे अत्याचार के वीडियो और तस्वीरें डराने वाली हैं। इन्हें देखकर आपको लगेगा कि बांग्लादेश में हिन्दू अपने घर में भी सुरक्षित नहीं हैं। न दिन में बेखौफ होकर घर से बाहर निकल सकते हैं और न रात में निश्चिंत होकर सो सकते हैं। ये लोग अब मदद के लिए भारत की तरफ देख रहे हैं। बांग्लादेशी हिन्दू भाई-बहनों के समर्थन में बंगाल से लेकर असम तक प्रदर्शन हो रहे हैं।

सोमवार की रात अपने प्राइम टाइम शो ‘आज की बात’ में हमने बांग्लादेशी हिन्दुओं के दर्द को दिखाया। पीड़ितों ने यह बताया कि कैसे वे रंगपुर जिले के पीरगंज इलाके में जब अपने घरों के अंदर सो रहे थे तो अचानक 200 से ज्यादा लोगों की हिंसक भीड़ ने हिंदुओं के घरों को घेर लिया। भीड़ में शामिल लोग नारे लगा रहे थे। इसके बाद पुरुषों को घर से बाहर निकाला और उन्हें बुरी तरह से पीटा। महिलाएं और बच्चे भी जान बचाने के लिए धान के खेतों की ओर भागे। इसके बाद देखते ही देखते भीड़ ने हिंदुओं के ज्यादातर घरों में आग लगा दी। 65 में से 29 घर पूरी तरह से जला दिए गए।

जो घर जलने से बच गए उन्हें पूरी तरह से लूट लिया गया। नकदी, गहने और कीमती सामान के साथ ही दंगाई कपड़े और बर्तन तक ले गए। अब इन लोगों के पास कुछ नहीं बचा है। दंगाइयों के जाने के बाद इन लोगों ने पुलिस से एक-एक दंगाई का नाम बताया जिन्हें वे जानते थे, वे सभी मुस्लिम थे लेकिन पुलिस और प्रशासन की तरफ से कोई एक्शन नहीं लिया गया। इस इलाके के ज्यादातर हिंदू अब बेघर हो चुके हैं। मुसीबत ये है कि अब न सिर पर छत है, न पहनने को कपड़े हैं और न खाने को खाना है। सैकड़ों हिन्दू परिवार इस चिंता में है कि दोबारा घर कैसे बनाएंगे और बच्चों को क्या खिलाएंगे।

सबसे पहले 13 अक्टूबर को कोमिला में दुर्गा पूजा पंडाल और मंदिर पर हमला हुआ। इसके तुरंत बाद चटगांव, चांदपुर और अन्य शहरों में मंदिरों, पूजा पंडालों पर हमले और तोड़फोड़ की घटनाएं हुई। अभी भी हमलों की संख्या में किसी तरह की कमी होने के संकेत नहीं मिले हैं।

बांग्लादेश के अधिकारियों के मुताबिक हर घटना में एक जैसा ही पैटर्न नजर आ रहा है। हर घटना का बैकग्राउंड धार्मिक ग्रंथ की बेअदबी और ईशनिंदा से जोड़ा गया। सबसे पहले सोशल मीडिया पर बेअदबी की झूठी अफवाह फैलाई गई और इसके तुरंत बाद भीड़ ने हिंदू मंदिरों, उनके घरों और व्यापारिक ठिकानों को निशाना बना शुरू कर दिया।

बांग्लादेश पुलिस के मुताबिक, रंगपुर में हिंदू बस्ती पर हुए हमले में कट्टरपंथी जमात-ए-इस्लामी और उसके स्टूडेंट विंग का हाथ होने का पता चला है, यहां 29 घरों में आग लगा दी गई। हैरानी की बात ये है कि बांग्लादेश के कुछ नेता और पुलिस अफसर हिन्दुओं पर हुए हमलों को सही ठहराने की भी कोशिश कर रही है। कुछ नेताओं ने कहा कि सोशल मीडिया पर इस्लाम को लेकर अपमानजनक पोस्ट किया गया इसलिए हिंसा भड़की। हालांकि बांग्लादेश के गृह मंत्री असदुज्जमां खान ने वादा किया है कि जिनके घरों का नुकसान हुआ है, सरकार उनकी मरम्मत कराएगी। जो सामान लूटा गया है या जल गया है, सरकार मुआवजा देकर उसकी भरपाई करेगी। लेकिन इसके बाद भी लोगों में खौफ कम होने का नाम नहीं ले रहा है।

बांग्लादेश के ढाका, चटगांव और अन्य शहरों में सोमवार को हिंदुओं ने अपनी सुरक्षा और दंगाइयों की गिरफ्तारी की मांग को लेकर विरोध प्रदर्शन किया। कोलकाता में सोमवार को बांग्लादेश के डिप्टी हाईकमिश्नर के दफ्तर के बाहर विरोध प्रदर्शन हुआ। इस विरोध प्रदर्शन में शामिल नेताओं ने आरोप लगाया कि बांग्लादेश में हिंदुओं पर हो रहे हमले को लेकर वहां का बहुसंख्यक मुस्लिम समाज चुप है, यह बेहद गंभीर प्रवृत्ति है। उन्होंने कहा अगर जल्द कार्रवाई नहीं कई गई तो जिहादी तत्व बड़ी संख्या में हिंदुओं को निशाना बनाएंगे। कोलकाता के साथ ही गुवाहाटी में भी विरोध प्रदर्शन हुआ। यहां इस्कॉन के स्थानीय नेता ने बांग्लादेश में संयुक्त राष्ट्र शान्ति सेना तैनात करने की मांग की।

बांग्लादेश के गृह मंत्री असदुज्जमां खान का कहना है कि उनके यहां हिन्दुओं को कोई खतरा नहीं है। हिन्दुओं पर हमले बांग्लादेश को बदनाम करने की साजिश के तहत किए गए हैं। उनकी आधी बात सही है। सिर्फ इतना सही है कि हिन्दुओं पर हमले साजिश के तहत हो रहे हैं लेकिन साजिश बांग्लादेश को बदनाम करने की नहीं बल्कि बांग्लादेश से हिन्दुओं को भगाने की हो रही है। हिंदुओं को उनकी मातृभूमि से अलग करने की साजिश हो रही है। जरा सोचिए, पहले फेसबुक पर ये अफवाह फैलाई गई कि एक हिन्दू लड़के ने पवित्र ग्रंथ का अपमान किया और फिर कुछ ही देर में सैकड़ों लोग इक्कठे हो गए। पूरे गांव को घेर लिया और घरों को आग के हवाले कर दिया। फिर ये अफवाह फैलाई गई कि मंदिर में कुरान का अपमान हुआ और इसके कुछ ही देर के बाद मंदिर पर हमला हो गया।

हकीकत ये है कि बांग्लादेश में हिन्दुओं पर हमले सिर्फ नौ दिन में नहीं हुए हैं। बांग्लादेश के एक मानवाधिकार संगठन (Legal and Conciliation Centre) की रिपोर्ट मैंने देखी है। पिछले नौ वर्ष में बांग्लादेश में हिन्दुओं पर हमले की 3,679 घटनाएं हुई हैं। 1,559 घरों को लूट लिया गया और उनमें आग लगा दी गई। हिंदुओं के 442 व्यापारिक ठिकानों में तोड़फोड़ की गई और इन्हें आग के हवाले कर दिया गया। वहीं हिंदू देवी-देवताओं की मूर्तियां तोड़ने, मंदिरों पर हमले, तोड़फोड़ और आगजनी की 1,678 घटनाएं हुईं। इन हमलों में 11 हिंदुओं की मौत हो गई जबकि 862 हिंदू घायल हुए थे।

अगर ये सब बांग्लादेश को बदनाम करने की साजिश के तहत हो रहा है तो क्या नौ महीने से बांग्लादेश की सरकार सो रही है? इस साजिश को नाकाम करने के लिए बांग्लादेश की सरकार ने क्या किया? हिन्दुओं की सुरक्षा के लिए क्या किया? कुल मिलाकर हकीकत ये है कि बांग्लादेश में हिन्दू असुरक्षित और डरा हुआ है। उसकी संपत्ति और जिंदगी दोनों खतरे में है।

सोमवार को अमेरिकी विदेश मंत्रालय ने बांग्लादेश में हिंदुओं पर हुए हमले की निंदा की। विदेश मंत्रालय के प्रवक्ता ने कहा- “ अपना धर्म चुनने की आजादी हर इंसान का अधिकार है, दुनिया का हर व्यक्ति, चाहे वह किसी भी धर्म या आस्था को मानने वाला हो, अपना महत्वपूर्ण त्योहार मना सकें, इसके लिए यह जरूरी है कि वह खुद को सुरक्षित महसूस करे।“ प्रवक्ता ने कहा,‘‘ विदेश मंत्रालय, बांग्लादेश में अल्पसंख्यक हिन्दू समुदाय के लोगों पर हाल में हुए हमलों की घटनाओं की निंदा करता है।’’

इस बीच, बांग्लादेशी हिन्दू समुदाय के सदस्य प्राणेश हलदर ने एक बयान जारी किया, ‘‘ बांग्लादेश में पहले से ही परेशानियों में घिरे हिन्दुओं को और नुकसान नहीं पहुंचे, यह सुनिश्चित किया जाए।’’

उधर रविवार को बांग्लादेशी हिंदुओं ने वॉशिंगटन में बांग्लादेश दूतावास के बाहर विरोध प्रदर्शन किया। इन लोगों ने अमेरिका में नवाधिकार को लेकर सक्रिय सभी निगरानी समूहों और मीडिया से आग्रह किया कि वे बांग्लादेश के हिंदुओं के खिलाफ हो रही हिंसा की घटनाओं को गंभीरता को उजागर करें। एक बांग्लादेशी हिंदू प्रवासी नेता ने कहा, बांग्लादेश में रहने वाले मूल हिन्दू लगातार नफरत और भेदभाव के शिकार हो रहे हैं। वहां हिन्दुओं की आबादी 40 के दशक में 28 प्रतिशत थी जो अब तेजी से घट कर 9 प्रतिशत पर आ गई है।
